RECOMMENDED ACTION: Adopt Resolution No. L,?? 3 authorizing the Housing and Redevelopment Commission of the City of Carlsbad to accept the agreement (attached) for legal services with the law firm of Goldfarb & Lipman. ITEM EXPLANATION: The law firm of Goldfarb & Lipman has extensive experience and the unique skills required to provide the legal services as outlined in their letter dated September 10, 1996. The services will be provided on an as needed basis FISCAL IMPACT: Services will be provided at the direction of and in coordination with the City Attorney’s office at rates between $85 and $190 per hour. The 1996-97 budget does not include funding for these services. Staff is recommending that the Housing and Redevelopment Commission authorize the transfer of $10,000 into the legal services account (001-820-1210-2474). EXHIBITS: 1. Resolution No. 283 2. That certain agreement for legal services with the law firm of Goldfarb & Lipman for the preparation and review of affordable housing agreements and related documents is hereby approved. 2. That the amount of $10,000 is hereby transferred from the General Fund Balance to the legal services account (001-820-1210-2474) to support the cost of these services. 3. Goldfarb & Lipman would be pleased to provide the services to the Redevelopment Agency as outlined in your letter, including the following: 1. Preparation and/or review of affordable housing agreements and related documents for the purposes of ensuring the proper development and monitoring of affordable housing projects throughout the City of Carlsbad; and/or 2. Preparation and/or review of other documents and agreements implementing various affordable housing programs and policies within the City of Carlsbad; and/or 3. General legal advice on issues relating to affordable housing. The services will be provided at your request, and in coordination with the services of the City Attorney's Office. Our fees for the above services will be billed on an hourly basis at the rates set forth in the attached schedule. I will be the primary attorney providing services to the Redevelopment Agency. We understand you wish to establish an initial budget of $10,000 for fiscal year 1996-97. Accordingly, this letter is intended to briefly explain our billing policies and procedures. We encourage you to discuss with us any questions you may have concerning these policies and procedures. To determine the value of our services, we ask each of our lawyers and legal assistants to maintain time records for each client and matter. The time records are reviewed monthly by the responsible billing attorney. Our present billing rates for services rendered are $180 to $205 per hour for partners, $150 to $160 per hour for associates, and $85 per hour for paralegals. Our hourly rates are adjusted from time-to-time (generally once a year) and may change during the course of our engagement. It is our policy to serve you with the most effective support systems available. Therefore, in addition to our fees for legal services, we also charge for telephone, messenger, reproduction, facsimile, and other costs and expenses incurred on your behalf. Our billing statements are due and payable upon receipt. Clients whose statements are not paid within 30 days of the statement date will be assessed a late charge on the unpaid balance at the rate of one-and-a-half percent per month.
