ITEM EXPLANATION: . On February 1, 1995, the Design Review Board voted (5-O) to recommend approval of a Negative Declaration, Major Redevelopment Permit and Coastal Development Permit for property on the southeast corner of Carlsbad Boulevard and Christiansen Way. The site is located in a commercial subarea of the Village Redevelopment Area. The proposed permits would allow the construction and operation of a 3,500 square foot mineral springs spa, office and residential,apartment adjacent to the existing AR Karlsbad building. The proposed architecture would continue the European theme by taking examples from Great Britain and France. One of the proposed buildings would measure 35 feet from the proposed grade, which would be a maximum of four feet above the current site grade. The Design Review Board has recommended that, for the purposes of measuring building height, the proposed grade be considered “existing” grade, as allowed by Section 21.04.065(a)(2) of the Zoning Ordinance. Although located in a commercial subarea, the project includes a residential apartment. The Village Area Redevelopment Plan allows the Housing and Redevelopment Commission to approve residential development in commercial subareas, provided it is not on the ground floor and does not adversely affect the surroundings. Since the existing apartment in the Alt Karlsbad building has functioned without incident, staff and the Design Review Board recommended approval of the proposed apartment. The Design Review Board found that the Major Redevelopment Permit and Coastal Development Permit are consistent with the various elements of the General Plan, the applicable portions of the Village Area Redevelopment Plan and Village Design Manual (constituting the Local Coastal Program), and the applicable provisions of the Carlsbad Municipal Code. The project has been conditioned to adhere to the Uniform Swimming Pool, Hot Tub and Spa Code and receive all necessary permits from the San Diego County Health Department. The project was also found to have no significant adverse environmental impacts and, therefore, a Negative Declaration was issued by the Planning Director on July 6, 1994. The proposed development has been conditioned to improve its respective street frontage along Christiansen Way. This includes curb, gutter, sidewalk on each side and street paving for the full width of the local street. The applicants have stated that the costs of these improvements, combined with the money spent for opening the well and other publicly beneficial features, are too onerous. After considering the applicants’ testimony, the Design Review Board made a minute motion requesting that the Commission explore relief from some of these street improvements. Three conditions of Design Review Board Resolution No. 219 were changed at the February 1, 1995 hearing. Two of the altered conditions revised the expected water usage to 2.94 Equivalent Dwelling Units. The third altered condition deleted the requirement for undergrounding the overhead utilities. After further review, the Engineering Department \ c PAGE 2 OF AGENDA BILL NO. a? 3 determined that the existing utility poles did not conflict with the future street improvements and did not require removal. At the Design Review Board meeting, the applicant requested relief from the requirements to complete street improvements noted on the site plan and outlined in condition no. 57 of Design Review Board Resolution No. 219. The requirement is as follows: the applicant must construct Christiansen Way to meet the local street standard of 40 feet between curbs including paving, concrete curbs, gutters, sidewalks, and street lights from Carlsbad Boulevard to the project boundaries. This means that the applicant must complete the improvements on both the north and south side of Christiansen Way to the property boundaries. Because the parking for the proposed project will be located across the street (north side of Christiansen Way), staff believes that curbs, gutters, sidewalk and street light improvements should apply to both sides of Christiansen Way on both properties included within the project proposal. The applicant believes this condition is onerous and requested relief during the Design Review Board meeting. In response to the applicant’s request, staff indicated to the Design Review Board that the requirements were typical for all developments within the Village Redevelopment Area and were reasonable based on the proj.ect proposal. The estimated cost of these improvements is $25,930. The applicant stated that the design of the building for the Mineral Springs Spa results in high construction costs which means that the project is unable to support the cost of all of the required public improvements. Therefore, the applicant requested that the requirement for the improvements to the north side of Christiansen Way be removed from the project. The Design Review Board did not feel that they had the authority to recommend deletion of the requirements; the’ members felt that this was a decision that could only be made by the Commission with recommendations from staff. The Board recommended that the Commission consider the applicant’s request for relief from the street improvements. As stated previously, the required improvements are typical and necessary for a new development such as the one proposed within the Village Redevelopment Area. The Agency does not have funding available to complete all of the various public