RED:MP OF STREETSCAPE, PHASE IV AGENDA BILL RECOMMENDED ACTION: Adopt Resolution No. 'la2 approving plans and specifications, approving a funds transfer, and authorizing the City Clerk to advertise for bids for the construction of the downtown Streetscape, Phase IV project and related improvements, Project Nos. 3346 and 3332. ITEM EXPLANATION: On April 10, 1990, the Carlsbad City Council adopted Resolution No. 90-99 approving an Operating and Maintenance Agreement with the State of California, Department of Parks and Recreation for the City's long term lease of State-owned property at Ocean Street and Carlsbad Boulevard upon which the Phase IV Streetscape Project will be constructed. The Phase IV Streetscape improvements include the following elements: l . . . . . The Construction of the Streetscape Sculpture Park designed by Andrea Blum at the corner of Carlsbad Boulevard and Ocean Street. Closure of Ocean Street atcarlsbad Boulevard and construction of street improvements including a double loaded parking lot consisting of fifty-three (53) formal parking spaces on Ocean Street. Signalization of the intersection of Pine and Carlsbad Boulevard. Substantial street and storm drain improvements on Carlsbad Boulevard, Lincoln Street, and Oak Avenue as a condition of a previously Council approved agreement with adjacent private property owners. The property owners have previously made the appropriate cash deposits with the City for their share of the cost of the improvements. Removal of several existing overhead utility poles throughout the project. Transitioning the Sculpture Park improvements into the completed Carlsbad Boulevard bluff-top walkway on the south. Sculpture Park contains four (4) small reflecting pools integral to the approved design concept. The pools have no apparatus to spray or shoot water, rather, their function is to provide a quiet visual accent to the tall steel pipe trellises which will enclose the sculpture and landscaping areas. The pools share a common circulation system that pumps water through a filter element and back into the pools. Page 2 of Agenda Bill No. /rb The four (4) reflecting pools are the following dimensions: . One (1) pool is 15 feet in length, 14 feet in width, and 15 inches in depth. . Two (2) pools are 30 feet in length, 2 feet in width, and 15 inches in depth. . One (1) pool is 20 feet in length, 2 feet in width, and 15 inches in depth. All four (4) pools contain a total volume of water of 3,500 gallons which is equivalent to approximately twenty percent (20%) of the volume of water in one (1) average residential swimming pool. Although the reflective pools will lose some water from evaporation, the evaporation rate is estimated to be approximately one-hundred (100) gallons per day, considerably less than the evaporation rate for the average residential swimming pool. The pumping equipment contains a filtration mechanism to reduce maintenance. The landscape planting consists primarily of flowering ice plant with a drip irrigation system. All of the elements which comprise the sculpture park have been previously reviewed by the project design committee and the Commission. Staff requests approval of the Streetscape Phase IV plans and specifications and requests authorization to advertise for construction. The project will begin construction early in 1991 and require five (5) months to complete. ENVIRONMENTAL REVIEW The Planning Director has issued a Negative Environmental Declaration for the entire Streetscape project on January 20, 1988 finding the project was consistent with the implementation of the California Environmental Quality Act (CEQA) and the environmental protection ordinances of the City of Carlsbad. This Negative Environmental Declaration was subsequently certified by the Carlsbad City Council sitting as the Housing and Redevelopment Commission, on February 2, 1988. COASTAL DEVELOPMENT PERMIT The California Coastal Commission has issued permit authority to the City of Carlsbad for all projects within the Carlsbad Redevelopment area. Coastal Development Permit Nos. 88-7, 8, and 9 for the Streetscape Program were approved by Resolution Nos. 126, 127, and 128 on February 21, 1989. Page 3 of Agenda Bill No. /.7z -- PROPOSITION H REOUIREMENTS The multiphased Downtown Streetscape project is to be funded from proceeds of a completed tax allocation bond sale which represents a source of funds exempt from the City's Proposition H limitations regarding capital facility construction in excess of $l,OOO,OOO. GENERAL PLAN CONSISTENCY The Planning Commission formally adopted Resolution No. 2696 on October 21, 1987 determining the Carlsbad Capital Improvement Program, which included the Carlsbad Streetscape project, was in conformance with the City's General Plan. Both Phase IV (Sculpture Park) and Phase V (Carlsbad Village Drive) are funded from the proceeds of the Tax Allocation Bond Program. Because the Sculpture Park includes related street improvements to Carlsbad Village Drive and Ocean Street, completion of the entire Phase IV project will require a slightly greater proportion of the $10,390,000 bond proceeds. If the Commission approves the funds transfer, then the Tax Allocation Bond proceeds will be allocated to projects as follows: Senior Center $ 3,500,000 Streetscape, Phase I (Village Faire Frontage) 750,000 Streetscape, Phase II (Carlsbad Blvd.) 2,300,OOO Streetscape, Phase III (Parking Program) 950,000 Streetscape, Phase IV (Sculpture Park) 876,800 Streetscape, Phase V (Carlsbad Village Drive) 2.013,200 TOTAL $10,390,000 The anticipated project costs for Phase V of Streetscape are budgeted at $2,700,000. Therefore, the Tax Allocation Bond proceeds are insufficient by an estimated $686,800 to fund Phase V. Staff wishes to emphasize these estimates are preliminary in nature and subject to receipt of competitive construction bids for both Phases IV and V. If the Commission approves proceeding with the Phase IV construction, then the projected Phase V shortfall will have to be eliminated by reducing the scope of the future construction on Carlsbad Village Drive or by extending a loan of City funds to the Redevelopment Agency. The Redevelopment Agency's access to the bond proceeds is restricted according to the bond covenant. The Agency's ability to withdraw funds from escrow for project construction and other uses depends upon the rise in assessed valuation of property within the Redevelopment District. The Finance Director has indicated that sufficient funds will be available for release from the escrow account in calendar 1991 to pay Phase IV project costs. To date, the City has received all but approximately $150,000 from the overall $10,390,000 tax allocation bond proceeds. The final disbursement is anticipated to occur prior to February of 1991 if the assessed evaluation has reached a certainthreshhold which will be known shortly prior to this date. Efforts to complete the final plans, specifications, contract documents, and securing all other utility and agency approvals making the final Phase V portion of the project (Carlsbad Village Drive) ready for construction bids are currently underway. As of this date, it is anticipated these documents, and all other necessary approvals, will be ready for a begin-construction date in the Summer of 1991. Page 5 of Agenda Bill No. L7zc EXHIBITS 1. NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Commission of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That a transfer of $126,800 from Streetscape Phase V Project Account No. 811-820-1880-3347 to Phase IV Project Account No. 811-820-1880-3346 is hereby authorized.
