RECOMMENDED ACTION:
The Design Review Board is recommending that the Housing and
Redevelopment Commission direct the City Attorney to prepare
documents UPHOLDING the denial of an amendment to Major
Redevelopment Permit PR 86-23(A). w-.-a
ITEM EXPLANATION
On March 27, 1991, the Design Review Board denied a request to
amend a Major Redevelopment Permit (RP 86-23) to allow
construction of an eight space parking lot on an adjacent lot and
to utilize up to 3,600 square feet of an existing professional
office building located at 2558 Roosevelt Street for medical use.
RP 86-23 was approved by the Housing and Redevelopment Commission
on May 19, 1987 upon recommendation from the Design Review Board.
The original project is an 8,400 square foot professional office
complex located at 2558 Roosevelt Street. Condition No. 17 of
the Redevelopment Permit approves this project subject to the
condition that no medical offices would be allowed to
occupy/lease any portion of the building. If the applicant
desires to lease space in the building for medical office use,
additional parking shall be required. The ratio for medical
office parking is one space per 200 sq. ft. of medical office
space. The ratio for office parking is one space per 300 sq. ft.
of office space.
The applicant proposed to lease 4,900 square feet from the lot
immediately south of the property and construct an eight space
parking lot to provide the additional spaces needed to
accommodate the medical use. The Design Review Board did not
believe that the app7icant would have adequate long term site
control over the leased lot. The applicant offered to lease the
site for a period of 5 to 10 years and limit medical office space
leases to the same term.
Redevelopment Staff recommended approval of the requested
amendment and believes that an agreement can be structured that
will assure that the leased parking lot remains to serve any
proposed lease for medical use. Additionally, Redevelopment
staff will develop and utilize a business license monitoring
system to confirm that parking is available to serve any proposed
medical use. Staff receives frequent requests for medical office
space in existing buildings within the Village Area. Assisting
and accommodating this need will reduce the existing unleased
office space and aid in-bringing new jobs, increased business and
pedestrians to the area.

If the Commission chooses to grant the applicant’s appeal, your
action is to adopt Resolution No. APPROVING an amendment
to a Major Redevelopment Permit to allow mixed use general
office/medical office at 2558 Roosevelt by providing parking on
an adjacent leased lot. If the Commission upholds the denial as
recommended by the Design Review Board, your action is to direct
the City Attorney to prepare documents UPHOLDING the denial of RP
86-23(A).
ENVIRONMENTAL REVIEW
The Planning Director issued a Notice of Exemption on March 4,
1991.
FISCAL IMPACT
Since this is an existing building, there will be no change in
the property tax increment.

I. RECOMMENDATION
That the Design Review Board ADOPT Design Review Board Resolution No. 164 recommending APPROVAL of an amendment to RP 86-23 to the Housing and Redevelopment Commission based on the findings and subject to the conditions contained therein.
II. PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting approval of an amendment to a Major Redevelopment Permit to allow construction of an eight space parking lot on an adjacent lot (2578 Roosevelt St.) and to utilize up to 3,600 square feet of the professional office building located at 2558 Roosevelt Street for medical use. The total building square feet is 8,400. The applicant proposes to lease 4,900 square feet from the lot immediately south to construct the parking lot.
The Board recommended approval of this project on May 6, 1987. The RP was subsequently approved by the Housing and Redevelopment Commission on May 19, 1987. A condition of the RP approval stated that no medical offices would be allowed. If at a later date the applicant intended to lease any of the structure for medical office, parking would be. required to be provided at a ratio of one space/200 square feet of gross floor area. *
On October 17, 1990, the Board gave preliminary review to the applicant's request. At that time the Board did not support the concept and directed staff to pursue creation of a parking district/authority to allow greater parking flexibility in the Project Area. This is currently included in the Master Plan Consultant R,equest for Proposal.