improvements required within the Redevelopment Area. Therefore, it is critical that private developers assume a portion of the responsibility for completing these improvements as they develop new projects. As each new project is built, developers are expected to finance and construct the improvements which have been deemed to be necessary and directly related to the proposed project. Staff recommends that the condition to complete the subject improvements remain on the Mineral Springs project and that the improvements be completed prior to issuance of a building permit. Although the applicants agree that the improvements are necessary, they do not believe that they can afford to pay for all of them. PAGE 3 OF AGENDA BILL NO. 2 3 3 The Housing and Redevelopment Department has received no documentation from the applicants which would indicate that they are unable to privately fund the necessary improvements or that the improvement requirements are financially burdensome to the project. Therefore, staff recommends that the Commission deny any request by the applicant for financial assistance for the project and/or relief from the required street improvements. FISCAL IMPACT This project, and the approval of the Negative Declaration as presented, will have no significant fiscal impact on the City or the Redevelopment Agency at this time. The project will result in some additional sales tax revenue for the City and tax increment for the Redevelopment Agency. The proposed mineral springs spa development is in accordance with the Carlsbad Village Area Redevelopment Plan and Village Design Manual because it increases the accommodation of residential uses in the convenient core area, provides non- ground floor residential development compatible with the surrounding area, and which does not adversely affect adequate internal residential order and amenity, provides a strong pedestrian orientation, adds to the variety of commercial, tourism, and recreational activity close to the beach, improves the visual aesthetics of the area, preserves the cultural quality of the downtown area, and provides appropriate building scale, landscaping, and parking. 3. The proposed mineral springs spa development is in accordance with the applicable provisions of the Carlsbad Municipal Code as demonstrated by the conformity with, or being conditioned to conform with, the requirements of Chapters 11.06, 18.17, 21.29 and 21.44 of the Carlsbad Municipal Code through the provision of parking, 1andscaping;street improvements, the proper building height, and permits to operate the spa. The site plan shall reflect the conditions of approval by the City. The plan copy shall be submitted to the Planning Director and approved prior to building permit approval. This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the District Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This project is also approved under the express condition that the applicant pay the public facilities fee adopted by the City Council on July 28, 1987 (amended July 2, 1991) and as amended from time to time, and any development fees established by the City Council pursuant to Chapter 21.90 of the Carlsbad Municipal Code or other ordinance adopted to implement a growth management system or facilities and improvement plan and to fulfil1 the subdivider’s agreement to pay the public facilities fee dated April 8, 1994, a copy of which is on file with the City Clerk and is incorporated by this reference. If the fees are not paid this application will not be consistent with the General Plan and approval for this project will be void. This project shall comply with all conditions and mitigation measures which may be required as part of the Zone 1 Local Facilities Management Plan and any amendments made to that Plan prior to the issuance of building permits. The applicant shall provide school fees to mitigate conditions of overcrowding as part of building permit application. These fees shall be based on the fee schedule in effect at the time of building permit application. If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 66020. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. Prior to the issuance of the certificate of occupancy, the applicant shall apply for and obtain a sign permit in accordance with the requirements of the Village Design Manual and/or the City sign ordinance. Prior to issuance of the building permit the applicant shall apply for and obtain a grading permit authorizing gradings substantially as shown on Exhibit “A”, dated February 1,1995, generally increasing the “existing grade” in such a manner that the resulting new “existing grade” will allow buildings to be constructed in accordance with Exhibit “E”, dated February 1, 1995, not in excess of 35 feet in height. Prior to issuance of a building permit, the applicant shall apply for and obtain all necessary approvals from the San Diego County Health Department. Failure to obtain these permits or subsequent revocation of the permits shall constitute cause for cessation and abatement of the mineral springs spa use by the Community Development Department. Prior to issuance of the certificate of occupancy, the applicant shall apply for and obtain all permits/approvals required to operate the Spa under Chapter 18.17 of the Carlsbad Municipal Code and the Uniform Swimming Pool, Hot Tub, and Spa Code. Prior to the issuance of any building permits, the applicant shall pay to the City an inclusionary housing impact fee as an individual fee on a per market-rate dwelling unit basis. Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance, the Village Design Manual, and all other applicable City ordinances in effect at time of building permit issuance. 14. Approval of RP 94-03 is subject to approval of CDP 94-04. All conditions of CDP 94-04, Design Review Board Resolution No. 220, dated February 1, 1995, on file in the Planning Department, are incorporated herein by reference. 15. This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval. 16. Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Planning Director and Housing and Redevelopment Director. Enclosure shall be of similar colors and/or materials to the project to the satisfaction of the Planning Director and Housing and Redevelopment Director. 17. All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, in substance as provided in Building Department Policy No. 80-6, to the satisfaction of the Directors of Planning and Building. 18. Compact parking spaces shall be located in large groups in locations to the satisfaction of the Planning Director and Housing and Redevelopment Director. 19. An exterior lighting plan including parking areas shall be submitted for Planning Director and Housing and Redevelopment Director approval. All lighting shall be designed to reflect downward and avoid any impacts on adjacent property. 20. No outdoor storage of material shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief, the Planning Director and the Housing and Redevelopment Director. 21. The applicant shall prepare a detailed landscape and irrigation plan which shall be submitted to and approved by the Planning Director prior to the approval of grading or building plans, whichever occurs first. 22. 23. All parking lot trees shall be a minimum of 15 gallons in size. All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. The developer shall install street trees at the equivalent of 40-foot intervals along all public street frontages in conformance with City of Carlsbad standards. The trees shall be of a variety selected from the approved Street Tree List. Preliminary landscape plans shall be submitted. All landscape plans shall be prepared to conform with the Landscape Manual and submitted per the landscape plan check procedures on file in the Planning Department. Landscape plans shall be designed to minimize water use. Lawn and other zone 1 plants (see Landscape Manual) shall be limited to areas of special visual importance or high use. Mulches shall be used and irrigation equipment and design shall promote water conservation. The developer shall avoid trees that have invasive root systems, produce excessive litter and/or are too large relative to the lot size. Planter width shall be a minimum of four (4) feet, not including curb, footings and/or other paving, and parking overhang. Prior to final occupancy, a letter from a California licensed landscape architect shall be submitted to the Planning Director certifying that all landscaping has been installed as shown on the approved landscape plans. All herbicides shall be applied by applicators licensed by the State of California. The applicant shall pay a landscape plan check and inspection fee as required by Section 20.08.050 of the Carlsbad Municipal Code. The first set of landscape and irrigation plans submitted shall include building plans, improvement plans and grading plans. All landscape and irrigation plans shall show existing and proposed contours and shall match the grading plans in terms of scale and location of improvements. All parking lot trees shall be canopy trees. Mature trees which are removed shall be replaced one to one with minimum 36” box specimen. Each case shall be reviewed by the Planning Director. The minimum shrub size shall be 5 gallons. 30% of trees in commercial projects shall be 24” box or greater. Trees shall be dispersed throughout the parking lot at a ratio of 1 tree per three parking stalls. Any signs proposed for this development shall at a minimum be designed in conformance with the City’s Sign Ordinance and/or the Village Design Manual and shall require review and approval of the Planning Director prior to installation of such signs. Building identification and/or addresses shall be placed on all new and existing buildings so as to be plainly visible from the street or access road; color of identification and/or addresses shall contrast to their background color. 42. Approval for RP 94-03 is granted subject to the condition that, prior to issuance of any building permit for the project, a deed restriction be placed on the parking lot parcels, Assessor’s Parcel Numbers 203-172-14 and 203-172-15, requiring the maintenance of the properties as a parking lot of at least 22 spaces for the mineral springs spa buildings. No alteration to the site that would reduce the quantity or quality of parking spaces can occur unless alternate parking is developed on the site or within 300 feet, as required by Section 21.44.020(c) of the Carlsbad Municipal Code through an amendment to this Redevelopment Permit. Ail improvements within this project shall be constructed with the latest requirements of the Standard Design Criteria for the Design of Public Works Improvements in the Citv of Carlsbad. The applicant shall comply with all rules, regulations and design requirements of the respective sewer and water agencies regarding services to the project. The applicant shall be responsible for coordination with S.D.G.