ITEM EXPLANATION A public hearing for RP 84-9 was held by the Design Review Board at their meeting of September 12, 1984. The applicant proposed the construction of a 10,692 square foot office building with twenty- five parking spaces, two short of the amount required by code. The applicant also requested a 5.97 foot street vacation along Jefferson Street. The Design Review Board expressed concern and directed the applicant to revise plans and return. The applicant revised the plans, enlarging the underground parking garage to accommodate twenty-three spaces. An additional seven parking spaces would be provided at the rear of the building and accessed from the alley. The Design Review Board reviewed the revised plans at their meeting of November 14, 1984, and voted to adopt Design Review Board Resolution No. 041, recommending APPROVAL of RP 84-9. FISCAL IMPACT This action will result in no fiscal impact to the City. I. RECOMMENDATION It is recommended that the Design Review Board APPROVE the Negative Declaration issued by the Land Use Planning Manager and ADOPT Resolution No. 041, recommending APPROVAL of RP 84-9, based on the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION & BACKGROUND The proposed office project was considered by the Design Review Board at their September 12 meeting. The applicant was proposing construction of a 10,692 square foot office building with 25 parking spaces, 2 spaces short of the amount required by code. The applicant was also requesting a 5.97-foot street vacation along Jefferson Street. The Design Review Board expressed concern regarding the proposed parking shortage and use of the property requested to be vacated. The Design Review Board directed the applicant to revise the plans to provide the required parking and to eliminate use of the right-of-way property and the need for a street vacation. The applicant has revised the plans, enlarging the underground parking garage to accommodate 23 spaces. An additional seven ' parking spaces would be provided at the rear of the building and accessed from the alley. The office building has also been enlarged to 12,000 square feet. The proposed thirty parking spaces would comply with the required parking ratio for the enlarged building. The building is now sited to provide a full 24 feet of back-up area from parking spaces accessed from the alley. The textured paving entry, stairs and landscaping would, however, still encroach in the right-of-way of Jefferson Street. Staff is recommending a condition of approval to require modification of the entry to eliminate all encroachments, other than landscaping, in the right-of-way. . Overall, staff believes that the proposed project, as conditioned and modified, complies with the direction given by the Design Review Board and the goals and objectives of the Village Design Manual. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Design Review Board of the City of Carlsbad as follows: (A) That the foregoing recitations are true and correct. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the general plan. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final map. This project is approved upon the express condition that the - applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee, a copy of that agreement, dated May 5, 1984, is on file with the City Clerk and incorporated herein by reference. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. The applicant shall prepare a reproducible mylar of the final site plan incorporating the conditions contained herein. Saic site plan shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of building permits. The applicant shall prepare a detailed landscape and irriga- tion plan which shall be submitted to and approved by the Lane Use Planning Manager prior to the issuance of building permits. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Any signs proposed for this development shall be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Land Use Planning Manager prior to installation of such signs. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Land Use Plannin! Manager. All roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction OI the Land Use Planning Manager and Building and Planning Director. The existing Palms shall be located to a site and in a manner acceptable to the Director of Parks and Recreation. The applicant shall redesign the building entry to remove all encroachments, other than approved landscaping, from the public right-of-way. Engineering Conditions: 14) The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. //// ///I DRB RESO NO. 041 -3- k . 1 2 3 4 5 6 7 e 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 15) The grading for this project is defined as "controlled grad- ing" by Section 11.06.170(a) of the Carlsbad Municipal Code. Grading shall be performed under the observation of a civil engineer whose responsibility it shall be to coordinate site inspection and testing to insure compliance of the work with the approved grading plan, submit required reports to the City Engineer and verify compliance with Chapter 11.06 of the Carlsbad Municipal Code. 16) No grading shall occur outside the limits of the development unless a letter of permission is obtained from the owners of the affected properties. 17) A separate grading plan shall be submitted and approved and a separate grading permit issued for the borrow or disposal site if located within the city limits. 