MTG. 2/06/90 NOTICE OF COMPLETI RECOMMENDED ACTION: Adopt Resolution No. /rf approving a change order, accepting Streetscape Phase I improvements and directing the City Clerk to record the Notice of Completion for Project No. 3288. ITEM EXPLANATION: The Phase I Streetscape improvements are complete. These improvements included new curb and gutter, street lights, decorative brick sidewalks and street trees on Elm Avenue and Carlsbad Boulevard adjacent to the recently opened Village Faire development. A fifteen foot (15') diameter tile mosaic of a bird of paradise flower was constructed under the supervision of the artist, James T. Hubbell. Street improvements in Washington Street and Grand Avenue adjacent to Village Faire were paid for and constructed by the developer as required by major redevelopment permit RP 87-11, approved on November 10, 1987. A further condition of development was construction of a storm drain system in Washington Street between Elm and Grand Avenues for runoff from Village Faire and Rotary Park. This work was also constructed by the developer apart. from Phase I of Streetscape. However, connecting the storm drain to the existing central business storm drain required the City to construct a short segment under the railroad tracks in Grand Avenue as a part of the Phase I contract. .. -- Seven (7) construction change orders totaling $44,860 were executed in accordance with Administrative Policy #7. The City initiated the change orders to either add additional enhancements to the sidewalk improvements or transfer work from the Phase II Streetscape construction to the Phase I construction to avoid any sidewalks and shoulder paving work after the Village Faire grand opening. The change orders included the following: I 1. Street light sidewalk fuse boxes, photocells, and outlets for Christmas lights. Installation of a water service connection to the future Phase II median landscaping in Elm Avenue. - iz 3. % 4 Installation of a drain system in sidewalk planter boxes. . Complete an electrical service connection on the west, or Phase II, side of Carlsbad Boulevard. 5. Complete the asphalt overlay on the Village Faire side of Carlsbad Boulevard and Elm Avenue. Page 2 of Agenda Bill No. /#S 6. Replace broken sidewalk on Grand Avenue near Carlsbad Boulevard. 7. Install a footing for a future village kiosk and cover utility box lids with brick pavers. Change Order No. 8 in the amount of $7,505.64 represents the City's share of engineering design and construction costs paid by the prime contractor. Because execution of Change Order No. 8 would produce an aggregate total of $52,365 for all change orders, the Commission's approval is required in accordance with Administrative Order No. 7. 8. Construction of three (3) 15-inch diameter storm drain pipes in Grand Avenue instead of one 24" diameter in order to provide sufficient clearance underneath the railroad tracks. The Phase I Streetscape prime contractor has completed 84 different items of work. The actual amount of one item, sidewalk brick pavers, exceeded the design engineer's estimate by 22%. This resulted in a net total of $22,379 in quantity overages on the construction contract. Staff recommends acceptance of the Streetscape Phase I improvements and requests authorization to record the Notice of Completion. FISCAL IMPACT: The funding of the Streetscape Phase I construction project is part of the Tax Allocation Bond program which also includes the Senior Center and Downtown Parking Lots. The Director of Finance produced a May 5, 1989 report on the condition of the bond program and the ability of the Agency to fund Streetscape construction and other projects. The report projected a shortfall of $560,000 in bond proceeds that will be needed to fully fund future phases of the Streetscape construction. The cost of Streetscape Phase I ran $23,344 over the project budget primarily because the design cost was $17,600 more than originally estimated. Therefore, the projected amount of funds available for future Streetscape construction are reduced by $23,344. However, there is a sufficient balance of funds in the Phase II Streetscape project to absorb the additional Phase I expenditure. NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Commission of the City of Carlsbad, California, as f0ii0ws: 1. That the above recitations are true and correct. 2. That the Commission approves Change Order No. 8 and authorizes the Chairman to sign the attached change order in the amount of $7,505.64 to the prime contractor, Harshbarger Construction, Incorporated. RCP with three 15" dia. PVC pipes and a manifold/clean-out structure - $5,140. Revise the engineering design of the storm drain to move it from the railroad right-of-way to the public right-of-way in Washington Street - $2,365.64. REASON FOR CHANGE: Smaller diameter pipes are required to achieve satisfactory clearance underneath the Washington St. railroad tracks. The storm drain was also moved westward in Washington St. to avoid railroad property. The storm drain serves both public drainage and the Village Faire development. The City's cost is based upon its 44.5% share of the drainage basin. The COST:'developer paid-for 55.5% of costsjor the proportion serving Village Faire.