& E., Pacific Bell Telephone and Cable TV authorities. Prior to grading or building permit issuance, the applicant shall pay all current fees and deposits required. Prior to issuance of a building permit the applicant shall pay a Planned Local Drainage Area (PLDA) fee for high runoff on the southerly parcel (APN: 203-173- 01), plus the area of half street width along Christiansen Way. Prior to issuance of a building permit, the applicant shall pay a Sewer Capacity Fee for the additional 2.94 Equivalent Dwelling Unit’s of sewerage the project will generate. Prior to issuance of a building permit, the applicant shall pay a Water Connection Fee for the additional water usage based on the 2.94 Equivalent Dwelling Units. Prior to issuance of a building permit, the applicant shall pay a Traflic Impact Fee for the additional 80 Average Daily Trips generated by the project. Prior to issuance of a building permit, the applicant shall either obtain an encroachment permit for the existing Alt Karlsbad building encroaching into the Christiansen Way right-of-way or a street vacation for the excess Christiansen Way right-of-way , as shown on Exhibit “A”, dated February 1, 1995. Pretreatment of the sanitary sewer discharge from this project may be required. In addition to the requirements for a sewer connection permit the applicant shall conform to the requirements of Chapter 13.16 of the Carlsbad Municipal Code. The applicant shall apply for as industrial waste discharge permit concurrently with the building permit for this project. Prior to hauling dirt or construction materials to or from any proposed construction site within this project, the applicant shall submit to and receive approval from the City Engineer for the proposed haul route. The applicant shall comply with all conditions and requirements the City Engineer may impose with regards to the hauling operations. The developer shall exercise special care during the construction phase of this project to prevent offsite siltation. Planting and erosion control shall be provided in accordance with the Carlsbad Municipal Code and the City Engineer. Reference Chapter 11.06. Additional drainage easements may be required. Drainage structures shall be provided or installed prior to or concurrent with any grading or building permit as may be required by the City Engineer. Plans, specification and supporting documents for all public improvements shall be prepared to the satisfaction of the City Engineer. Prior to issuance of a building permit in accordance with City Standards, the applicant shall install, or agree to install and secure with appropriate security as provided by law, improvements shown on the site plan and more completely described as follows: A Christiansen Way shall be constructed to a local street standard of 40 feet between curbs including paving, concrete curbs, gutters, sidewalks, and street lights from Carlsbad Boulevard to the project boundaries. Sufftcient transition sections shall be constructed offsite as needed. The above improvements shall be constructed prior to occupancy for the additional uses including operations of the mineral spa. Every effort shall be made to save the large eucalyptus tree at the north east corner of Carlsbad Boulevard and Christiansen Way. The City Engineer may approve modifications to the public improvements of curb, gutter and sidewalk in accordance with the Street Width and Improvements Standards variance procedure, in order to help save the tree. II. PROJECT DESCRIPTION AND BACKGROUND The applicants, Kay Christiansen and Ludvik Grigoras, are requesting permits to allow the construction and occupation of a mineral springs spa, office, and apartment on Carlsbad Boulevard, directly south of the existing Alt Karlsbad building. The proposal also includes the development of an off site parking area, located across Christiansen Way, to serve the development. The project area is designated V (Village) in the General Plan, zoned V-R (Village Redevelopment) and lies within Sub area 5 of the Village area. The land uses allowed within Sub area 5 center around tourist-serving commercial uses. The site planned for the new buildings is currently vacant, with little vegetation except for small trees. Adjacent to the building site on the south side is a parking lot for the Koko Beach restaurant and the property to the east is undeveloped. The site proposed for the parking lot, on the northeast comer of Carlsbad Boulevard and Christiansen Way, currently contains three buildings. One of the buildings is occupied by a bicycle shop which is planned to remain after the mineral springs spa development. The other two buildings, one of which is a hair and nail salon and the other a storage shed, are proposed to be removed for the parking lot development. The existing curb cut on the RP 94-03/CDP 94-04 CARLSBAD MINERAL SPRINGS SPA FEBRUARY 1,199s PAGE 2 Carlsbad Boulevard frontage is proposed to be removed and replaced with a split face solid wall and landscaping. The areas adjacent to the proposed parking lot are undeveloped and the perimeter of the lot would be landscaped. The architecture of the proposed buildings would continue the European village theme established by the Alt Karlsbad building, modeled after the composer’s Antonin Dvorak’s home near Karlsbad, Bohemia. The building closest to Carlsbad Boulevard is proposed as a two-story rendering of the Old Curiosity Shoppe in England. The rear building is proposed as a three-story