III. ANALYSIS
The project site is 26,829 square feet. There is an existing residence located to the south side of the property with construction material storage to the rear. The proposed parking lot would be located on the north side of the property. Fifteen feet would separate the house from the parking lot. A six foot wooden fence would be installed along the south side and rear of the parking lot with a six foot masonry wall on the north side.
The existing professional office building and the adjacent property are located in Redevelopment sub-area six. The goal of this sub-area is to maximize the office and professional buffer zone around the residential use.
Since this is an existing building there will be no change in tax increment nor sales tax. However, staff receives frequent requests for medical office use in existing buildings within the Village Area. Assisting and accommodating this need will maximize the existing unleased office space and aid in bringing new jobs, increased business and pedestrians to the area. Of the 8,400 square feet, 6,300 are leased with 2,100 vacant.
Section 21.44.050(5) of the Zoning Ordinance allows for the use of common parking facilities "provided the total of such off street parking spaces, when used together, shall not be less than the sum of the various uses computed separately". The applicant proposes to provide required parking for both the general office and medical office use. In 1987, the Board recommended approval of the RP 87-11, Village Faire using parking ratios computed as stated in the ordinance for this mixed use project. The project and parking arrangement was subsequently approved by the Housing and Redevelopment Commission.
In order to monitor this project and assure that the amount of square feet approved for general office use are not leased as medical office, staff will develop a business license monitoring system. As business license applications are received in the Redevelopment Department, they will be verified against a master list of addresses having special or unique circumstances.
As part of this amendment to the Redevelopment Permit, conditions will be added to require the following:
Applicant will submit a ground lease for the adjacent parking lot for approval by the Housing and Redevelopment Director prior to construction of the parking lot.
Applicant shall submit each new lease signed by tenants for office space to the Housing and Redevelopment Department prior to the applicant signing the lease. Space leases will contain language that advises the prospective tenant of the parking lot lease terms.

Terms for the lease of medical office space shall not exceed the term of the ground lease.
Applicant/Owner will be required to dedicate 5 feet along the front parking lot for street purposes.
IV. GROWTH MANAGEMENT
Development permits and building permits for this project shall be subject to all fees and conditions of the City-wide Facilities and Improvement Plan and Local Facilities Management Plan for Zone 1. v. ENVIRONMENTAL REVIEW
The Planning Director has determined that this project will not cause any significant environmental impacts and Notice of Exemption has been issued by the Planning Director on March 4, 1991.
VI. SUMMARY
The applicant has met the requirements established by the Village Design Manual and the Redevelopment Plan. Redevelopment Staff believes the project will be successful as mixed use general office/medical office and be a benefit to the Village Area. The applicant has met all the requirements necessary for an amendment to the original Redevelopment Permit (85-23) approval. For these reasons, Redevelopment Staff supports the applicants request for mixed use professional/medical office at 3558 Roosevelt Street by providing parking on an adjacent leased lot.

The applicant-shall prepare a 24" x 36" reproducible mylar o the final site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approved b the Planning Director prior to the issuance of building
permits.
The applicant shall prepare a detailed landscape and irriga-
tion plan which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first. All trees propose
shall be of a high canopy variety and be of a specimen size.
All shrubs shall be a minimum of five gallons in size.
~11 landscaped areas including the water feature shall be
maintained in a healthy and thriving condition, free from weeds, trash, and debris.
Any signs proposed for this development shall be designed in conformance with the City's Sign Ordinance and shall require
review and approval of the Planning Director prior to
installation of such signs.
Trash receptacle areas shall be enclosed by a six-foot high
masonry and cultured stone wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director.
All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building.
Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road: color of identification and/or addresses shall contrast to their 'background color.
If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 65913.5. If any such condition i.: determined to be inval'id this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law.
No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director.

Prior to the issuance of building permits, the project applicant shall be required to submit elevations for the northern and eastern sides of the building. These elevations shall be required to be comparable in design as the southern and western elevations, and shall be subject to the approval of the Community Redevelopment Manager.
Prior to the issuance of a grading or building permit, whichever comes first, a soils report shall be prepared and submitted to the City of Carlsbad. If the soils report
indicates the presence of potential fossil bearing material then a two phased program shall be undertaken to avoid possible significant impacts on paleontological resources.
This project is approved subject to the condition that no
medical offices be allowed to occupy/lease any portion of the
building. Should the applicant at a later date intend to
lease any of the structure for medical office use, additional parking shall be required to be provided at a ratio
consistent with the parking ordinance in effect at that
time.
This project is approved upon the condition that flatstone paving materials be incorporated into both project driveways.
Prior to the issuance of building permits, the project applicant shall be required to submit to the Planning Director, for review and approval, a detailed site plan for the entryway plaza.

Prior to hauling dirt or construction mateerials to or from this project, the developer shall submit to and receive approval from the City Engineer for; the proposed haul route. The developer shall comply with all conditions and requirements the City Engineer may impose with regards to tht
hauling operation.
Additional drainage easements and drainage structures shall
be provided or installed as may be required by the City
Engineer.
The owner of the subject property shall execute a hold
harmless agreement regarding drainage across the adjacent
property prior to approval of any grading or building permit
for this project.
Unless a standard variance has been issued, no variance from City Standards is authorized by virtue of approval of this

The developer shall install street lights along all public
and private street frontages in conformance with City of
Carlsbad Standards.
The developer shall install street trees at the equivalent 01 4O-foot intervals along all public street frontages in conformance with City of Carlsbad Standards. The trees shal: be of a variety selected from the approved Street Tree List.
The developer shall install sidewalks along all public streei frontages of this project in conformance with City of Carlsbad Standards prior to occupancy of any buildings.
The developer shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project.
The developer shall be responsible for coordination with
S.D.G.&E., Pacific Telephone, and Cable TV authorities.
Prior to approval of any grading or building permits for thi: project, the owner shall give written consent to the annexation of the area shown within the boundaries or the site plan into the exi'sting City of Carlsbad Street Lighting andalandscaping District No. 1.
The developer shall post a cash deposit in an amount satisfactory to the City Engineer to ensure the replacement of any damaged public improvements incured during the

MINUTES
Patty Cratty stated that Mr. Landreth had been
called out of town and had requested that the permit be extended. He was aware of and accepted
the new conditions.
Chairman McCoy asked whether Mr. Landreth understood Item #23, which state8 that no medical
uses are allowed, and staff indicated he did.
Chairman McCoy opened the Public Hearing at 5:06
p.m., and issued the invitation to speak. Since nc one wished to speak, the Public Hearing was closed.
The Design Review Board adopted the following
Resolution, including the new finding and
conditions mentioned above.
RESOLUTION NO. 165, recommending approval of an extension request for a Xajor Redevelopment Permit
to construct a 4,800 square foot general office building on a 10,203 square foot lot at 715-725 Arbuckle Place.
2. RP 86-23 A (
Request to amend a Major Redevelopment Permit to allow mixed office and medical office use at 2558 Roosevelt Street by providing parking on an
adjacent leased lot.
Patty Cratty gave the staff report as contained in the packet, stating that the additions listed there
would be included in the amendment to the Redevelopment Permit. She said that Condition X30
was expanded to say that the lease cannot be cancelled by the lessor and would be recorded
against both properties. Condition #33 would be added to state: “A six foot wooden fence shall be installed and maintained along the south side and
rear of the parking lot, with a six foot masonry wall on the north side. Condition X34 would be added to state: "The property leased for the parking lot shall be for the exclusive use of providing parking for 2550 Roosevelt Street, and
signs noticing this restriction shall be installed to the satisfaction of the Planning Director."
The Resolution should state "Special Meeting” rather than "Regular".
Member McFadden asked whether it was correct that this would then close the gate on the east side and
there would be a solid fence across there. Staff concurred and stated that the applicant had not
seen the additional conditions.
Member McFadden said there was nothing in the conditions that stated the medical parking would be reduced if the property owner pulled out of the lease.

