ITEM EXPLANATION The City Council at your meeting of March 7, 1992 directed our . office to prepare a resolution approving a major redevelopment permit (RP-91-6). That document is attached. The Housing and Redevelopment Commission should satisfy itself that the findings and conditions accurately reflect your intentions in the matter. EXHIBITS Resolution No. a06 1 2 3 4 5 6 7 6 9 10 11 12 13 14 15 16 17 16 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 206 A RESOLUTION OF THE HOUSING AND REDEVELOPMENT COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING A MAJOR REDEVELOPMENT PERMIT (RP 91- 6) TO ALLOW THE CONSTRUCTION OF AN 8,700 SQUARE FOOT TWO STORY OFFICE BUILDING WITH SUBTERRANEAN PARKING ON PROPERTY GENERALLY LOCATED AT 2815 JEFFERSON STREET WITHIN SUB- AREA 1 OF THE VILLAGE REDEVELOPMENT ZONE. APPLICANT: PRESIDENTIAL CENTRE CASE NO: RP 91-6 WHEREAS, on February 19, 1992 the Carlsbad Design Review Board held a duly noticed public hearing to consider a Major Redevelopment Permit (RP-91-6) for an 8,700 square foot two story office building with subterranean parking and adopted Design Review Board Resolution No. 178 recommending to the Housing and Redevelopment Commission that the Major Redevelopment Permit (RP- 91-6) be approved: and WHEREAS, the Housing and Redevelopment Commission of the City of Carlsbad, on March 7, 1992 held a public hearing to consider the recommendations and heard all persons interested in or opposed to RP 91-6; and WHEREAS, a Negative Declaration was previously issued on February 26, 1988 and submitted to the State Clearinghouse for a 30 day review period. All comments received from that review period are fully incorporated into the conditions of approval for the redevelopment permit. These conditions will be reviewed through a monitoring program set up for the project. NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Commission of the City of Carlsbad, California, as follows: 1. That Redevelopment Permit RP 91-6 is approved and that the findings and conditions of the Design Review Board contained in Resolution No. 178 marked Exhibit A and attached hereto are the findings and conditions of the Housing and Redevelopment Commission. 3. This action is final the date this resolution is adopted by the City Council. The provision of Chapter 1.16 of the Carlsbad Municipal Code, "Time Limits for Judicial Review" shall apply: "NOTICE TO APPLICANT" "The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking judicial review must be filed in the appropriate court not later than the ninetieth day following the date on which this decision becomes final; however, if within ten days after the decision becomes final a request for the record of the proceedings accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one. The project is consistent with the goals and objectives of the Village Design Manual as detailed in the Staff Report dated February 19, 1992. The project meets all the requirements of the Zoning Ordinance, including the goals and design and development standards specified by the Village Design Manual for the Village Redevelopment Zone, Sub-area 1, including Section IX, Offstreet Parking Areas, of the Village Redevelopment Manual permitting up to 40% of the required parking spaces to be compact at the election of the Housing & Redevelopment Commission. The proposed project will contribute to the economic revitalization of the Redevelopment Area. The proposed project is compatible with the surrounding future land uses since surrounding properties are designated for RMH/O Medium High Residential/Office development on the General Plan. . This project is consistent with the City+ Growth Management Ordinance as it has been conditioned to comply with any requirement approved as part of the Local Facilities Management Plan for Zone 1. ?lanninn Conditions: 1. 2. 3. 4. Approval is granted for RP 91-6, as shown on Exhibits “A” - “s’, dated February 19, 1992, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. The developer shall provide the City with a reproducible 24” x 36”, mylar copy of the site plan as approved by the Planning Commission. The site plan shall reflect the conditions of approval by the City. The site plan copy shall be submitted to the City Engineer prior to building, grading or improvement plan submittal, whichever occurs first. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. If the fees are not naid tmm&natm-uujth the General Plan and approval for this project will be void. This project shall comply with all conditions and mitigation required by the Zone 1 Local Facilities Management Plan approved by the City Council on September I, 1987, incorporated herein and on file in the Planning Department and any future amendments to the Plan made prior to the issuance of building permits. Approval of this ,request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City ordinances in effect at tune of building permit issuance. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view.and the sound buffered from adjacent properties and streets, in substance as provided in Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the issuance of grading or building permits, whichever occurs first. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. All landscape plans shall be prepared to conform with the Landscape Manual and submitted per the landscape plan check procedures on file in the Planning Department. Landscape plans shall be designed to minimize water use. Lawn and other zone 1 plants (see Landscape Manual) shall be limited to areas of special visual importance or high use. Mulches shall be used and irrigation equipment and design shall promote water conservation. Prior to final occupancy, a letter from a California licensed landscape architect shall be submitted to the Planning Director certifying that all landscaping has been installed as shown on the approved landscape plans. The applicant shall pay a landscape plan check and inspection fee as required by Section 20.08.050 of the Carlsbad Municipal Code. A uniform sign program for this development shall be submitted to the Planning Director for his review and approval prior to occupancy of any building. Any signs proposed for this development shall at a minimum be designed in conformance with the City’s Sign Ordinance and shall require review and approval of the Planning Director prior to installation of such signs. Medical or dental uses shall not be allowed in this project unless square footage is reduced proportionately to accommodate parking for medical use. The applicant shall comply with all the rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. The applicant shall be responsible for coordination with S.D.G.&E., Pacific Telephone, and Cable TV authorities. Prior to approval of any grading or building permits for this project, the owner shall give written consent to the annexation of the area shown within the boundaries of the site plan into the existing City of Carlsbad Street Lighting and Landscaping District No. 1 on a form provided by the City. Prior to or con currently with issuing a building permit, the applicant shall obtain a right-of-way permit for the work of removing the driveway approach on the southerly project frontage and replacing with standard curb, gutter and sidewalk. Prior to occupancy, the work in the public right-of-way shall be completed to the satisfaction of the City Engineer. Fire Conditions: 26. Prior to the issuance of building permits, complete building plans shall be submitted to and approved by the Fire Department. Additional public and/or site fire hydrants shall be provided if deemed necessary by the Fire Marshal. Applicant shall submit two (2) copies of a site plan showing locations of existing and proposed fire hydrants and onsite roads and drives to the Fire Marshal for approval. All required fire hydrants, water mains and appurtenances shall be operational prior to combustible building materials being located on the project site. All fire alarm systems, fire hydrants, extinguishing systems, automatic sprinklers, and other systems pertinent to the project shall be submitted to the Fire Department for approval prior to construction. Buildings exceeding 10,000 square feet aggregate floor area shall be sprinklered or have four-hour fire walls with no openings therein which shall split the building into 10,000 square feet (or less) areas. The entire potable and non-potable water system/systems for subject project shall be evaluated in detail to ensure that adequate capacity and pressure for domestic, landscaping and fire flow demands are met. The developer’s engineer shall schedule .a meeting with the District Engineer and the City Fire Marshal and review the preliminary water system layout prior to preparation of the water system improvement plans. The developer will be responsible for all fees and deposits plus the major facility charge which will be collected at time of issuance of building petmit.