depiction of the Boutique Du Pont Audemer (Draper’s House) in France. As shown on Exhibit “E”, dated February 1,1995, the buildings would be covered with a combination of stucco, wood trim and brick, and topped by flat tile roo&. The mineral springs spa building is proposed to consist of 16 individual rooms, each with a spa and seating area. The mineral water would be pumped from the two existing Carlsbad mineral springs, located below the property. The office would most likely be occupied by a physical therapist or other health professional and the apartment is slated for occupation by one of the applicants. The mineral springs have played a very important part in Carlsbad’s history. First excavated by John Frazier in 1883 while looking for subterranean potable water, the mineral springs were found to contain the same qualities as the then world-famous European Spa No. 9, in Karlsbad, Bohemia. The similarity of the waters led to the adoption of the name Carlsbad for the community and this name has remained since that time. The proposed buildings are part of a larger development scheme originally conceived by B. M. “Chris” Christiansen and his wife, Kay, in the 1960’s. Their goal was to establish a European village which celebrates the ties between Carlsbad and Karlsbad (now known as Karlovy Vary and Carlsbad’s sister city since 1991). The current applicants, Ludvik Grigoras and Kay Christiansen, have resurrected the original development scheme, hence .fhe current development proposal. Considering the historic nature of the project site, and the registration of the actual mineral spring well as a State Historic Landmark, the development proposal was taken to the Historic Preservation Commission for comments. The Commission identified no conflicts between the proposed development and the existing historic landmark. III. ANALYSIS 1. Is the proposed mineral springs spa development consistent with the various elements of the General Plan? 2. Is the proposed mineral springs spa development in accordance with the Local Coastal Program (i.e. the Carlsbad Village Redevelopment Plan and the Village Design Manual)? General Plan Consistency There are several elements of the General Plan that apply to the proposed mineral springs spa development. The objectives of the Land Use Element mention the need for creating a distinctive sense of place and identity and a visual form for the community, rich in variety, reflecting cultural values of the residents. By incorporating European “village-like” architecture and reopening the mineral springs which gave Carlsbad its name, the proposed project helps to contribute to the visual variety of the downtown area and solidifies the City’s sense of place. This is also in keeping with the goals and objectives of the Open Space and Conservation Element, including the protection, preservation, recognition, and enhancement of Carlsbad’s existing heritage and the use of historic resources for the education, pleasure and welfare of the people of the City. One of the goals of the Housing Element is to encourage the increased integration of housing with non-residential development. By proposing a mixed use project, the development is in keeping with this goal. The Circulation Element calls for the provision of safe, adequate and attractively landscaped parking facilities. The proposed parking area meets all requirements with regard to circulation area and parking lot landscaping, therefore complying with this objective. One of the implementing policies of the Arts Element is to encourage private businesses to install works of art in their public places. The proposed development includes an oversize statue of John Frazier, founder of the well, in the front of the property near the gazebo, facing Carlsbad Boulevard. The statue was dedicated in December of 1994. Although technically not a feature of the project, the relationship with the statue and other aspects of the proposed Mineral Springs Spa development are consistent with the applicable goals and objectives.of the General Plan. Considering these features of the project, the proposed mineral springs spa development is consistent with the applicable goals and objectives of the General Plan. 2. Conformance with the Local Coastal ProPram The Local Coastal Program for the Village Redevelopment Area consists of the Village Area Redevelopment Plan and the Village Design Manual. Therefore, consistency with these two documents constitutes consistency with the Local Coastal Program. The objectives of the Village Area Redevelopment Plan state many desires that are consistent with the aspects of the Mineral Springs Spa. The Plan calls for the provision of a variety of commercial, tourism and recreational opportunities, especially close to the beach. The Plan also seeks a variety of spaces with unique and attractive shops with a strong pedestrian orientation. The proposed Mineral Springs Spa provides commercial and recreational opportunities in a unique and attractive building with a pedestrian courtyard, thereby meeting these objectives. RP 94-03/CDP 94-04 CARLSBAD MINERAL SPRINGS SPA FEBRUARY 1,199s PAGE 4 The mineral springs spa development proposes a residential apartment within the tourist- commercial sub-area. The Village Area Redevelopment Plan states that the Housing and Redevelopment Commission, upon request, may allow residential development in commercial sub-areas provided that the proposed residential development is compatible with the