Ron Ball stated he understood that concern and that an appropriate condition might be one that said
that the medical use will cease if the ground lease expires or is terminated for any cause, unless
alternative parking has been approved and provided. That would make it self-executing.
Staff indicated that the Redevelopment Director
would assure a provision in the lease notifying the tenant that their term can be no longer than the
ground lease and notifying them of the provision of this Resolution that mandate5 the medical uses if
the ground lease is terminated.
Chairman McCoy opened the Public Hearing at 5:16 p.m., and issued the invitation to speak.
Henry Tubbs, 2558 Roosevelt Street, stated he felt this was a solution to a parking problem that has
not been addressed within the downtown village area. This additional parking is in a convenient
area next door and the people don't have to cross streets to use the parking. He said that the leases with the medical tenants would be tied to
the lease of the parking space, and there would be notice to all parties. Mr. Tubbs said they were
trying to find a solution for clients trying to lease medical space.
Mr. Tubbs referred to Condition X29 concerning the
dedication of five feet along the project frontage, stating no other property owners along there had to
make this dedication, and he questioned why they had to lose the use of this additional five feet.
Mr. Tubbs referred to Condition #JO, stating if the
lease were to be a ten year lease, he would request that it not be reviewed for the term of that lease.
Mr. Tubbs felt that Item #31, stating "lease signed
by tenants for non-medical/general office space" should say "tenants for medical/non-general use".
With reference to the new Condition #33, Mr. Tubbs said the six foot fence was all right, but he said
the six foot gate was needed, to allow'for the same
use of the property behind there, as that is used for construction storage. In reply to Board guery,
Mr. Tubbs stated their lease would be for just the area where the parking space5 would be. He said the use of that area behind the lot could not be
intensified due to City ordinances, as it was a non-conforming use. Concern was expressed that there might be stacking out into the parking lot
while they were.wai.ting to get into that storage yard. Mr. Tubbs said it would only be long enough to open the gate. The Board Members felt it should
, be a solid fence in that area.
In reply to query regarding the easement, staff
indicated that was an oversight on the part of staff on the original project. This would give the
60 foot right-of-way reguired.

Board Member discussion determined that there was concern that there was no control of the property.
There was no medical allowed with this particular
parking, and that has not changed, as the method c
taking care of the parking is not a strong method.
Mr. Tubbs reiterated that the original permit
allowed them to go to medical use if they could provide additional parking, and that is what they
were presenting here within the guidelines of the City ordinances and terms of the lease.
Mr. Tubbs was questioned about the term of this
parking lease, and he indicated five to ten years, but he said that no negotiations had been started as they were not aware of City requirements.
In response to Board Query regarding a parking
district, Kathy Graham answered that as a conditio of the Master Plan, there is to be a study done on
establishing a method to generate additional
parking in the downtown area and to determine how to fund it. She further stated that staff is read
to put forth the final copy for the Master Plan within the next week, and they want to deal with parking immediately--hopefully within six months.
Chairman McCoy closed the Public Hearing at 5:40
p.m.

Request to allow intensification to medical use in the existing professional office building at 2558 Rooeevelt Street.
Patty Cratty gave the staff report on this item. She.eaid one of the conditiona-of approval wae that
no medical use warn to be allowed. If medical use was to be considered later, then the parking
requirement would be one,opace for each 200 square
feet of groam area. Beforo the applicant proceeds with the leame of the property, he would like

