If Housing and Redevelopment Commission concurs, your action is to adopt Resolution No l-CJ$, approving RP 87-8 - CALVERT and to approve the negative declaration issued by Planning Director.
ITEM EXPLANATION
The applicant is requesting approval of a Major Redevelopment Permit to develop an 1800 square foot retail use with additional 780 square feet of storage space. The proposed project site is to be located at 2685 State Street in Subarea 3 of the Village Redevelopment Area, Local Facilities Management Plan Zone 1.
Design Review Board first heard this application at their meeting of November 25, 1987. At that time, the project request was for three residential units over retail. As originally proposed, the project did not meet parking requirements and the second story residential units were not compatible with the surrounding heavy commercial/light industrial uses. Design Review Board asked the applicant to redesign the project. The redesigned projected deleted the ~ residential units and added storage space.

WHEREAS, a verified application has been filed with the
City of Carlsbad and referred to the Design Review Board: and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, pursuant to the provisions of the Municipal
Code, the Design Review Board did, on the 17th day of February,
1988, hold a duly noticed public hearing to consider said
application on property described as:

The project has been redesigned to delete the proposed three second story residential units, thereby making it more compatible with surrounding uses, and to provide adequate onsite parking, as discussed in the staff report.
The site is physically suitable for the type and density of the development since the site is adequate in size and shape to accommodate retail development at the density proposed.
The Design Review Board has, by inclusion of an appropriate condition to this project, ensured building permits will not be issued for the project unless the City Engineer determines that sewer service is available, and building cannot occur within the project unless sewer service remains available, and the Design Review Board is satisfied that the requirements of the Public Facilities Element of the General Plan have been met insofar as they apply to sewer service for this project.
All necessary public improvements have been provided or will be required as conditions of approval.
The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General Plan.
The proposed project is compatible with the surrounding future land uses since surrounding properties are designated for commercial development on the General Plan.
This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Planning Director on January 27, 1988, and approved by the Design Review Board on February 17, 1988.
The applicant is by condition, required to pay any increase in public facility fee, or new construction tax, or development fees, and has agreed to abide by any additional requirements established by a Local Facilities Management Plan prepared pursuant to Chapter 21.90 of the Carlsbad Municipal Code. This will ensure continued availability of public facilities and will mitigate any cumulative impacts created by the project.
This project is consistent with the City's Growth Management Ordinance as it has been conditioned to comply with any requirement approved as part of the Local Facilities Management Plan for Zone 1.

Approval is granted for RP 87-8, as shown on Exhibits llAql-
"El1 dated January 13, 1988, incorporated by reference and on kile in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions.
The applicant shall prepare a 24" x 36" reproducible mylar of the final site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approved by the Redevelopment Director prior to the issuance of building permits.
This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy.
This project is also approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on July 28, 1987 and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad municipal Code or other ordinance adopted to implement a growth management system or facilities and improvement plan and to fulfil1 the subdivider's agreement to pay the public facilities fee dated August 13, 1987, and the agreement to pay the Growth Management Fee dated August 13, 1987, copies of which are on file with the City Clerk and are incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this project shall be void.
Water shall be provided to this project pursuant to the Water Service agreement between the City of Carlsbad and the Costa Real Water District, dated May 25, 1983.
This project shall comply with all conditions and mitigation required by the Zone 1 Local Facilities Management Plan approved by the City Council on September 1, 1987, incorporated herein and on file in the Planning Department and any future amendments to the Plan made prior to the issuance of building permits.

7. If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 65913.5. If any such condition

is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law.
8. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at time of building permit issuance.
9. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Redevelopment Director. Enclosure shall be of similar colors and/or materials to the project to the satisfaction of the Redevelopment Director.
10. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building.
11. An exterior lighting plan including parking areas shall be submitted for Redevelopment Director approval. All lighting shall be designed to reflect downward and avoid any impacts on adjacent homes or property.
12. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Redevelopment Director.
13. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first.
14. All parking lot trees shall be a minimum of 15 gallons in size.
15. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris.
16. Any signs proposed for this development shall at a minimum be designed in conformance with the City's Sign Ordinance and shall require review and approval of the Redevelopment Director prior to installation of such signs.
17. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color.