surrounding area and does not adversely affect adequate internal residential order and amenity, and is not located on the ground floor. Therefore, since the project site is located within a commercial sub-area, this provision applies, and must be complied with. The proposed residential unit is not proposed on the ground floor and will be compatible with the existing and proposed uses. There is already a residential unit on the top floor of the Alt Karlsbad building and no compatibility issues have arisen. The Village Design Manual contains many provisions applicable to the project, namely land use, building coverage and height, parking area landscaping, and signage. The types of land uses called for in Sub-area 5 include tourist related commercial uses. By celebrating the heritage of Carlsbad and reinstitutionalizing the historic sanitariums that originally brought many travelers to the City, the proposed Mineral Springs Spa fits this land use category. As required by the Manual, the open spaces within the project are devoted to landscaping and patios or courtyards and the total building coverage for the lot does not exceed the 80 percent maximum. The proposed building site and parking lot landscaping meets the criteria of the Manual by providing a minimum of 20 percent landscape coverage and including a permanent irrigation system. The proposed signage will be reviewed under a ministerial permit in accordance with the Village Design Manual and the City’s Sign Ordinance, required to satisfy those code requirements, and is not part of this request. The proposal has been conditioned to require this permit and is, therefore, in accordance with the Village Area Redevelopment Plan and the Village Design Manual. 3. Municinal Code Consistency The Village Design Manual states that all projects within the Village Redevelopment Zone must comply with all normal City development regulations, except as specifically addressed in the Manual. With regard to the location and amount of parking required, the Manual refers to the City-wide development regulations. Sections 21.44.020(a)(3) and 21.44.020(b)(17)(A) require a total of 23 parking spaces. Section 21.44.020(c) of the Carlsbad Municipal Code allows parking to be located on another property, provided that the distance between the parking spaces and the use served by such parking is not over 300 feet. The distance between the furthest parking space and proposed mineral springs spa building is approximately 220 feet, thereby meeting this requirement. The proposed mineral springs spa and the existing bicycle shop would be parked at the standard ratio for retail, that being one space per three hundred square feet of floor area. The proposed apartment would be allotted 2.0 spaces (1.5 resident spaces and 0.5 guest spaces), as would the existing apartment. One handicapped space would be provided adjacent to the existing Alt Karlsbad building to facilitate access for the physically challenged. To guarantee that the parking remains available, the project is conditioned to place a deed restriction on the 22 space parking lot site keeping it as a parking area unless another parking area is developed RP 94-03/CDP 94-04 CARLSBAD MINERAL, SPRINGS SPA FEBRUARY 1,1995 PAGE 5 adjacent to the project through an amendment to the Redevelopment Permit. With regard to building height, the proposed two story building measures 25 feet from the peak of the roof to existing grade. The three story building in the rear of the property measures 35 feet from the peak of the roof to the proposed existing grade, as defined by Section 21.04.065(2). The site gently slopes downward to the east, causing an elevation difference between Carlsbad Boulevard and the rear portion of the lot of up to four feet. As conditioned, this discretionary permit would set the proposed grade, which matches the Carlsbad Boulevard elevation and the existing elevation of the Koko Beach parking lot, as the existing grade for the purposes of measuring building height. Section 21.04.065(2) permits the existing grade to mean the grade after the property is developed in accordance with the grading plans which implement an approved discretionary permit. The resulting three story building, with up to four feet of fill below, would not exceed the existing height of the Alt Karlsbad building. Since the proposed project involves the use of spas, the development will be subject to Chapter 18.17 of the C.M.C. and, consequently, the Uniform Swimming Pool, Hot Tub, and Spa Code of 1991 (U.S.P.H.T.S.C.). The applicant must also obtain all necessary approvals from the San Diego County Health Department. According the U.S.P.H.T.S.C., the Administrative Authority, in this case the Community Development Director, has the authority to declare any spa found to be insanitary as a nuisance. Where a nuisance exists, the Administrative Authority shall require the nuisance to be abated. Therefore, if the County Health Department ever considers the proposed spas to be insanitary, the City has the authority to abate the mineral springs spa use. This authority is expounded in this approval through a condition in Design Review Board Resolution No. 219. These requirements are made a part of this approval through a condition in Design Review Board Resolution No. 219. Section 18.40.040 of the Carlsbad Municipal Code requires any person who wnstructs any building in the City to also construct all necessary public improvements along their street frontage(s). The