ITEM EXPLANATION Since this proposal calls for actions of both City Council and Housing and Redevelopment Commission, this item can be presented as a joint public hearing. A joint public hearing for RP 84-8/CP 287 and CT 84-17 Carlsbad Office Center was held by the Design Review Board and the Planning Commission at their meeting of July 11, 1984. The applicant is requesting a Redevelopment Permit including a tentative tract map and condominium permit to sub-divide an existing office building into a 24- unit non-residential (office) condominium. No structural changes are proposed for the 13,400 square foot, two- story office building. The subject property is located at 2945 Harding Street, in Sub-area 1 of the Redevelopment Area. The existing and proposed use are encouraged in this subarea as stated in the Village Design Manual. The Design Review Board and Planning Commission in a joint public hearing voted in favor of APPROVING RP 84-8/CP-287 and CT 84-17. FISCAL IMPACT Staff analysis of the proposed condominium conversion concluded that, as a condominium, the building will not function much differently than it does presently. APRIL 24, 1984 w STAFF REPORT DATE: July 11, 1984 TO: Planning-Commission FROM: Land Use Planning Office SUBJECT: RP 84-8 and CT 84-17/CP-287 - CARLSBAD OFFICE CENTER - Request for a redevelopment permit, tentative tract map and condominium permit to subdivide an existing office building into a 24-unit non-residential (office) condominium. I. RECOMMENDATION It is recommended that the Design Review Board ADOPT Design Review Board Resolution No. 037 APPROVING RP 84-8 and the Planning Commission ADOPT Planning Commission Resolution No. 2319, APPROVING CT 84-lf/CP-287, based on the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION The proposed project involves the subdivision of an existing 13,400 square foot, two-story office building into 24 airspace . office units. No structural changes are proposed to the building, located at 2945 Harding Street, across from Sonny's Drive-Thru Restaurant. The site is situated in Subarea I of the redevelopment area. The non-residential planned development ordinance requires that four findings must be made for approval of such condominiums. Existing buildings requesting conversion must meet the same findings. They are as follows: 1) 2) 3) 4) The granting of this permit will not adversely affect and will be consistent with the code, the general plan, applicable specific plans, master plans, and all adopted plans of the City and other governmental agencies. The proposed use at the particular location is necessary and desirable to provide a service or facility which will contribute to the general well-being of the neighborhood and the community. Such use will not be detrimental to the health, safety or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity. The proposed non-residential planned development meets all of minimum development standards of the underlying zoner except for lot area. III. ANAL;YSIS Planning Issues 1) Does the proposed project meet the required findings for approval of a non-residential planned development as stated above? Discussion Staff analysis of the proposed condominium conversion has concluded that, as a condominium, the building will not function greatly different than it does presently under single ownership. The structure iS attractive, and provides sufficient parking, setback, and landscape amenities so as to meet all development standards of Subarea I of the V-R zone. As conditioned, the landscaping and lavatory facilities will be upgraded, so as to improve the overall project. The existing and proposed use is encouraged in this subarea as stated in the Village Design Manual. Conversion of this building is consistent with the general plan, compatible with surrounding uses, and will not be detrimental to the community, It further meets all development standards of the underlying zone. IV. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that this project is categorically exempt from environmental review per Section 19.04.070(H) of the Carlsbad Municipal Code and a Notice of Exemption was filed on June 18, 1984. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. 3) The applicant shall give notice of the conversion to all tenants as required by the Subdivision Map Act and the Carlsbad Municipal Cede. Location of said receptacles shall be approved by the Land Use Plannin! Manager. 8) All roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction ol the Land Use Planning Manager and Building and Planning Director.
