SELECTION OF CONSULTAWT AS LIAISON FOR STREETSCAPE PROJECT ITEM EXPLANATION: The $6,000,000 downtown streetscape/parkins lot project will cause sisnificant disruption to access, commerce and tourism in the Villase area. Constant communication with the affected parties will be necessary. The quantity and consistency of interaction between contractor/City and merchant/owners is beyond the ability of regular City staff to provide. Right of Entry Agreements and Right of Way Acquisition documents must be acquired. Time consuming updates and status reports must be provided daily in positive, clear terms. An ombudsman assisned to this job on a part time basis (up to 20 hours a week) could perform these duties. The Community Development Director and City Engineer concur with this action after discussions with Municipal Projects. We feel that Bill Baldwin would be an appropriate candidate for this position. Bill Baldwin is a former Assistant City Manager of the City of Carlsbad. Bill has a thorough knowledge of contracting procedures, inspection policies, City personnel and public relations. His extensive experience in local issue resolqtion should make him an ideal mediator. He recently was instrumental in the successful negotiation of a 60 space parking lot on State Street. Commission's adoption of Resolution No. 173 will authorize the Chairperson to execute the agreement to hire Bill Baldwin as a part time consultant for six (6) months at a fee of $30.00 per hour. FISCAL IMPACT: The consultant will work a maximum of 20 hours per week.at $30.00 per hour for six (6) months for a total cost of $15,000. Funds are available in the Redevelopment operating budget. Resolution No. 123 with letter of agreement. , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 123 A RESOLUTION OF THE HOUSING AND REDEVELOPMENT COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONSULTANT AGREEMENT FOR THE CARLSBAD BOWLEVARD/ELM AVENUE STREETSCAPE PROJECT WHEREAS, the Housing and Redevelopment Commission of the City of Carlsbad, California has determined it is necessary and in the public interest to construct the Carlsbad Boulevard/Elm Avenue Streetscape project; and WHEREAS, the Commission has determined it necessary to hire a consultant to act as liaison/ombudsman to provide constant communication between the City, the contractor, merchants/property owners and the general public: NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Commission of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the consultant Letter of Agreement attached hereto and made a part hereof is hereby approved. 3. Your duties will include providing assistance with public information and being a liaison between the contractor, staff and the public for the Elm Avenue/Carlsbad Boulevard Streetscape Project . You will begin work on Wednesday, January 18, 1989. Your hours will be determined by the Housing and Redevelopment Director but will not exceed twenty (20) hours per week unless by mutual agreement of the Director and you, the hours are extended. Your fee for this service shall not exceed $30.00 per hour for a maximum three month fee of $7,500. As a consultant, you are an independent contractor of the City. The payment made to you pursuant to this contract shall be the full and complete compensation to which you are entitled. The City shall not make any Federal or State tax withholdings on your behalf. The City, its agents, offices and employees shall not be liable for any claims, liabilities, penalties, fines or any damage to goods, properties or effects of any person whatever, nor for personal injuries or death caused by, or resulting from, any act or omission of Consultant. Consultant agrees to defend, indemnify and save free and harmless the City and its authorized agents, officers, and employees against any of the foregoing liabilities or claims of any kind and any cost and expense that is incurred by the City on account of any of the foregoing liabilities, including liabilities or claims by reason of alleged defects in any plans and specifications, unless the liability or claim is due, or arises out of, solely to the City's negligence.