part medical and part professional occupancy, as there is no monitoring eystem at this time.
Board Member Rombotie inquired whether there was
some way to refuse to issue a burineer license if
the parking was not being provided. He felt the parking immediately adjacent would enhance the project and not be a detriment. Ms. Cratty repliec
that it would not be impoerible to set up some type of process for this, especially with the use of the
computers.
Board Member McFadden asked whether it was poesiblc to have a lease that would assure those parking spaces would always be there in the adjacent lot.
Assistant City Attorney Ball stated that the term of the office lease could coincide with the term 01
the parking lease so that no one renta an office ir the building for longer than the term of the lease
on the parking spaces.
Board Member McFadden inquired when the analysis oi the definition of medical use would be completed bl
staff, and Ms. Graham said it was not yet complete.
She said that this study would be included in the
Master Plan for the downtown area.
Chairman McCoy stated he wanted a Planning Department report.
Gary Wayne said that on the preliminary findings of
the study Redevelopment is engaged in, there waa concern this might open the door for specialty
uses. Monitoring is not impossible,. but becomes a burden when business licenses and leaaee are
involved. He said that staff wanted to review thir to know that all those people have business
licenses. Enforcement is a big problem and staff would rather not have to enforce such an arrangement.
Mark.Go&ar, 2558 Roosevelt Street, spoke in favor of the requeet, et,ating that no lease would run
longer than the lease for the extra parking spaces.
When asked about the people having to walk from the adjacent area to the building for medical officea, Mr. Gom@ar said there is no separation between the parking area and thebuilding and the people could
walk from their cars to the building. Mrs. McFadden suggested that the ill people might want to be able to park closer. Mr. Gombaf stated he
would be happy to mark the parking spaces.

AsSiStant City Attorney Ball stated there would be
no problem if the applicant leased the entire
adjacent parcel; however, if only a portion were leaaed, that could require a map.
Board Member Schrannn asked how long a lease would be given on the parking apaces, and staff indicated
10 to 15 yeara.
Henry Tubbs, 2558 Roosevelt Street, representing Preaidential Plaza, etated they would participate
to verify the uaes at the time there was a new occupancy permit, on the new use as well as the
existing uses.
Board Member Rombotis stated he would move for
staff to return with conditions for approval.
Board Member HcPadden stated she was concerned with
setting a precedent. There is a need to go forward with a parking authority or district, and she
stated she wanted to encourage that. Since the applicant does not own the land that the additional
parking spaces would be on, Mrs. McFadden said she could not support this request.
Board Member Schramm atated she had looked at the' site and was uncomfortable with leased parking. If there are going to be medical services, need
parking provided. If a building is being built and it is not certain as to what type of businesses will occupy that building, it should be parked to
the maximum standard to begin with. This would allow for medical and/or professional use. She
said she could not support this reguest, but did
support the need for a parking authority or district for the Redevelopment area.
Motion to direct staff to return with conditions of approval for intensified medical use in the
professional office building at 2558 Roosevelt Street. Motion failed.
The Design Review Board regueeted etaff to present an item on the next agenda for discussion on the feasibility of a parking authority for the
Redevelopment area.

Preliminary review of request to allow applicant to
be given credit and utilise four (4) parking spaces in public parking lot for required off-street parking in lieu of providing them on the site.
Allan Sweeney gave the staff report, stating the
t four parking spaces would be in a City.parking lot, and the project is north of the Redevelopment Office on the west side of Roosevelt Street.

or. Sweeney said that because of the small lot, the applicant was having difficulty in finding an
acceptable design. The present plan is to demolish
the existing building and build a new one facing
Roosevelt. With the Design Manual encouraging
innovative parking, the applicant feels this is the
way to solve the problem of the small lot.
Mr. Sweeney stated that since this is a preliminary
review, no extensive staff analysis has been made.
The applicant would like to know the Board's feeling with regard to using spaces in a City
parking lot.
Clark Knapp, 2508 Congress Street, representing Game Towne and owner of the property, stated they
have been working on a design that would be pedeatrian oriented. He showed pictures of the
interior design and explained this ia a retail store that sells games and puzzles.
Mark Davis, 24445 Juan Street, San Diego,
representing Davis Architects, stated that they had met with staff to try to find a design that would
meet the needs of the Redevelopment areq and the Planning Department. He said the access to the project and the parking needed to be worked out,
and staff suggested they come before the Design Review Board.
In reply to query regarding underground parking,
the applicant stated the cost would be prohibitive. The parking alternatives were discussed, with Mr. Davis stating they had explored all possible waya
to accomplish having a building that would be desirable plus the parking required.
Board discussion determined that this City parking lot is heavily used and the consensus was that
using public parking was not innovative. The feeling was that someone needs to look at the need for parking in the Redevelopment area. These
parking lots were to replace the spaces lost on Elm Avenue because of the streetscape. Also, the
suggestion was made to make an assessment of that particular parking lot.
Kathy Graham stated she would report back at the
next meeting.
The Design Review Board continued the Game Towne item until the December 5, 1990, meeting.
Kathy Graham stated her Department is preparing a packet for the Members who did not attend the tour on October 20, 1990, to.the SRO units in San Diego. She described some other SRO projects and said she
is working with the Planning Department on affordable housing and SRO units.

