That the Commission, by motion, authorize litigation against the County of San Diego to recover the property tax administration fees illegally withheld from the Redevelopment Agency's tax increment payment.
ITEM EXPLANATION Senate Bill 2557 authorizes the County to charge agencies a share of its costs for administering and collecting the property tax. The City general fund has paid $83,907. The reasonableness of that fee is under review and it is possible the City Attorneys may be recommending expanding the already authorized jail booking litigation to include this fee. It seemed clear that SB 2557 did not apply to redevelopment agencies. Counties are sponsoring legislation to give them that additional authority. Notwithstanding that, the County has acted to extend their charges to the Agency and has deducted $19,094 from our April 24, 1991tax increment payment. The Agency's special counsel has already filed litigation on behalf of their other clients including Culver City, Lynwood, Moreno Valley, Redondo Beach, San Jose, Santa Ana and Santa Clara. They report San Diego's CCDC will be taking similar action on May 7, 1991. It is recommended that the Commission protest these charges and authorize litigation against the County of San Diego to recover the Agency's money which, we believe, was improperly and illegally withheld.
FISCAL IMPACT It is estimated the Agency's share of litigation costs will-be less than $5,000. The Redevelopment Director reports funds are available in the Agency's professional services account.

A letter was sent to you on March 5, 1991, regarding local government ' financing, property tax admjnfstrative cost, providing information relative to Senate Bill 2557 which was approved by the Governor and became Chapter 466 of the Statutes of 1991, addlng paragraph (e) to section 97 of the Revenue and Taxation (R&T) Code.
This letter is to inform you that the portCon of your share of the cost has bean retained from apportionment 119 made on April 16, 1991.
County Counsel advised on March 26, 1991 that the Auditor and,Controller has the authority to retain amounts owed from a property tax apportionment to pay the property tax adminlstratlve costs for cities, schools and other taxing jurisdictions as specified In R&T 97 (a).
By way of remfnder, enclosed is a copy of the invoice or notice that was mailed to you on March 5, 1991, and became the basis for the retention from your apportlonment on April 16, 1991. The costs were arrived at In accordance with the provisions of the new law and the State Controller's InstructIons,