Prior to issuance of a grading or building permit, whichever occurs first, a soils report shall be prepared and submitted to the City of Carlsbad. If the soils report indicates the presence of potential fossil bearing material then a standard two phased program, on file in the Planning Department, shall be undertaken to avoid possible significant impacts on paleontological resources under the direction of the Planning Department.
This project is approved subject to the condition that the 780 square foot storage area be used exclusively for storage. No commercial office, residential, or other non storage uses are allowed within this area.
This project is approved subject to the condition that the two onsite parking spaces (3 and 4) located within the garage be available for public use. In accordance, these spaces shall be clearly labeled for public parking. The doors of the garage that these spaces are located within shall remain open during business hours of the retail use.
The second story window facing State Street where the storage area is located shall be replaced by an opaque architectural feature such as a dormer, shutter, or translucent glass.
Enaineerina Conditions:
22. This project may require a grading permit. The applicant shall conform to Chapter 11.06 of the Carlsbad Municipal Code (Excavation and Grading).
23. Additional drainage easements and drainage structures shall be provided or installed as may be required by the City Engineer.
24. Prior to issuance of a Certificate of Occupancy, the applicant shall repair or replace all broken or defective curb, gutter, or sidewalk adjacent to the project. A note to this effect shall be placed on the building plans for this project.
25. All telephone and electric utilities to serve this site shall be from an underground service point. The relocation of light pole shall include underground service.
Fire Conditions:
26. Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department.

Costa Real Municipal Water District Conditions:
27. Prior to the issuance of building permits, the entire water system for subject property shall be evaluated in detail to ensure adequate capacity for domestic landscaping and to ensure that fire flow demands are addressed.
28. The applicant's engineer shall be required to schedule a meeting with the Water District Engineer to review the preliminary water system layout prior to preparation of the water system improvement plans.

I. RECOMMENDATION
That the Design Review Board recommend APPROVAL of the Negative Declaration issued by the Planning Director and ADOPT Design Review Board Resolution No. 109 recommending APPROVAL of RP 87-
8, based on the findings and subject to the conditions contained therein.
DISCUSSION
This project, RP 87-8, was previously heard before the Design Review Board on November 25, 1987. At that time, staff was recommending denial of the project because the project: (1) did not include adequate onsite parking, and (2) the second story residential uses proposed with the project at that time were not regarded as being compatible with the surrounding heavy commercial/light industrial uses.
The Design Review Board agreed with staff's concerns and recommendations and sent the project back to staff for redesign.
As shown on Exhibits rlAlt - ~~E~~, the project has been redesigned to delete the three second story residential units, whereby the project now provides adequate onsite parking (six spaces for the 1800 square feet of retail use, and one space for the 780 square foot storage area). Staff does have concerns regarding the intended use of the 780 square foot storage area, and the usability of two public parking spaces (3 and 4) which are proposed to be located within a garage onsite. In accordance, staff has added conditions 19 and 20 which (1) restrict the 780 square feet of storage area for storage use only and (2) requires that garage doors be left open during business hours and that these two parking spaces be clearly labeled for public parking.

With these revisions, the project is now in conformance with the goals of Subarea 3 and the development standards of the Village Design Manual and the V-R Zone.
This project, as proposed, will be similar in design as the former proposed project. The architecture will be of a filcontemporary village style". Architectural materials and design features will include shiplap siding, wood single roofing, french doors, bay windows, and skylight dormers. The project will also include a redwood deck at the entry with patio seating and planters. These design features create a project which is both village like and pedestrian oriented.
Overall, because the project applicant has been willing to redesign the project to delete the three second story residential units, provide adequate onsite parking, and create a project which is pedestrian oriented and village like in character, staff recommends approval of RP 87-8. For additional details, please see the attached staff report to the Design Review Board dated November 25, 1987.

I. RECOMMENDATION
That the Design Review Board ADOPT Resolution No. 108
DENYING RP 87-8, based on the findings contained therein.
II. PROSECT DESCRIPTIOt4 AND BACKGROUND
The applicant is requesting a major redevelopment permit to
develop a mixed use commercial/residential project, located as
described above. The proposal would entail the development of
an 1800 square foot commercial/retail use along the ground floor
and three second story apartment units (each 667 sq. ft. in area). Seven on-site parking spaces will be provided,
including, 2 garage parking spaces, 2 carport spaces, and 3 open
parking spaces. The architecture of the proposed project would
be “contemporary village style” in nature. The architectural materials of the structure would include, stucco walls with accent shingle siding, and a wood shake roof. Architectural features including, French doors, bay windows, and window
overhangs, have also been incorporated into the architecture to
add interest and relief. The project will also include a redwood deck at the entry to the proposed retail use and a
second story redwood deck associated with the proposed
residential uses.
The subject property currently includes a single wall of a former
6-unit apartment project. Since this wall still remains, the project can qualify as a rehabilitation project. The property is surrounded by an auto body and paint shop to the north, a
plumbing company to the south, a cabinet and antique shop to the
east and the AT & SF right of way to the west. The project is
located within the Zone 1 Local Facilities Management Plan area.
III. ANALYSIS
Planning Issues
1) Does the proposed project conform with the goals
of Subarea 3 and the development standards of the
Village Design Manual and the V-R Zone?
2) Is the proposed project compatible with surrounding uses?
Discussion
The primary redevelopment goal of Subarea 3 is to maximize the
established pattern of development (heavy commercial) north of
Grand Avenue and create a visual link with the Village Center.
As proposed, the commercial portion of this project appears to conform with this primary goal. However, the residential part of this project may not be consistent with this goal. The Design Guidelines Manual does not appear to encourage residential
development within Subarea 3. The uses allowed within Subarea 3
include uses permitted within the C-l and C-2 zones. In
addition, C-M Zone (limited industrial) uses may be permitted
when found to be compatible with general commercial uses. Historically, Subarea 3 has been developed with heavy commercial
and limited industrial uses (i.e., manufacturing, auto repair).
The majority of the subarea today is developed with such uses.
While the C-l and C-2 zones allow second story residential uses
through a conditional use permit, Staff believes that since
Subarea 3 remains predominantly developed with heavy commercial
and limited industrial uses, residential development would not be
compatible at this time.
This project does not comply with all of the development/design standards of the Village Design Manual and the V-R Zone. As
discussed within the “Design Criteria” for Subarea 3, “adequate off street parking shall be provided.” The project proposes a
total of only 7 off street parking spaces. Per the City’s
Parking Ordinance, a total of 12 spaces would be required for
this project. Since the project as proposed, provides only 58%
of the required on-site parking, Staff cannot recommend support.
Otherwise, the project is in compliance with the applicable
development standards of the Village Design Manual and V-R Zone.
Staff is generally supportive of integrating residential uses in
with commercial uses within certain subareas of the Redevelopment Area (i.e., Subarea 1, the Village Center). However, because
Subarea 3 predominantly functions as a limited industrial area, which is not generally compatible with residential uses, Staff
cannot recommend support of this mixed use residential/commercial
project within this subarea and at this specific location.

In summary y because residential uses are not regarded as
compatible with surrounding heavy commercial/light industrial
uses which are the primary uses within Subarea 3 and because the
proposed project does not include adequate onsite parking, Staff
is recommending denial of RP 87-8.

NEGATIVE DECLARATION
PROJECT ADDRESS/LOCATION: This project is located at 2685 State Street in Subarea 3 of the Village Redevelopment Area.
PROJECT DESCRIPTION: This project, RP 87-8, will include an 1800 square foot retail use with an additional 780 square feet of storage area on a 6546 square foot lot.
The City of Carlsbad has conducted an environmental review of the above described project pursuant to the Guidelines for Implementation of the California Environmental Quality Act and the Environmental Protection Ordinance of the City of Carlsbad. As a result of said review, a Negative Declaration (declaration that the project will not have a significant impact on the environment) is hereby issued for the subject project. Justification for this action is on file' in the Planning Department.

Chairman Rombotis introduced Sharon Schramm, the new Design Review Board Member. He also introduced the new Planner for the Board, Nancy Rollman.
CONTINUED PUBLIC HEARING:
1. RP 87-8 - CALVERT - Request for a major redevelopment oermit to develoo an 1.800 sauare foot retail use with
an additional 780 square feet of storage space, located at 2685 State Street, in subarea 3 of the Village Redevelopment Zone.
Chris Salomone introduced the item, and Nancy Rollman gave
the staff presentation as contained in the Staff Report, using wall charts to show the elevation and site plan.
The issues were parking and incompatibility of residential
use.
The project was re-designed to delete the residential units and comply with parking requirements for retail and storage use. Ms. Rollman stated conditions were placed on
the project to ensure the workability of the parking and storaqe use. The project now meets the requirements of the Design Manual. A transparency was used to show the site.
Chairman Rombotis requested staff change the wording under Condition 14, referring to the Design Review Board instead
of the Planning Commission.
Chairman Rombotis opened the public hearing at 5:OY p.m.,
and issued the invitation to speak.
Gene Calvert, 3791 Mulberry, the applicant, was present to answer any questions.
Since no one else wished to speak on this item, the public
testimony portion was closed at 5:ll p.m.
Board Member McCoy commented he felt this was an “over- kill" situation for a retail use.

