CA RECOMMENDED ACTION: If the Commission concurs, your action is to adopt Resolution No. A&!-- approving Redevelopment Permit (RP 92-4) and Coastal Development Permit (CDP 92-3) for two dormitory buildings at the Army & Navy Academy. ITEM EXPLANATION The Housing & Redevelopment Commission at its meeting of July 7, 1992, directed our office to prepare documents approving a redevelopment permit and a coastal development permit for the construction of two dormitory buildings on the Army & Navy Academy campus. Those resolutions are attached. The Commission granted the requested engineering standards variance upon the condition that if the Army & Navy Academy is ever sold in the future, it will dedicate the addition right- of-way required for a 47-foot width. The Commission should satisfy itself that the findings and conditions as recommended by the Design Review Board and as amended by the Commission accurately reflect your intentions in this matter. If the Commissions concurs, Ls!LLLL your action is to adopt Resolution No. EXHIBITS Resolution No. L3Lc 4 . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 212 A RESOLUTION OF THE HOUSING AND REDEVELOPMENT COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING A MAJOR REDEVELOPMENT PERMIT (RP 92-4) AND COASTAL DEVELOPMENT PERMIT (CDP 92-3) TO ALLOW THE CONSTRUCTION OF TWO DORMITORY BUILDINGS CONTAINING 19,075 SQUARE FEET WITHIN TWO STORIES ON PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER OF CYPRESS AVENUE AND OCEAN STREET. CASE NAME: ARMY & NAVY ACADEMY CREAN/ATKINSON HALL CASE NO: RP 92-4/CDP 92-3 WHEREAS, on June 3, 1992 the Carlsbad Design Review Board held a duly noticed public hearing to consider a proposed Major Redevelopment Permit (RP-92-4) and Coastal Development Permit (CDP 92-3) for construction of two dormitory buildings and adopted Design Review Board Resolutions No. 183 and 184 respectively, recommending to the Housing and Redevelopment Commission that the Redevelopment Permit (RP-91-4) and the Coastal Development Permit (CDP 92-3) be approved; and WHEREAS, the Housing and Redevelopment Commission of the City of Carlsbad, on July 7, 1992 held a public hearing to consider the recommendations and heard all persons interested in or opposed to RP 92-4/CDP 92-3; and WHEREAS, the Planning Director has determined that the project is exempt from environmental review under section 15302 of . Title 14 of the California Code of Regulations because the demolition of the three existing structures and the construction of the proposed dormitories will not increase student capacity. The Planning Director shall issue a Notice of Exemption upon final approval of the project. NOW, THEREFORE, BE IT RESOLVED by the' Housing and Redevelopment Commission of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. That the findings and conditions of the Design Review Board in Resolution Nos. 183 and 184 on file with the City Clerk and incorporated herein by reference are the findings and conditions of the Housing and Redevelopment Commission. 3. That Redevelopment Permit RP 92-4 and Coastal Development Permit CDP 92-3 are approved and that the findings and conditions of the Design Review Board contained in Resolution Nos. 183 and 184 on file with the City Clerk and incorporated herein by reference are the findings and conditions of the Housi: and Redevelopment Commi. ;ion wi.th the ex;-option of Condition No. 3 of Reso,ution No. 183 to read as follows: "4 . The Commission grants applicant's engineering standards variance and finds that: A. There are extraordinary or unusual circumstances -or conditions applicable to the situation of surrounding property necessitating a variance of the standards. B. The granting of such variance will not cause substantial drainage problems. C. The granting of such variance willnotconflict with existing or future traffic and parking demands or pedestrian or bicycle use. D. The granting of such variances will not be detrimental to the public welfare or injurious to the property or i-.r.ti2,- c -Jements in t" vicinity in which the variance is granted. E. The granting of such variance will'- not adversely affect the comprehensive general plan and, therefore, modifies V129t' to read as follows: The owner shall make an offer of dedication to the City for all public streets and easements required by these conditions: a) Cypress Avenue from the easterly line of Ocean Street to the easterly line of Garfield Street shall have sufficient right of way dedicated for a right of way width of 40 feet based on the proposed southerly right of way line as shown on the site plan. That proposed southerly row line will coincide approximately with the existing fence so as not to impact the fence. This requires an offsite dedication on a portion of APN 203-141-01. The roadway shall be 32 feet wide with one-half foot curbs and a four foot and three foot wide sidewalk as shown on Exhibit *@l'@ to Project No. RP 92-4 which is attached. b) Ocean Street along the easterly side from the northerly line of Cypress Avenue to the project boundary as shown on the site plan shall have an additional five feet of right of way dedicated based on a center line to right of way distance of 25 feet. 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 cl In addition, the owner shall convey to the City an additional right of way to an ultimate 47 feet wide right of way as shown on Exhibit "6" of Project RP 92-4 attached hereto and incorporated by a reference which shall not become effective until and unless property owner conveys its interest in the real property. No structure shall be located in this additional right of way: The form of the conveyance to the City shall be approved by the City Attorney and recorded prior to the issuance of any building or demolition permits."