Ha. Graham continued, stating that over thm next five years 1,200 units of affordable housing in
required in Carlsbad. She aaid it is important to look at the City'8 fair share of that affordable
housing. Mixed-use and SRO's may be able to help
the City meet its goal.
Ms. Graham stated that some of the projects that have been before this Board recently are looking a
mixed-use/retail. She said she needed the consensus of this Board on this type of use before staff spent their time working on this concept, ant
to know that this Board is enthusiastic about this
Board Member Rombotis stated that the project by Mr. Rowe would more appropriately be
travel/commercial; however, the other project coulc be great as a mixed-use project.
Board Member Schrannn stated she is for this concepi and also feels that lower-income housing does not
need to be in the Redevelopment area--but in all
four quadrants.
Board Member NcFadden agreed with W-8. Bchranxn and said that ahe does not feel SRO's are needed due tc
the density: but the mixed-use concept is needed.
Chairman McCoy aaid that guidelines are needed wit1 a minimum square footage in SRG'e. He would want to see layout8 of the areas and decent closet apacc
and bathroom facilities. He said he would also need to know what amenities are necessary for SRO'!
and mixed-use*.
Mr. McCoy said it would have to be determined how to deal with restaurants, and not have living units above them. Also, he said he was not Fn favor of high densities.
Kathy Graham naid that the Planning Department haa
arranged two tours with additional units, and she will give that.information to this Board.

ANALYSIS OF MEDICAL PARKING STANDARDS
Recently, in response to Council direction, staff revisited the ordinances and standards adopted by the City Council, which relate to medical parking. Based on staff's evaluation, and after comparing Carlsbad's standards with those presented in Municinal Parkina Standards for 155 Selected California Cities, a survey conducted by International Parking Design Incorporated, we are satisfied that the City's current standards are appropriate. Consequently, we are not recommending any amendments or new standards be considered at this time.
Staff does, however, recognize that there may be parking issues and factors related to specific medical and other uses which are unique to the redevelopment area. In these instances, staff is recommending each case be evaluated on its own merits. Additionally, staff believes it would be beneficial to include a review of downtown parking requirements as part of the new proposed Redevelopment Master Plan.

We are unable to process your request for appeal of the Design Review Board's position on the preliminary review of intensification to medical use in the existing professional
office located at 2558 Roosevelt Street. Your request to the
Board was for direction only. The Board was not reviewing your
project as an application.
Since you have not filed an application for an amendment to your Major Redevelopment Permit, RP 86-23, there is no process for appeal.
Submittal of an application for amendment to your Redevelopment Permit would begin an extensive review of your request for conformance with City codes. Staff review is not done on projects submitted for preliminary discussion before the Board.

