RECOMMENDED ACTION:
If the Housing and Redevelopment Commission concurs, your action
is to adopt Resolution No. 167 approving superseding Part I
of Section 8 Housing Certificate Pkogram Annual Contributions
Contract No. SF-535(E) and authorizing the Housing and
Redevelopment Commission Chairperson to execute the contract.
ITEM EXPLANATION:
Periodically, the Department of Housing and Urban Development
(HUD) requires administrative changes in the way they list
appropriations for the various Section 8 Housing Program
contracts. In this regard, HUD has contacted the City of
Carlsbad requesting the approval of an amendment to the current
Annual Contributions Contract (“ACC”) No. SF-535(E).
In October 1989, the Housing and Redevelopment Commission
approved an amendment which provided for the listing of funded
projects into two categories. The first category, titled
“Exhibit I,” contains projects that were appropriated before
October 1988. The second category, titled “Exhibit II,” contains
projects appropriated durinq Federal Fiscal Year 1988 and later.
The requested amendment will accomplish the following:
1 . Transfer the first project awarded to the City (No. CA16-
E077-001) from Exhibit I to Exhibit I-I. When this project
expires on October 28, 1991, HUD will replace it with a new
five-year project and contract.
2. Extend the project expiration dates for all remaining
projects listed in Exhibit I to February 28, 1994.
FISCAL IMPACT:
This is an administrative change only, no increase or decrease in
funding will result, nor will there be any impact to
participants.

A RESOLUTION OF THE HOUSING AND REDEVEIXPMENT COMMISSION APPROVING SUPERSEDING PART I OF SECTION 8 HOUSING CERTIFICATE PROGRAM ANNUAL CONTRIBUTIONS CONTRACT NO.SF-535tEl AND AUTHORIZING EXECUTION
WHEREAS, the Housing and Redevelopment Commission of
the City of Carlsbad (*#PHA") desires to enter into a
superseding Section 8 Annual Contributions Contract (lAACCgt
with the United States of America ("Government") for the
Section 8 Existing Housing Certificate Program.

WHEREAS, the Section 8 ACC must now be revised so that
it will consist of the following parts:
a. Superseding Part I of the ACC, HUD 52520B (8/88), applicable to the Section 8 Existing Housing Certificate Program.
b. Exhibit I, Projects Appropriated Before Federal Fiscal Year 1988;
c. Exhibit II, Projects Appropriated in Federal Fiscal Year 1988 and Later Years.
NOW, THEREFORE BE IT RESOLVED by the PHA, as follows:
1. The SUPERSEDING Part I of the ACC, together with Exhibits I and II, for the Housing Certificate program are hereby approved and accepted. The Chair or Acting Chair is hereby authorized and directed to execute the counterparts of the ACC on behalf of the PHA, and the Secretary is hereby authorized to impress the official seal of the PBA on each such counterpart and to forward such executed counterparts to the Government together with such other documents evidencing the approval and authorizing the execution thereof, as may be required by the Government.
2. This Resolution shall take effect immediately.