frontages for the mineral spring spa site and the bicycle shop/parking lot site have been improved along Carlsbad Boulevard. The frontages along Christiansen Way, however, are not improved in accordance with City specifications. Therefore, the project has been conditioned to improve, or agree and secure to improve, Christiansen Way along the project frontages prior to the issuance of a building permit for the project. Currently, there is a small area of the existing Alt K&bad building that extends into the City right-of- way for Christiansen Way. In order to bring this part of the property into conformance, this project has been conditioned to either obtain an encroachment permit for that portion of the building or receive approval of a street vacation, to legalize its continued use. Considering that the project will improve its frontages along Christiansen Way, meets the standard parking requirements, is being conditioned to comply with the U.S.P.H.T.S.C. and obtain the adjustment of existing grade, the proposal is consistent with the applicable portions of the Carlsbad Municipal Code. . ENVIRONMENTAL REVIEW Since the project site is a gently sloping, mostly denuded, infill property in the downtown area, the Planning Director has determined that the proposed development could not have a significant effect on the environment. A Negative Declaration was therefore issued on July 6, 1994 and made available for public review. No comments were received on the environmental document. Adoption of Design Review Board Resolution No. 218, dated February 1,1995 will recommend approval of the Negative Declaration to the Housing and Redevelopment Commission. V. SUMMARY Since the proposed mineral springs spa development is consistent with the applicable portions of the General Plan, Municipal Code, Village Redevelopment Plan and Village Design Manual, staff is recommending approval of RP 94-03 and CDP 94-04. RP 94-03XDP 94-04 - CARLSBAD MINERAL SPRINGS SPA - Request for a Negative Declaration, Major Redevelopment Permit, and Coastal Development Permit to allow the construction and occupation of a 3,500 s.f. mineral springs spa, office, and residential apartment adjacent to the Alt Karlsbad building, on the southeast corner of Carlsbad Boulevard and Christiansen Way in Sub-area 5 of the Village Redevelopment Zone. Mike Grim, Assistant Planner, reviewed the background of the request and stated that the applicants, Kay Christiansen and Ludvik Grigoras, are requesting permits to allow the construction and occupation of a mineral springs spa, office, and apartment on Carlsbad Boulevard, directly south of the existing Alt Karlsbad building. The proposal also includes the development of an off site parking area, located across Christiansen Way, to serve the development. The site planned for the new buildings is currently vacant, with little vegetation. The site proposed for the parking lot currently contains three buildings, two of which are proposed to be removed for the parking lot development. The bicycle shop will remain. The curb cut adjacent to the bicycle shop on Carlsbad Boulevard is proposed to be removed and replaced with a split face solid wall and landscaping. The architecture of the proposed buildings would continue the European village theme established by the Alt Karlsbad building, modeled after the composer’s Antonin Dvorak’s home near Karlsbad, Bohemia. The -_ - CORRECTED DESIGN REVIEW BOARD February 1, 1994 PAGE 2 building closest to Carlsbad Boulevard is proposed as a two-story rendering of the Old Curiosity Shoppe in England. The rear building is proposed as a three-story depiction of the Boutique Du Pont Audemer (Draper’s House) in France. The buildings would be covered with a combination of stucco, wood trim and brick, and topped by flat tile roofs. The mineral springs spa building is proposed to consist of 16 individual rooms, each with a spa and seating area. The mineral water would be pumped from the two existing Carlsbad mineral springs, located below the property. The office would most likely be occupied by a physical therapist or other health professional and the apartment is slated for occupation by one of the applicants. The mineral springs have played a very important part in Carlsbad’s history. First excavated by John Frazier in 1883, the mineral springs were found to contain the same qualities as the then world-famous European Spa No. 9, in Karlsbad, Bohemia. The similarity of the waters led to the adoption of the name Carlsbad for the community and this name has remained since that time. The proposed buildings are part of a larger development scheme originally conceived by the Christiansen’s in the 1960s. Their goal was to establish a European village which celebrates the ties between Carlsbad and Karlsbad (now known as Karlovy Vary and Carlsbad’s sister city since 1991). The current applicants, Ludvik Grigoras and Kay Christiansen, have resurrected the original development scheme, hence the current development proposal. Considering the historic nature of the project site and the registration of the actual mineral spring well as a State Historic Landmark, the development proposal was taken to the Historic Preservation Commission for comments. The Commission identified no conflicts between the proposed development and the existing historic landmark. The proposed mineral springs spa development was reviewed by staff and found to be consistent with the applicable portions of the General Plan, Municipal