In answer to Board query regarding Condition 827, Dave
Hauser explained the Water Company wants to evaluate the
old lines there to determine whether or not they need upgrading.
Design Review Board approved the Negative Declaration
issued by the Planning Director and adopted the following Resolution:

Board Member Hall stated he is the owner of a piece of property across the street from this site.
Chairman Rombotis stated he conducts business with the Architect who prepared the plans for this project.
Chris Salomone introduced this ftem and Nancy Rollman
continued the staff report, usinq a transparency to show the site wall charts showing the house to be built.
Joe Valdez, 1610 Melrose Way, Vista, stated this is his parents’ property and he wants to build a house at Pine
and Roosevelt to allow his sister and parents to live there. He stated he understood the conditions placed on
the project.
Design Review Board adopted the following Resolution:

3. BOOTH PRELIMINARY REVIEW
Proposed office building at Madison and Arbuckle in Subarea 6 of the Village Redevelopment Zone.
Chris Salomone introduced this item, explaining this was an informal preliminary review process to allow Design Review Board input upfront.
Mr. Salomone explained this project would be located on
two lots and be two-stories high over at-grade parking.
The applicant has requested two parking spaces in the front yard setback on the Madison side of the project. The applicant was also seeking Board input with regard to the architecture.

Bill Booth, 2979 State Street, Suite D, the applicant,
stated he wanted preliminary comments from the Board
Members. Mr. Booth distributed a handout to the Board
Members showing the plan and commenting the floor plan terraces back and is not square. He also stated the
square footage would be 5,100, and not 5,600 as stated in the staff report.
Board Member McCoy stated he was not pleased with the architecture and felt it did not fit the neighborhood.
He stated he would like to see an alternative. Mr.
Booth displayed a wall chart with alternative architecture used. The consensus of the Board was this plan was much more acceptable and would fit into the neighborhood better.
Board Member McFadden stated she did not like to see a three-story buildino with no elevator and did not like
the handicapped entrance. Mrs. McFadden commented that
on Saturday the street was parked solid in that area.
Staff indicated the post office workers park on the street in that area, and that has a trememdous impact on
the parking. The suggestion was made that perhaps this was too intense a use for that property.
Chris Salomone stated this would be a good infill
project, and there is to be a major parking study to look at time limits in that area.
Board Member McFadden had concerns about second-story office space, and wondered whether people would want to
rent that space.
Consensus of the Board was to favor the alternative plan
and to allow the two parking spaces in the setback,
inasmuch as the applicant had to dedicate ten feet off
of Arbuckle and Madison. He would berm the parking area
up to hide the two parking stalls.
Board Member Hall stated he felt a lot of traffic would
come in off of Arbuckle and the back of the building should be given special attention, as that will be the first sight of the building.
4. RECENT RESIDENTIAL DEVELOPMENT REPORT
Informational intern regarding recent residential
development in and around Redevelopment Area.
No Action Needed
The Board accepted the report.
5. ELECTION OF CHAIRPERSON
Board Member Hall was unanimously elected Chairman.
Board Member McCoy was unanimously elected Vice- Chairman.

The Board discussed the possibility of changing the time and day of the meting, with the final consensus
of the Board being to leave the meeting time at 5:00

WHEREAS, the Design Review Board did on the 17th day of
February, 1988, hold a duly noticed public hearing as

ITEM EXPLANATION
The applicant is requesting approval of a Major Redevelopment Permit to develop an 1800 square foot retail use with additional 780 square feet of storage space. The proposed project site is to be located at 2685 State Street in Subarea 3 of the Village Redevelopment Area, Local Facilities Management Plan Zone 1.
Design Review Board first heard this application at their meeting of November 25, 1987. At that time, the project request was for three residential units over retail. As originally proposed, the project did not meet parking requirements and the second story residential units were not compatible with the surrounding heavy commercial/light industrial uses. Design Review Board asked the applicant to redesign the project. The redesigned projected deleted the residential units and added storage space.
I ISSUES:
Parkinq: As redesigned, the project meets parking code * requirements.
Storage: Project was conditioned that area will be used exclusively for storage.
Garage Doors: Two required parking spaces are in the garage; project was conditioned that garage doors will be left open during business hours, clearly marked Itpublic parking".
Design Review Board at their continued public hearing of February 17, 1988, unanimously recommended approval of RP 87-7 Calvert based on the findings and subject to the conditions contained in Resolution No. 109 attached hereto.
