RECOMMENDED ACTION: If the Housing and Redevelopment Commission concurs your action is adopt Housing and Redevelopment Resolution No. 6107 approving a negative declaration and a redevelopment permit (RP-91-4). ITEM EXPLANATION The City Council at your meeting of May 19, 1992 directed our office to prepare a resolution approving a negative declaration and a redevelopment permit (RP-91-4). That document is attached. Condition No. 17 has been amended to read as follows: *'Traffic flow within the property must be managed by the applicant in such a manner to minimize the impact on Harding Street and Carlsbad Village Drive. The Design Review Board may review the applicant's compliance with this condition upon notice at a public hearing at any time the Design Review Board deems review necessary and it may recommend changes to the Housing and Redevelopment Commission." The Housing and Redevelopment Commission should satisfy itself that the findings and conditions accurately reflect your intentions in the matter. APPLICANT: ARC0 AM/PM MINI-MART CASE NO: RP 91-4 WHEREAS, on April 1, 1992 the Carlsbad Design Review Board held a duly noticed public hearing to consider a proposed Negative Declaration and a Redevelopment Permit (RP-91-4) for construction of a gas station and minimart and adopted Design Review Board Resolutions No. 179 and 180 respectively, recommending to the Housing and Redevelopment Commission that the Negative Declaration and Redevelopment Permit (RP-91-4) be approved; and WHEREAS, the Housing and Redevelopment Commission of the City of Carlsbad, on May 19, 1992 held a public hearing to consider the recommendationti and heard all persons interested in or opposed to RP 91-4; and WHEREAS, a Negative Declaration was issued on January 9, 1992 and submitted to the State Clearinghouse for a 30 day review period. All comments received from that review period are fully incorporated into the conditions of approval for the redevelopment permit. These conditions will be reviewed through a monitoring program set up for the project. . NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Commission of the City of Carlsbad, California, as l . follows: 1. That the above recitations are true and Correct. 2. That Redevelopment Permit RP 91-4 is approved and that the findings and conditions of the Design Review Board contained in Resolution No. 180 on file with the City Clerk and incorporated herein by reference are the findings and conditions of the Housing and Redevelopment Commission with the exception of Condition No. 17 to read as follows: "Traffic flow within the property must be managed by the applicant in such a manner to minimize the impact on Harding Street and Carlsbad Village Drive. The Design Review Board may review the applicant's compliance with this condition upon notice at a public hearing at any time the Design Review Board deems review necessary and it may recommend changes to the Housing and Redevelopment Commission." 4. This action is final the date this resolution is adopted by the City Council. The provision of Chapter 1.16 of the Carlsbad Municipal Code, "Time Limits for Judicial Review" shall apply: "NOTICE TO APPLICANT" "The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter 1.16. Any petition or other paper seeking judicial review must be filed in the appropriate court not later than the ninetieth day following the date on which this decision becomes final: however, if within ten days after the decision becomes final a request for the record of the proceedings accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one. NOTICE OF PUBLIC HEARING Redevelopment Permit - RP 91-4 NOTICE IS HEREBY GIVEN that the Housing and Redevelopment Commission of the City of Carlsbad will hold a public hearing at the Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at 6:00 p.m. on Tuesday, May 19, 1992, to consider an application for a Major Redevelopment Permit to allow the demolition of the existing gas station and the construction of a new gas station and mini- mart on property generally located at the northeast corner of Carlsbad Village Drive and Harding Street in the Village Redevelopment Zone/Sub-area 1 and more particularly described as: Lots 1, 2, 3 and 4 in Block 67 of Carlsbad, in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 535, filed in the office of the County Recorder of San Diego County, May 2, 1888. Those persons wishing to speak on this proposal are cordially invited to attend the public hearing.
