ITEM EXPLANATION
The Housing and Redevelopment Commission, at your meeting of March 28, 1995, voted 3-O (Commissioner Kulchin absent, Commissioner Hall not participating) to approve the above referenced Major Redevelopment Permit (RP 94-07) and Coastal Development Permit (CDP 94-08) for the Carlsbad Village Brewery and Public House. The Commission should satisfy itself that the findings and conditions recommended by the Design Review Board reflect the Commission's intentions.

RESOLUTION NO. 264
A RESOLUTION OF THE HOUSING AND REDEVELOPMENT COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA APPROVING A MAJOR REDEVELOPMENT PERMIT (RP 94-07) AND COASTAL DEVELOPMENT PERMIT (CDP 94-08) FOR A CHANGE IN LAND USE TO PERMIT A NEW RESTAURANT/MICROBREWERY GENERALLY LOCATED ON THE SOUTHWEST CORNER OF CARLSBAD VILLAGE DRIVE AND ROOSEVELT STREET IN SUBAREA 1 OF THE VILLAGE REDEVELOPMENT AREA APPLICANT: CARLSBAD VILLAGE BREWERY AND PUBLIC HOUSE CASE NO: RP 94-07/CDP 94-08
WHEREAS, on March 1, 1995 the Carlsbad Design Review
Board held a duly noticed public hearing to consider a Major
Redevelopment Permit (RP 94-07) and Coastal Development Permit
(CDP 94-08) for a change in land use to permit a new
restaurant/microbrewery at 571 Carlsbad Village Drive and adopted
Design Review Board Resolutions No. 221 and 222 recommending to
the Housing and Redevelopment Commission that Major Redevelopment
Permit (RP 94-07) and Coastal Development Permit (CDP 94-08) be
approved; and
WHEREAS, the Housing and Redevelopment Commission of
the City of Carlsbad, on March-28, 1995 held a duly noticed
public hearing to consider the recommendations and heard all
persons interested in or opposed to Major Redevelopment Permit
(RP 94-07) and Coastal Development Permit (CDP 94-08); and
WHEREAS, the environmental effects have already been
considered in conjunction with previously certified environmental
documents for the Village Redevelopment Plan. Environmental
Impact Review documents for the Redevelopment Plan were completed
and certified by the Planning Commission on November 14, 1979.
This EIR considered all potential impacts of the policies,

procedures and land uses proposed within the Redevelopment Plan
and outlined within the EIR for the Redevelopment Plan. Such
mitigation measures have been made conditions of project
approvals. The proposed project has been developed pursuant to,
and is consistent with, the Village Redevelopment Plan and any
applicable mitigation measures outlined within the EIR for the
Plan. No new circumstances have been identified which would
require subsequent environmental review or a supplement to the
certified EIR for the Redevelopment Plan. As a consequence, no
additional environmental review is required.
NOW, THEREFORE, BE IT RESOLVED by the Housing and
Redevelopment Commission of the City of Carlsbad, California, as
follows:
1. That the above recitations are true and correct.
2. That Major Redevelopment Permit (RP 94-07) and
Coastal Development Permit (CDP 94-08) are approved and that the
findings and conditions of the Design Review Board contained in
Resolutions No. 221 and 222, on file in the City Clerk's office
and incorporated herein by reference, are the findings and
conditions of the Housing and Redevelopment Commission.
3. This action is final the date this resolution is
adopted by the City Council. The provision of Chapter 1.16 of
the Carlsbad Municipal Code, "Time Limits for Judicial Review"
shall apply:

"The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code Chapter

1.16. Any petition or other paper seeking judicial review must be filed in the appropriate court not later than the ninetieth day following the date on which this decision becomes final; however, if within ten days after the decision becomes final a request for the record of the proceedings accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one. A written request for the preparation of the record of the proceedings shall be filed with the City Clerk, City of Carlsbad, 1200 Carlsbad Village Drive, Carlsbad, California 92008."
PASSED, APPROVED AND ADOPTED at a Regular Meeting of
the Housing and Redevelopment Commission of the City of Carlsbad
on the 4th day of APRIL 1995, by the following vote, to
wit:
