AB# APPROVAL OF PLANS AND SPECIFICATIONS MTG. AND AUTHORIZATION TO BID CONSTRUCTION CITY

I RECOMMENDED ACTION:
Adopt Resolution No. /aa approving plans and specifications, authorizing the City Clerk to advertise for bids for the construction of the Downtown Streetscape, Phase II improvements on Carlsbad Boulevard and a portion of Elm Avenue, Project No. 3288, and appropriating project funds.
I ITEM EXPLANATION:
On February 2, 1988, the Housing and Redevelopment Commission approved a general negative environmental declaration and approved the design of the Downtown Streetscape project. In 1988, the Commission further authorized the sale of redevelopment tax allocation bonds to finance the entire Streetscape program.
The Downtown Streetscape program has been prepared in five (5) separate phases. The following is a description and estimated timing of each phase:

Phase I of the Streetscape involves the Village Faire frontage improvements on Carlsbad Boulevard and Elm Avenue which will be constructed by the property owners in accordance with the approved Streetscape design. The plans, specifications and contract documents for this phase have been completed and are currently being bid by the Village Faire development group. Construction is anticipated to begin in April of 1989 and will be coordinated with the Village Faire construction which is currently underway.

Phase II of Streetscape includes major overlay reconstruction of the roadway on Carlsbad Boulevard from State Street southerly to Ocean Street and on Elm Avenue from Ocean Street to Washington. Construction will include new curbs, gutters, sidewalks, raised landscaped medians, ornamental and safety street lighting, substantial parkway landscaping, and an art entry exhibit at the corner of Carlsbad Boulevard and State Street which will serve as an entry statement for the north end of downtown Carlsbad.
Construction is anticipated to require approximately ten (10) months to complete following issuance of the project Notice to Proceed. Carlsbad Boulevard and Elm Avenue within the construction zone will be in a state of major transition during the entire construction period, however, will be open to traffic at all times.
Staff recommends approval of the project plans, specifications and contract documents and requests the Housing and Redevelopment Commission authorize the advertisement of construction bids.
ENVIRONMENTAL REVIEW
The Planning Director issued a negative declaration for the entire Streetscape project on January 20, 1988 finding the Streetscape project was consistent with the implementation of the California Environmental Quality Act (CEQA) and the environmental protection ordinances of the City of Carlsbad. This negative declaration was subsequently certified by the Carlsbad City Council sitting as the Housing and Redevelopment Commission, on February 2, 1988.
COASTAL DEVELOPMENT PERMIT
The California Coastal Commission has issued permit authority to the City of Carlsbad for all projects within the Carlsbad Redevelopment area. The Coastal Development Permit for the Streetscape project is currently under review. The Coastal Development Permit will be presented to the Housing and Redevelopment Commission for action prior to or in conjunction with the award of the construction of the Downtown Streetscape, Phase II project.
PROPOSITION H REQUIREMENTS
The multiphased Downtown Streetscape project is to be funded from proceeds of a completed tax allocation bond sale which represents a source of funds exempt from the City's Proposition H limitations regarding Capital facility construction in excess of $1,000,000.
GENERAL PLAN CONSISTENCY
The Planning Commission formally adopted Resolution No. 2696 on October 21, 1987 determining the Carlsbad Capital Improvement

Program for the 1987-88 budget year, which included the Carlsbad Streetscape project, was in conformance with the City's General Plan.
FISCAL IMPACT:
The Housing and Redevelopment Commission has previously authorized the sale of tax allocation bonds to fund the multiphased Downtown Streetscape project. This bond sale was accomplished in 1988 with proceeds on deposit with the City's Finance Department. Staff recommends the appropriation of $6,000,000 of bond sale proceeds to the Streetscape project account 811-820-1880-3288.
The estimated construction cost of Phase II of the Streetscape project is $1,800,000. The balance of the appropriated funds will remain in the Streetscape project account for the costs of the other Streetscape phases.

RESOLUTION NO. 122
A RESOLUTION OF THE CARLSBAD HOUSING AND REDEVELOPMENT COMMISSION, APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING THE CITY CLERK TO ADVERTISE FOR BIDS FOR THE CONSTRUCTION OF STREETSCAPE, PHASE II, PROJECT NO. 3288, AND APPROPRIATING PROJECT FUNDS
WHEREAS, the Housing and Redevelopment Commission of the
City of Carlsbad, California, has determined it necessary and in
the public interest to construct Phase II of Downtown
Streetscape project; and
WHEREAS, plans and specifications for the furnishing of all
labor, materials, tools, equipment, transportation and other
expenses necessary or incidental for said project, have been
prepared and are on file in the Municipal Projects Department of
the City of Carlsbad; and
WHEREAS, the Commission has previously authorized and
completed the tax allocation bond sale necessary to fund said
project.
NOW, THEREFORE, BE IT RESOLVED by the Housing and
Redevelopment Commission of the City of Carlsbad, California,
as follows:
1. That the above recitations are true and correct.
2. That the plans and specifications as presented are
hereby approved.

3. That the City Clerk of the City of Carlsbad is hereby
authorized and directed to publish, in accordance with law,
Notice to Contractors inviting bids for the construction of
Phase II of the Downtown Streetscape project.
4. That the Commission does hereby appropriate $6,000,000
of tax allocation bond sale proceeds for the Streetscape project
construction to account number 811-820-1880-3288.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Carlsbad Housing and Redevelopment Commission held on the 17th
day of January I 1989, by the following vote, to wit:
