3ECOMMENDED ACTION:
If Housing and Redevelopment Commission concurs, your action is
to adopt Resolution No. 138 approving the submittal of an
application for additional Section 8 Existing Housing units and
authorizing the Housing and .Redevelopment Director to execute
documents.
ITEM EXPLANfiTION:
3n March 24, 1989, the Department of Housing’ and Urban
Development invited the Carlsbad Housing Authority to apply for
additional Section 8 Housing units.
-unds in the amount of $147,600 are expected to be made availab
to the Housing Authority to provide assistance to low income
families. Funds will be distributed to subsidize units as
follows:

Currently the Housing Authority subsidizes 332 units to
income families. If the application is accepted by the

subsidized units will be 354.

Dear Mr. Salomone:
SUBJECT: Invitation for Section 8 Existing Housing Application
your public housing agency is invited to submit an application for
Section 8 Existing housing. We expect contract Authority in the amount of
$ 147,600 to be made available for your agency to provide assistance for
approximately 20 units based on the Fair Market Rent for a 2-bedroom unit - in your jurisdiction. The actual number of units is dependent on the unit
distribution you propose, which should be consistent with the applicable
Housing Assistance Plan(s) in your jurisdiction. The contract authority
consumed by your proposed unit distribution should not exceed the amount
indicated above. Unlike previous fiscal years, the amount of contract
authority for which you apply should be calculated by multiplying each unit
by 12 times 95% (instead of 100%) of the appropriate Fair Market Rent. This
procedural change is for fund reservation purposes only and does not change
outstanding policy with regard to approval of contract rents.
Pursuant to the 1988 McKinney amendments, a public housing agency
may, at its sole discretion, revise its tenant selection policy to provide
top priority for issuing Section 8 Certificates to families in Rental
Rehabilitation Projects (RRP) with incomes between 50% and 80% of median
income who are not being.physically displaced, but whose rent would be more
than 30% of adjusted family income as a result of rehabilitation. This class
of family is not eligible for Housing Vouchers. The Administrative Plan
should reflect this modification to the tenant selection policy should the
public housing agency choose to exercise this option.
HUD is required by Section 213(a) of the Housing and Community
Development Act of 1974 to provide the unit of general local government
an opportunity to object to our approval of an application for housing
assistance on the grounds that the application is inconsistent with the
local Housing Assistance Plan. To avoid any delay in HUD approval of the
PHA application, you should encourage the Chief Executive Officer to submit
a Section 213 letter with the PHA application. The Section 213 letter should not only indicate that approval of the application for the Section 8 Existing Housing Program is consistent with the community's Housing Assistance Plan, but that the letter should be considered as the final comments and that no
additional comments will be submitted by the unit of local government. If your specific locality is covered by a County HAP, you must provide comments from the Chief Executive Officer of the County and the Chief Executive

Your application package must contain the following:
1. Form HUD 52515, Application for Existing Housing
2. Form HUD 916, Equal Opportunity Certification
3. Letter from Chief Executive Officer forwarding comments in
accordance with Section 213 review procedures.
4. PHA Resolution Authorizing submission of the application.
Applications must be properly completed and signed by an Authorized
Official of the Public Housing Agency.
The completed Application Form HUD 52515 and other required documents
should be submitted to the Housing Development Division of this Office by
May 1, 1989. An original plus five copies of the application package are
required. Applications received after the May 1, 1989 deadline ~111 be
returned.

Instructions: The applicant agency must provide assurances and certify to 011 O/ the following items.
The applicant agency hereby assures and certifies that:
(0 It will comply with Title VI of the Civil Rights Act of 1964 (p.L. 88-352) and regulations pursuant thereto
(Tille 24 CFR Part I) which states that no person in the United States shall, on the ground of race, color, or
national origin, be excluded from participation in, be denied the benefits of, or be otherwise subjected to
discrimination under any program or activity for which the applicant receives financial assistance; and will
immediately take any measures necessary to effectuate this agreement. With reference to the real property
and structure(s) thereon which are provided or improved with the aid of Federal financial assistance extended
to the applicant, this assurance shall obligate the applicant, or in the case of any transfer of property, the
transferee, for the period during which the real property and structure(s) are used for a purpose for which the
Federal financial assistance is extended or for another purpose involving the provision of similar services
or benefits.
(ii) It will comply with Title VIII of the Civil Rights Act of 1%8 (P. L. 90-284) as amended, which prohibits
discrimination in housing on the basis of race, color, religion, sex or national origin, and administer its
programs and activities relating to housing in a manner to affirmatively further fair housing.
(iii) It will comply with Executive Order 11063 on Equal Opportunity in Housing which prohibits discrimination
because of race, color, creed, or national origin in housing and related facilities provided with Federal
financial assistance.
(iv) In establishing the criteria for the selection of tenants, the PHA or Owner will not utilize preferences or pfi-
orities which are based on (1) the identity or location of the housing which is occupied O? prOpOscd to be
occupied or (2) upon the length of time the applicant has resided in the jurisdiction. The PHA or Owner shall treat non-resident applicants who are working, or have been notified that they are hired to work,
in the jurisdiction as residents of the jurisdiction.
(v) If the proposed project is to be located within the area of a local Housing Assistance Plan (HAP), the
applicant will take affirmative action to provide opportunities to participate in the program to persons
expected to reside in the community as a result of current or planned employment.

Development has invited the City of Carlsbad, Housing Authority,

NOW, THEREFORE BE IT HEREBY RESOLVED, by the Housing and
Redevelopment Commission of the City of Carlsbad, California, as
2 follows:
3 1 . The Housing and Redevelopment Commission hereby approves the
4 submittal of an application to the U.S. Department of
Housing and Urban Development for twenty-two (22) additional
5 units of Section 8 Existing Housing.
6 2- The Housing and Redevelopment Commission hereby authorizes
the Housing and Redevelopment Director to execute documents
7 required for the submittal of said application for
additional Section 8 Existing Housing units.