18) 19) All slopes within this project shall be no steeper than 2:l. Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. 20) The developer shall exercise special care during the construction phase of this project to prevent any off-site siltation. The developer shall provide erosion control measures and shall construct temporary desiltation/detention b.asins of type, size and location as approved by the City Engineer. The basins and erosion control measures shall be shown and specified on the grading plan and shall be constructed to the satisfaction of the City Engineer prior to the start of any other grading operations. Prior to the removal of any basins or facilities so constructed the area served shall be protected by additional drainage facilities, slope erosion control measures and other methods required or approved by the City Engineer. The developer shall maintain the temporary basins and erosion control measures for a period of time satisfactory to the City Engineer and shall guarantee their maintenance and satisfactory performance through cash deposit and bonding in amounts and types suitable to the City Engineer. 21) Additional drainage easements and drainage structures shall be provided or installed as may be required by the County Department of Sanitation and Flood Control or the City Engi- neer. 22) The developer shall pay the current local drainage area fee prior to approval of the final map or shall construct drain- aqe systems in conformance with the Master Drainage Plan and City of Carlsbad Standards as required by the City Engi-neer. DRB RESO NO. 041 -4- . 1 2 3 4 E Y 6 7 E 9 1c 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 23) All land and/or easements required to satisfy the conditions of approval for this project shall be granted to the City, without cost to the City, free and clear of all liens and encumbrances and without cost to the City. 24) Improvements listed in this section shall be installed or agreed to be installed by secured agreement by the developer before the issuance of any building permit. The developer shall obtain approval of the plans from the City Engineer and pay all associated fees and performance guarantees prior to issuance of any building permit. The developer shall install said improvements to the satisfaction of the City Engineer prior to issuance of a Certificate of Occupancy or occupancy of any portion of the project for any purpose. The improvements are: a) Grand Avenue to collector street standards from the centerline of Jefferson Street to the easterly line of the alley along the easterly perimeter of the project for the half of the street width fronting the project, except that the street section shall be the width as shown on the cross-section on the site plan and to accommodate the 60-inch diameter Eucalyptus tree shown on the plan. b) Jefferson Street to collector street standard from the centerline of Grand Avenue to the southerly line of the project boundary for half of the street width fronting the project, except that the street section shall be as shown on the site plan. cl The alley between Harding Street and Jefferson Street from the southeasterly corner of the project to Grand Avenue to full 20-foot wide alley standards. 25) As well as conforming to all applicable City requirements, the developer shall modify the site plan as follows: a) Sight distance at the corner of Grand Avenue and Jefferson Street shall be provided in accordance with City standards. b) Excepting only the parking stalls designated "compact", all parking stalls shall have an area no less than 170 square feet and a width no less than 8.5 feet. Areas shadowed by columns or other parts of the building structure shall not be included in the required area. All private driveways shall be kept clear of parked vehicles at all times, and shall have posted "No Parking/Fire Lane Tow Away Zone" pursuant to Section 17.04.040, Carlsbad Municipal Code. All plans, specifications, and supporting documents for the improvements of this project shall be signed and sealed by the Engineer in responsible charge of the work. Each sheet shall be signed and sealed, except that bound documents may be signed and sealed on their first page. Additionally the first sheet of each set of plans shall have the following certificate: "DECLARATION OF RESPONSIBLE CHARGE" I hereby declare that I am the Engineer of Work for this project, that I have exercised responsible charge over the design of the project as defined in Section 6703 of the . Business and Professions Code, and that the design is consistent with current standards. I understand that the check of project drawings and specifications by the City of Carlsbad is confined to a review only and does not relieve me, as Engineer of Work, of my responsibilities for project design. RECOMMENDATION It is recommended that the Design Review Board APPROVE the Negative Declaration issued by the Land Use Planning Manager and ADOPT Resolution No. 041, recommending APPROVAL of RP 84-9, based on the findings and subject to the conditions contained therein. II. PROJECT DESCRIPTION The applicant is requesting approval of a Redevelopment Permit to develop a 10,692 square foot office building on .24 acres, - located as described above. The subject property is a level corner lot, fronting on both Grand Avenue and Jefferson Street. The site rears on an alley. The proposed two-story structure would be developed over semi- subterranean parking. Access to this parking would be derived from Jefferson Street. Seven additional spaces would be provided at the rear of the building and accessed from the alley. A request for street vacation of 5.97 feet along Jefferson Street accompanies this project. The Engineering Department is recommending approval of the request to the City Council. A condition of approval has been added to this project making approval contingent upon street vacation. III. ANALYSIS Planning Issues 1) Is the proposed project consistent with the goals and objectives of the Village Design Manual? 