RECOMMENDED ACTION:
That the Housing and Redevelopment Commission direct the City Attorney to prepare documents APPROVING the Negative Declaration issued by the Planning Director and APPROVING RP 90-6 and CDP 90-3 based on the findings and subject to the conditions contained therein.
ITEM EXPLANATION
The'replacement and expansion of the Redevelopment portion of the Vista/Carlsbad Sewer Interceptor requires approval of RP 90-6 and CDP 90-3. The Interceptor expansion is required due to projected capacity deficits identified in the Zone 1 Local Facilities Management Plan and the City's Master Sewerage Plan. The expanded interceptor which will be constructed parallel to existing lines within street and railroad rights-of-way will ensure the provision of an adequate sewer collection system to meet demand through buildout of the area.
The public works project received the required General Plan consistency determination from the Planning Commission on May 15, 1991, and was reviewed by the Design Review Board and recommended for approval on June 5, 1991.

SUBJECT: RP 90-6/CDP 90-3 - VISI’AKARISBAD SEWER INTERCEPTOR - Request for
a Redevelopment Permit and Redevelopment Coastal Permit to allow the
construction of a 36” to 48” sewer interceptor within the City’s right-of-way
along Jefferson Street and Oak Avenue, and within the AT&SF Railroad
right-of-way from Oak Avenue to the southern redevelopment boundary.
RECOMMENDATION
That the Design Review Board ADOPT Design Review Board Resolution No. 166
recommending approval of the Negative Declaration issued by the Planning Director, and
ADOPT Resolution No’s. 167 and 168 recommending approval of RP 90-6 and CDP 90-3
based on the findings and subject to the conditions contained therein.
II. PROJJXX DE!ERIPTION AND BACKGROUND
The proposed public works project consists of the replacement and expansion of the
VistaKarlsbad Sewer Interceptor, which is the major trunk system serving the northern
half of the City. The interceptor extends from the Buena Vista Lagoon, through the
downtown area and Agua Hedionda Lagoon to the Encina Water Pollution Control Facility
Treatment Plant. The project includes the construction of a 36” to 48” replacement
interceptor parallel to the existing interceptor within the rights-of-way of Jefferson Street
from I-5 to Oak Avenue, Oak Avenue to the railroad right-of-way, and south along the
railroad right-of-way to a point 1,400 feet south of Tamarack Avenue.
Section 65401 of the California Government Code requires that a General Plan Consistency
Determination be made for major public works projects. This Consistency determination
for the project was made by the Planning Commission on May 15, 1991.
The Interceptor expansion is required due to projected capacity deficits identified in the
Zone 1 Local Facilities Management Plan and the City’s Master Sewerage Plan. The
expanded interceptor satisfies through buildout the Zone 1 Growth Management Performance Standard for sewer collection systems requiring trunk line capacity to meet
demand. The existing interceptor will be abandoned and each new segment will be
constructed when the lines can no longer meet current or future demand. Construction
will consist of trench grading to bury the new interceptor parallel to existing lines within
the City and railroad rights-of-way.

Planninn Issues

Zone as specified in the Village Area Redevelopment Plan?

3. Is the proposed project consistent with the Village Redevelopment Local Coastal
Program as specified in the Village Design Manual?
Village Redevelopment Zone
Approval of the proposed major public works project is consistent with the Redevelopment
Zone since the Village Area Redevelopment Plan authorizes the Housing and
Redevelopment Commission to make provisions for the construction of public utilities
necessary to carry out the Plan’s goals and objectives. The Redevelopment Zone is subject
to the Growth Management standard for sewer collection systems requiring that trunk line
capacity to meet demand must be provided concurrent with development. The City’s
Master Sewerage Plan indicates that the above described improvements to the
VistaKarlsbad Interceptor will be required to meet existing as well as buildout demand;
therefore, approval of the new Interceptor is necessary to accomplish the goals and
objectives set forth in the Redevelopment Plan.
General Plan Consistency
One oveniding goal of the Public Facilities Element of the General Plan is to ensure that
adequate public facilities are available for the existing and future population of the City.
This project achieves this objective by providing existing and future residents in Zone 1
with an adequate sewer collection system through buildout of the City.
The Land Use Elanent of the General Plan states that the Planning Department should:
1) permit the development of land only after adequate provision for services such as
transportation, water, sewerage, utilities, and public facilities; and 2) develop programs
which would correlate rate of growth and service capabilities of the City. This project
which provides an adequate sewer collection system to meet the existing and future
demand of the area as required by the Growth Management Ordinance is consistent with
these policies.

Village Redevelonment Coastal DeVdODment Promam
The portion of the project within the Village Redevelopment Coastal Program area is
consistent with the Local Coastal Plan since the expanded capacity of the new sewer
interceptor will allow development to proceed to meet projected future demand based on
the existing General Plan designations regulating residential density and
commercial/industrial uses. Trench grading in the existing street rights-of-way to bury the
interceptor segments will minimize prolonged construction impacts such as traffic, dusr,
and noise.
In summary, the proposed improvements to the VistaKarlsbad Sewer Interceptor are
consistent with the above General Plan goals and policies, the Redevelopment Zone, and
the Local Coastal Program; therefore, Staff recommends that the Design Review Board
recommend approval of Redevelopment Permit RP 90-6 and Coastal Development Permit
CDP 90-3 as conditioned.
ENVIRONMENTAL REVIEW
The Planning Director has detetmined that the project will have no significant
environmental impacts and has issued a Negative Declaration on December 28, 1990. This
Planning Directois decision was based on the Initial Study and a field visit conducted by
staff. The project will replace an existing sewer interceptor and will be located underneath
existing streets, and therefore will create no significant environmental impacts. The
Negative Declaration was sent to the State Clearinghouse for agency review and no
comments were received.