2135.010 Intent and purpose.
The village redevelopmentzone is intended to
establish land use classifications and develop
standards and procedures for that area of the‘city
described in the Carl&d village area redevelop
ment plan. as adopted by city council Ordinance
No. 9591. This zone adopts the land use classifi-
cations and development standards of the Carls-
bad village area redevelopment plan and of the
village design manual adopted pursuant to the
redevelopment plan as the zoning for the area

2135.020 Incorporation of redevelopment
ph and design manual by
reference.
The Carl&ad village area redevelopment plan
as adopted by Carlsbad city council Ordinance
No. 9591 and the village design manual as
adopted by Carlsbad housing and redevelop
ment commission Resolution No. 14 are hereby
adopted by reference and incorporated into this

2135.030 Land affected by this chapter.
This chapter shall apply only to lands located
within the boundaries of the Carkbad village
area the boundaries of which are described in the
Carlsbad village area redevelopment plan. (Ord.

2135.040 &mitteduses.
Only those uses specified in the Carlsbad \;il-
lage area redevelopment plan and the village
design manual as permitted uses for particular L
property in the village redevelopment area shah

2135.0!!0 Conditional uses.
Uses permitted as conditional uses by the
Carlsbad village area redevelopment plan and
the village design manual shall be permitted
upon issuance of a redevelopment permit
approved according to this chapter. (Ord. 9639 4

2135.060 General regulations.
Subject to the provisions of Section 2 I .35.130
and except as otherwise provided by the Carlsbad
village redevelopment plan or the village design
manual, the regulations of this title which apply to usesgenerally or generally to all zoning classi-
fications shall apply to property and uses in this

2135.070 Redevelopment permit.
No development. redevelopment, building or
rebuilding shall occur in the area subject to this

having been issued by the housing and redevel-
opment commission or, for minor projects
defined in Section 21.35.080, by the design

2 135.080 Minor projects.
A minor project includes:
(a) Requests not involving a structural
change;
(b) Projects involving a structural change
costing less than fifty thousand dollars:
(c) Use changes in existing buildings;
(d) New signs or changes to existing signs.

2135.085 kmit application.
(a) An application for a redevelopment per-
mit may be made by the record owner or owners
of the property on which the development is
proposed to be constructed or the authorized
agents thereof. The application shall be filed with
the director of building and planning upon forms
provided by the director, and shall be accom-
panied by plans in sufficient detail to allow
review pursuant to this chapter, a legal descrip
tion of the property involved and an explanation
and description of the proposed use. The director
of building and housing may prescribe the form
and content for such application. If the project
involves the subdivision of land the application
shall be accompanied by a tentative map or ten-
tative parcel map, which shall be fki in accord-
ance with the provisions of Title 20 of this code.
If a subdivision map has previously been
recorded on the lot permitting the use of the
property for the purposes stated in the redevelop
ment permit application, then a tentative map or
tentative parcel map need not be filed. The direc-
tor of building and planping shall forward the
application to the appropriate city departments
21.35.070
for review and recommendation. Except as pr+
vided herein, the director of building and plan-
ning shall also refer the application to the
housing and redevelopment advisory committee
for review and recommendation.
(b) The committee need not hold a public
hearing on the application. If the committee does
not report on the application within thirty days
of the date the application is referred to it, the
application shall be deemed to have been recom-
mended for approval. Pursuant to Section
34 120.5 of the Health and Safety Code, the com-
mittee may, by resolution, exclude from its
review applications for all or any classification of
projects subject to this chapter
(c) The application shall be accompanied by a
fee in the amount establishec$ by city council

2135.090 -lhamittai to desilpr review board.
After all nemSary reports and recommenda-
tions haye been received the director of building
and planning shall transmit the application for
the redevelopment permit together with the
repoa and the recommendations of the appro-
priate departments to the design review board for
a public hearing. Notice of the public hearing
shall be given as provided in Section 2 1.54.060( 1)

2135.100 Design review hoard action.
(a) The design review board shall hold a pub-
lic hearing on all redevelopment permits except
for minor projects.
(b) For minor projects defined In Section 21.35.080, the design review board shall consider
the evidence and by resolution approve. condi-
tionally approve or deny the project. Such deter-
mination shail be made in accordance with this
code, the general plan, the Carisbad village area
redevelopment plan and the village design man-
ual.