2) Does the proposed project conform to the requirements of the Zoning Ordinance? . /- 5 Discussion The project site is located within Sub-area 1 of the Village Redevelopment project. This sub-area has traditionally served as the central business district of Carlsbad. The goal for Sub- area 1 is to function as a major financial, specialty, commercial center for the downtown area. Uses encouraged within the sub-area include bonafide restaurants, retail and specialty shops and professional complexes. Staff believes that the proposed project is consistent with both the goals and permitted uses of the sub-area. The proposed project, however, does not conform to all requirements of the Zoning Ordinance. The project would provide a total of 25 parking spaces, five of them compact. The Zoning Ordinance requires office projects in the redevelopment area to provide one parking space per 400 square feet of gross floor area. The project is thereby required to provide 26.73 or 27, spaces. The downtown area already has office parking requirements lower than the rest of the City. As a redevelopment endeavor, however, staff is not adverse to supporting the project with the minor parking reduction and does not anticipate any significant impacts on parking or traffic congestion as a result . of this project. The Zoning Ordinance also requires that a lot which abuts an alley observe a five foot rear yard setback to any structure or parking. The proposed project observes only a two-foot setback. A condition of approval is being recommended that would require the building to be relocated two feet closer to Jefferson Street. The result would be a four-foot rear yard setback. Staff believes this to be adequate as it would provide 24 feet for ingress and egress to parking and allow the maximum area along Jefferson Street for landscaping. Overall, staff believes that the project conforms to all other requirements of the Zoning Ordinance and is consistent with the goals and objectives of the Village Design Manual. IV. DESIGN/ARCHITECTURE The two-story structure would utilize wood frame construction and feature a contemporary design. Gray redwood siding would be used on most of the building with a medium brown wood trim. Off- white stucco and masonry and brown asphalt shingles would also be used. Handrails would be accented in bright blue. (A material board will be available for your inspection at the meeting). -2- . c- . . - v. ENVIRONMENTAL REVIEW The Land Use Planning Manager has determined that this project will not have a significant impact on the environment and, therefore, issued a Negative Declaration on July 17, 1984. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the general plan. This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Land Use Planning Manager on July 17, 1984 and approved by the Commission on September 12, 1984. Ionditions: ‘/// ‘/// Approval is granted for RP 84-9, as shown on Exhibits "A" and “B" dated November 14, 1984 and Exhibit "C", dated July 23, 1984, incorporated by reference and on file in the Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these conditions. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This note shall be placed on the final map. This project is approved upon the express condition that the - applicant shall pay a public facilities fee as required by City Council Policy No. 77, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee, a copy of that agreement, dated May 5, 1984, is on file with the City Clerk and incorporated herein by reference. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. The applicant shall prepare a reproducible mylar of the final site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of building permits. The applicant shall prepare a detailed landscape and irriga- tion plan which shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of building permits. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. Any signs proposed for this development shall be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Land Use Planning Manager prior to installation of such signs. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Land Use Planning Manager. All roof appurtenances, including air conditioners, shall be architecturally integrated and shielded from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction of the Land Use Planning Manager and Building and Planning Director. The existing Palms shall be located to a site and in a manner acceptable to the Director of Parks and Recreation. The applicant shall redesign the building entry to remove all encroachments, other than approved landscaping, from the public right-of-way. -_ ngineering Conditions: 4) The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. ‘/// ‘/// -3- : ,.’ I J .* 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 15) 16) 17) 18) 19) 20) 21) 22) The grading for this project is defined as "controlled grad- ing" by Section 11.06.170(a) of the Carlsbad Municipal Code. Grading shall be performed under the observation of a civil engineer whose responsibility it shall be to coordinate site inspection and testing to insure compliance of the work with the approved grading plan, submit required reports to.the City Engineer and verify compliance with Chapter 11.06 of the Carlsbad Municipal Code. No grading shall occur outside the limits of the development unless a letter of permission is obtained from the owners of the affected properties. A separate grading plan shall be submitted and approved and a separate grading permit issued for the borrow or disposal site if located within the city limits. All slopes within this project shall be no steeper than 2:l. Prior to hauling dirt or construction materials to any proposed construction site within this project the developer shall submit to and receive approval from the City Engineer for the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operation. The developer shall exercise special care during the construction phase of this project to prevent any off-site siltation. The developer shall provide erosion control measures and shall construct temporary desiltation/detention basins of type, size and location as approved by the City Engineer. The basins and erosion control measures shall be shown and specified on the grading plan and shall be constructed to the satisfaction of the City Engineer prior to the start of any other grading operations. Prior to the removal of any basins or facilities so constructed the area served shall be protected by additional drainage facilities, slope erosion control measures and other methods required or approved by the City Engineer. The developer shall maintain the temporary basins and erosion control measures for a period of time satisfactory to the City Engineer and shall guarantee their maintenance and satisfactory performance through cash deposit and bonding in amounts and types suitable to .the City Engineer. Add-itional drainage easements and drainage structures shall be provided or installed as may be required by the County Department of Sanitation and Flood Control or the City Engi- neer. The developer shall pay the current local drainage area fee prior to approval of the final map or shall construct drai::- age systems in conformance with the Master Drainage Plan and City of Carlsbad Standards as required by the City Engineer. -4- .,-.; * . \ I 2 z 4 F . Improvements listed in this section shall be installed. or agreed to be installed by secured agreement by the developer before the issuance of any building permit. The developer shall obtain approval of the plans from the City Engineer and pay all associated fees and performance guarantees prior to issuance of any building permit. The developer shall install said improvements to the satisfaction of the City Engineer prior to issuance of a Certificate of Occupancy or occupancy of any portion of the project for any purpose. The improvements are: a) Grand Avenue to collector street standards from the centerline of Jefferson Street to the easterly line of the alley along the easterly perimeter of the project for the half of the street width fronting the project, except that the street section shall be the width as shown on the cross-section on the site plan and to accommodate the 60-inch diameter Eucalyptus tree shown on the plan. b) Jefferson Street to collector street standard from the centerline of Grand Avenue to the southerly line of the project boundary for half of the street width fronting the project, except that the street section shall be as shown on the site plan. cl The alley between Harding Street and Jefferson Street from the southeasterly corner of the project to Grand Avenue to full 20-foot wide alley standards. As well as conforming to all applicable City requirements, the developer shall modify the site plan as follows: a) Sight distance at the corner of Grand Avenue and Jefferson Street shall be provided in accordance with City standards. b) Excepting only the parking stalls designated "compact", all parking stalls shall have an area no less than 170 square feet and a width no less than 8.5 feet. Areas shadowed by columns or other parts of the building structure,shall not be included in the required area. The aisle width shall be no less than 24 feet. ‘/// ‘/// //// -5- . All private driveways shall be kept clear of parked vehicles at all times, and shall have posted "No Parking/Fire Lane Tow Away Zone" pursuant to Section 17.04.040, Carlsbad Municipal Code. All plans, specifications, and supporting documents for the improvements of this project shall be signed and sealed by the Engineer in responsible charge of the work. Each sheet shall be signed and sealed, except that bound documents may be signed and sealed on their first page. Additionally the first sheet of each set of plans shall have the following certificate: "DECLARATION OF RESPONSIBLE CHARGE" I hereby declare that I am the Engineer of Work for this project, that I have exercised responsible charge over the design of the project as defined in Section 6703 of the Business and Professions Code, and that the design is consistent with current standards.