BIOLOGKAL ENVIRONMENT
The proposed project will occur under existing streets and within the ATS&F railroad right of USA>.;

The project consistr of the replacement of the existing sewer interceptor to supply current and future
demand for sewer se&cc. Any noise impacts will be those resulting f?om the temporary grading ar.d
construction.
The temporary grading and construction noise and dust impacts to surrounding residential and
commercial development are unavoidable; these impacts are necessary to provide adequate sewer
facilities to the area. The required grading permit will restrict construction operations to the hours of 7:00 a.m. to sunset on weekdays, and a dust abatement procedure is required to minimize these
impacts on the surrounding area. Since no construction above grade will occur, no light or glare
impacts are anticipated.

The proposed VistaKarlsbad sewer interceptor project is one phase of the Sewer Master Plan and is
required to expand the capacity of flow to meet the demand projected by the Zone 1 Local Facilities
Management Plan. The project was included in the 1987-88 Capital tmprovement Program and wiII
be constructed entirely within the right of way of collector and local streets and the railroad in the
Nonhwest Quadrant.

1) PCD/GPC 90-13 - VISTA/CARLSBAD SEWER INTWCEPTOR -
Request for a General Plan Consistency Determination to allow the construction of a 36" to 18" sewer interceptor
within the City right-of-way along Jefferson Street, Oak Avenue, and within the AT&SF railroad right-of-way from
Oak Avenue to a point south of Olive Avenue and a 12" sewer main within the right-of-way of Chestnut Avenue
from Harding Street to the AT&SF railroad right-of-way.
Anne Hysong, Assistant Planner, reviewed the background of the request and stated that the proposed project consists of
the replacement and expansion of a portion of the Vista/Carlsbad sewer interceptor located east of I-5, the
Buena Vista, and Agua Hedionda lagoons. It is under
consideration because a General Plan Consistency Determination is required for public works projects.
Ihe interceptor expansion is necessary to correct existing and projected sewer line capacity deficits identified in the
Zone 1 Local Facility Management Plan and the City's Master Sewage Plan. The proposed interceptor will be buried
parallel to the interceptor located in the right-of-way of Jefferson Street, Oak Avenue, and the railroad right-of-way. The project also includes a 12" sewer main in the
right-of-way of Chestnut Avenue from Harding Street to the railroad right-of-way. The project will provide an adequate sewer collection system to the area through buildout and is,
therefore, consistent with the goals and policies of the Public Facilities and Land Use Element for the General Plan requiring adequate public facilities to meet the demand of
the existing and future population.

The public works project is consistent with the General Plan and staff recommends that the Commission make the required
consistency determination.
Commissioner Erwin inquired when the construction would start and finish. Gary Kellison, Municipal Projects, replied that construction would begin in 1992 concurrent with the Chestnut Avenue sewer project. The balance of the project would
commence in the year 2000+ depending on when the Vista/Carlsbad jointly owned interceptor reaches capacity.
Commissioner Erwin expressed curiosity about the
Vista/Carlsbad interceptor and inquired if Vista uses this line. Mr. Kellison replied that Carlsbad's ownership and flow percentage varies from 27-51% and the balance is owned
by Vista for their effluent. These percentages do not refer
to Encina but only the sewer line. Vista will be responsible for funding their portion of the project.
Chairman Holmes opened the public testimony and issued the invitation to speak.
There being no persons desiring to address the Commission on
this topic, Chairman Holmes declared the public testimony closed and opened the item for discussion among the Commission members.
Motion was duly made, seconded, and carried to adopt Planning Commission Resolution No. 3232 approving the Negative
Declaration issued by the Planning Director, and adopt Planning Commission Resolution No. 3233 approving PCD/GPC
90-13 making the determination that the construction of a new Vista/Carlsbad Sewer Interceptor is consistent with the
General Plan based upon the findings and subject to the conditions contained therein.
2) CUP 204(B) - ST. PATRICK'S CHURCH PARKING LOT - Request to amend an existing Conditional User Permit 204 to
allow a 12,400 square foot parking lot addition which adds 27 (net) parking stalls at St. Patrick's Church, 3821 Adams Street, in the R-l Zone and in Local
Facilities Management Plan Zone 1.
Commissioner Schlehuber declared for the record that he is a member of the St. Patrick's congregation. After discussion
with the City Attorney, Commissioner Schlehuber has decided to vote on this issue because he does not serve on any Church
committees and he feels he can be fair and impartial.
Robert Green, Principal Planner, reviewed the background of the request and stated that this item is a Conditional Use Permit (CUP) amendment to allow a 27 space parking lot at St. Patrick's Church located at 3821 Adams Street in the R-l Zone. Churches and accessory uses are allowed in the R-l
Zone with a CUP. The proposed parking lot will supplement existing parking on the site to provide for a total of 169 parking spaces. These spaces will service the existing
church and multi-purpose parish center which have 750 and 600 seats respectively. Based on the parking ordinance of 1:5 at the time the church was constructed, the 169 spaces provided
were adequate for the use of either the church or the parish center. However, when both structures are fully occupied
simultaneously, the present parking is not sufficient. Although the applicant does not plan to use both facilities at the same time, a condition has been placed on the CUP that