(c) For ail Other w the board shall con-
sider the evidence and by resolution recommend
to the housing and redevelopment commission
approval, condithal approvai of the project or
denial of the project. Such resolution shall state.
among other things, the facts and reasons why
the board determined the approval, conditional
approval or denial to be consistent with this
chapter. The action of the board to deny the
permit is final unless appealed to the commis-
sion. The action to approve or conditionally
approve is advisory to the commission and the
city clerk shall set the matters to public hearing
before the commission within thirty days after
the adoption of the resolution.
(d) Notice of public hearings shall be given as
provided.ih Section 21.54.060(l) of this code.

2135.110 Appeal to housing and
redevelopment commission.
Any interested party may appeal a design
review board decision on a minor project or
denial of any other project by filing a written
appeal with the city clerk within ten days of the
date of the decision. (Ord. 9679 $ 1 (part), 1983:
Ord. 9639 3 1 (part), 1982)
2135.115 Housing and redevelopment
commission action. The housing and redevelopment commission
shall hold a public hearing on a redevelopment
permit which has been appealed or for which the
design review board has filed a report with the
city clerk. At the public hearing, the housing and
redevelopment commission shall review the
design review board’s report. shall consider the
evidence and shall approve, conditionally
approve, or disapprove the permit. Such deter-
mination shall be made in accordance with this
code, the general plan, the Carlsbad vijhge area redevelopment plan and the village design man-
ual. The housing and redevelopment‘ com.mis-
sion may refer the permit to the housing and
redevelopment advisory committee for report
and recommendation. Such report and recom-
mend&on shall be made within thirty days of
the dated referral. The housing and redevelop
ment advisory committee need not hold a public
hearing on the project. Notice of the public hear-
ing shall be given as provided in Section
21.54.060(l) of this code. (Ord. 9758 0 7, 1985;

2135.120 Consolidation of other permit
requirements.
Whenever a project would rquire a permit or
approvai under the provisions of this title, not-
withstanding this chapter, the redevelopment
permit shall be deemed to satisfy the rquire-
ments for such permit or approval; provided,
however, that in considering the redevelopment
permit for said project the design review board
and the housing and redevelopment commission
shall apply the provisions of this chapter and the
provisions of this title otherwise applicable to
such other permit or approval for the project.

2135.130 Exemptions.
(a) The housing and redevelopment commis-
sion is authotized to grant exceptions from the
limits, restrictions and controls established by
this chapter if the commission finds that:
(1) The application of certain provisions of this chapter would result in practical diffxulties
or unnecessary hardships which would make
development inconsistent with the general pur-
pose and intent of the Carlsbad village area rede-
velopment plan;
(2) There are exceptional circumstances or
conditions unique to the property or the pro-
posed development which do not generaily apply
to other properties or developments which have
the same standards. restrictions and controls:
(3) The granting of an exemption till not be
injurious or materially detrimental to the public
welfare, other properties or improvements in the
project area; and

(4) ihe Ilnlnting of an exemption will not
contradict the standards established in the village
design manual. An application for exemption
shall be processed in the same manner estab-
lished by this chapter for a redevelopment per-
mit. In granting an exemption, the housing and
redevelopment commission may impose such
conditions as are necessary to protect the public
health, safety and welfare. (Ord. 9639 $1 (part),

2135.140 Compliance with other provisions
of this code.
Prpjects developed pursuant to this chapter
shall be subject to ail other applicable provisions
of the Carlsbad Municipal Code, including but
not limited to those provisions of Titles 18, 19 and 20. (Ord. 9639 § 1 (part), 1982)
2135.150 Amendments.
Amendments to the Carlsbad village area
redevelopment plan or the village design manual
shall be deemed to be amendments to this chap
ter, provided+ however, that such amendments
are processed and noticed in a manner which I
meets the requirements of Chapter 2 1.52 of this
code. Amendment of the village design manuai
by housing and redevelopment commission res-
olution shali be deemed to satisfy the require-
ments of Chapter 2 1.52 of this code, provided all