Code, Village Redevelopment Plan and Village Design Manual. Staff recommends approval, with a correction to Conditions #48 and #49 which should correctly read 2.94 Equivalent Dwelling Units. Chairman Noble opened the public testimony and issued the invitation to speak. Ludvik Grigoras, 5010 Caspian Drive, Oceanside, applicant, addressed the Commission and stated that he has encountered a problem financing the public improvements being requested by the City. He was advised by the bank that the square footage cost is too high. They will be financing the project with an SBA loan and the bank is only willing to finance some items, i.e. repairing the sidewalk along Carl&ad Boulevard and removing the buildings on Christiansen Way. However, the street improvements and the costs to relocate the electrical are too prohibitive to be included in their loan. Alt Karlsbad is a historic building and many people in Carlsbad are supporting the project. However, unless the City can make some concessions on the public improvements being required, he is afraid the project may never be completed. Mr. Grigoras stated that he has made many inquiries and was told that the Design Review Board can recommend that certain improvements be waived. Don Christiansen, 3715 Longview Drive, Carlsbad, addressed the Commission and stated that this would be an excellent opportunity for the public sector to work together with the private sector for the benefit of the community. Kay Christiansen has been a good will ambassador for Carlsbad for many years. She maintained a historical museum of Carlsbad in the basement of her home for 30 years. In the 1980s she donated a parcel of land to the City for a future museum. He requested the Board to exercise their discretionary powers and recommend some forbearance for the street improvements along Christiansen Way. Jim Doyle, Chief Executive of the Lutheran Home and Carlsbad-by-the-Sea, 2855 Carlsbad Boulevard, Carlsbad, addressed the Commission and stated that he seconds everything that Don Christiansen said. He has been a business neighbor for 40 years and he is very much in favor of the proposed project. 32 /- /- CORRECTED DESIGN REVIEW BOARD February 1, 1994 PAGE 3 Dorothy Dudley Muth, 7328 San Bartolo, Carlsbad, addressed the Commission and stated that she has served on several boards and commissions in lnglewood before coming to Carlsbad. She thinks this project will be an outstanding addition to the City because it will bring tourist dollars here. She is very mucli in favor of the project and seconds everything that has been said. John Jones, 3044 State Street, Carlsbad, addressed the Commission and suggested that staff investigate the availability of ISTEA or CLG grant funds to assist with the public improvements. William R. Stromberg, 241 Holiday Way, Oceanside, addressed the Commission and stated that he is the grandson of Gerhart Schutte and he doesn’t want to see any more deterioration of Carlsbad’s history. He is very much in favor of the proposed project because of the historical aspect. Gary Nessim, 2987 Highland Drive, Carlsbad, addressed the Commission and stated that this project requires an unusually large amount of public improvements, too large for a private citizen to bear the total cost. It needs some public funds as well. This is a showcase corner for the City. It will benefit the City by bringing in tax dollars and tourist dollars. The Board has the discretion to move it forward. Amelia Irvine, 6759 Nepeta Way, Carlsbad, addressed the Commission and stated that she has served as President of the Carlsbad Historical Society Board of Directors for two years and is representing the Historical Society. If the project is allowed to be completed, the applicant is willing to build a museum for the Historical Society. The community will be the benefactor of the proposed project and the museum. There being no other persons desiring to address the Board on this topic, Chairman Noble declared the public testimony closed and opened the item for discussion among the members. Member Welshons inquired if the Board has the authority to waive any of the public improvements. Debbie Fountain, Senior Management Analyst, replied that it is within the pervue of the Board to recommend a waiver; however, staff must recommend all standards imposed by the ordinances, Member Marquei inquired about the total cost of the project. Mr. Grigoras replied that the building being constructed is only 3,950 s.f. and &lfhU the street improvement costs exceed $100,000. Member Vessey inquired if the City has money available for a‘purpose such as this. Chairman Noble replied that the ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~ City’s Underground Utilities Committee recommends priorities for undergrounding utilities. Member Vessey would like to see the Planning Department review the proposed project again and waive some of the requirements. Ms. Fountain stated that staff is very supportive of the proposed project. She reiterated that it was necessary for staff to apply the standards established by the various ordinances and that the recommended improvements are appropriate. Bob Wojcik, Principal Engineer, referred to Condition #57A which indicates that utilities should be undergrounded. At the request of the applicant, staff reviewed the existing placement of power poles and it will not be necessary to relocate them. Therefore, engineering staff is recommending that the last sentence of Condition #57A be stricken.
