HomeMy WebLinkAbout1989-12-12; Housing & Redevelopment Commission; 141; Streetscape Phase IIHOUSING AND -’ ADEVELOPMENT COMMISS; -.1 - AGENDA BILL APPROVAL OF CHANGE ORDER NOS. 5, 6, 7 AND 8 FOR STREETSCAPE, PHASE II, PROJECT NO. 3288 RECOMMENDED ACTION: Adopt Resolution No. -154 approving construction Change Order Nos. 5, 6, 7 and 8 for Phase II of the downtown Streetscape Improvements, Project No. 3288, and appropriating project funding for Change Order No. 6. ITEM EXPLANATION: Phase II of the Carlsbad Boulevard and Elm Avenue Streetscape Improvement Program is proceeding on schedule. To date, four (4) minor change orders totaling $33,230 have been executed in accordance with Administrative Order No. ,7 and City Ordinance NS-55, effective April 21, 1989. These previous change orders were executed to resolve problems with unexpected subsurface conditions or to match private frontages to the Streetscape construction. Attached Change Order No. 5 adds the purchase of the following street trees to the contractor's scope of work: Ninety-four (94) Fern Pines in 24" boxes Four (4) Fern Pines in 36" boxes Thirty-two (32) Mexican Fan Palms, 15' high Sixteen (16) Mexican Fan Palms, 10' high Six (6) Queen Palms, 14' high Prior to the start of construction, the Purchasing Department solicited bids from nurseries to supply trees for planting by the City's contractor. The purpose of having the City provide the trees was to ensure availability at the time of planting, select a better quality of boxed specimen trees, and potentially save the standard contractor mark-up. No nursery submitted a bid on the Mexican Fan Palms. Bids were received for the remaining trees and-- on June 27, 1989, the City Council approved issuance of purchase orders to two (2) nurseries. One nursery later notified the City that it subsequently sold its remaining stock of Queen Palms and it would be unable to supply the City. The City inspected the Fern Pines reserved by the other nursery and discovered that the trees were all of an unsuitable variety. Therefore, the purchase order for the Queen Palms should be rescinded and the other purchase order should be reduced by the cost of the Fern Pines. ,Staff recommends approval of- Change Order No. 5 which will enable the contractor to supply the required trees from a newly identified supplier. There is some urgency in terms of time to have the contractor provide the trees at this time since the project is quickly proceeding to the stage in which the parkway and median trees are to be planted. Change Order No. 6 adds the purchase and,installation of sixteen (16) Streetscape Victorian-style streetlights to Magee Park. The existing park lights are in a state of disrepair. The proposed addition of the new lights will provide improved illumination and i Page 2 of Agenda Bill No. 141 unify the landscape architecture to Magee Park and its Carlsbad Boulevard Streetscape frontage. Changing out the lights at Magee Park is not within the scope of the Streetscape Project, however, the opportunity exists to have this contractor install the lights to take advantage of economies of purchasing and installing a larger quantity of the specified lights. Because of the concerns for public safety by providing essential safety and security lighting in Magee Park, there is substantial public interest and benefit to be obtained by proceeding to install these lights at this time. The extended additional time and loss of construction economies involved in competitively bidding the installation of the lights is outweighed by the public benefit and safety to be gained through a timely installation. Staff recommends proceeding with Change Order No. 6 at this time. Change Order No. 7 directs the contractor to add white lane striping to both sides of Elm Avenue, between Washington Street and Harding Street. On-street parking on Elm Avenue must be removed in order to provide sufficient room for the additional travel lanes. Frequent posting of standard "No Parking" signs is included in the change order price. On October 17, 1989, the Carlsbad City Council approved Ordinance No. NS-91 to designate "No Parking" on both sides of Elm Avenue from Carlsbad Boulevard to Pio Pica Drive. The effective date of the ordinance is January 3, 1990. If the Commission approves Change Order No. 7, staff will direct the contractor not to restripe Elm Avenue or post 'INo Parking" signs until the first of the year. The Phase II Streetscape contractor is already obligated to restripe Elm Avenue and post "No Parking" signs from Carlsbad Boulevard to Washington Street. Staff anticipates that both portions of Elm Avenue will be restriped and posted with new signs at the same time in January 1990. This time period will coordinate with the opening of the three (3) downtown parking lots currently nearing completion. Change Order No. 8 adds approximately 211 feet of anodized aluminum handrail to the top of a newly constructed concrete block retaining wall on the east side of Carlsbad Boulevard, between State Street and the railroad overcrossing. The handrail is necessary to protect pedestrians from an 8 to 12 foot vertical drop from the sidewalk over the retaining wall. Similar handrailing was constructed on Carlsbad Boulevard at the bluff-top walkway above the seawall. Staff recommends approval of Change Orders 5, 6, 7 and 8. Page 3 of Agenda Bill No. 141 FISCAL IMPACT: The cost of Change Order Nos. 5, 6, 7 and 8 is summarized as follows: Change Order No. 5 - Tree Purchase $ 45,800 Change Order No. 6 - Magee Park Lights 56,275 Change Order No. 7 - Elm Avenue Striping 9,152 Change Order No. 8 - Pedestrian Handrail 19,176 TOTAL $130,403 Funds in the amount of $4,445,966 are currently appropriated to account number 811-820-1880-3288 for the Streetscape program. The current unencumbered, available fund balance totals $2,387,696.65 in this account. Change Order Nos. 5, 7, and 8 are attributable to the Phase II project's construction contingency totaling $253,797.00. Change Order No. 6 for the Magee Park lights is not an item contemplated by the Phase II construction contingency and therefore should not be attributed to its fund balance. Staff recommends a transfer from the Unappropriated Balance of the General Fund to the General Capital Construction Fund and appropriate the cost of Change Order No. 6 in the amount of $56,275 to the Phase II Streetscape Project Account No. 300-820-1821-3288. That the Commission approves Change Order Nos. 5, 6, 7 and 8 and authorizes the Chairman to sign the attached change orders in the aggregate amount of $130,403 to the prime contractor, William J. Kirchnavy, Incorporated. Following the Chairman's signature, the City Clerk is directed to return the said change orders to the Municipal Projects Department for processing. ’ . 3. That in accordance with the provisions of Carlsbad Ordinance No. NS-55, and Section 3.28.080 and Section 3.28.172 of the Carlsbad Municipal Code, the City Manager's and the Secretary of the Carlsbad Housing and Redevelopment Commission's authority for approving change orders for this project up to a limit of $15,000 per change order shall be extended an additional cumulative amount not to exceed an additional $100,000 in accordance with code sections. 4. That Purchase Order No. 8346 to Yasuda Tree Nursery is hereby rescinded and that Purchase Order No. 8347 to Sea Tree Nurseries, Incorporated is reduced from $21,624.70 to $9,150.00. 5. That the Purchasing Officer is hereby authorized and directed to increase the project Purchase Order. No. 8192 to the William J.
