SERVICES IN CONNECTION WITH THE PREPARATION CITY ATTY AND REVIEW OF AFFORDABLE HOUSING DOCUMENTS CITY MGRa RECOMMENDED ACTION: Adopt Resolution No. 293 authorizing the Housing and Redevelopment Commission of the City of Carlsbad to accept the revised billing rates for legal services with the law firm of Goldfarb & Lipman. ITEM EXPLANATION: The law firm of Goldfarb and Lipman has been providing specialized legal services in connection with the preparation and review of affordable housing agreements and other related documents for the Housing and Redevelopment Commission of the City of Carlsbad since September 1996, at rates ranging between $85 and $190 per hour, depending on the expertise of the person providing the service. The firm has now provided the City Attorney with the attached schedule of revised rates, which is the first increase in three years. The new rates represent only a 5% increase overall and appear to be in keeping with inflationary costs. They range from between $90 and $215 per hour with $200 per hour being the most likely billing rate for the majority of services required. Staff requests authorization to continue to contract with Goldfarb and Lipman when their expertise is required. FISCAL IMPACT: Services will be provided at the direction of and in coordination with the City Attorney’s office at the revised listed on the attached schedule. The 1997-98 budget does not include funding for these services. Staff is recommending that the Housing and Redevelopment Commission authorize the transfer of $10,000 into the legal services account (001-1210-7410) from the General Fund to provide for this increased expense. That the amount of $10,000 is hereby transferred from the General Fund Reserve Balance to the City Attorney’s professional services account (11012107410) to support the increased cost of these services. Unfortunately, increasing costs make it necessary for us to raise our rates, effective February 1, 1998. Attached is a list of the new rates, by attorney. You will note that we have only increased our rates by approximately 5%. We have also included for your reference a copy of our Billing Policies and Procedures, which we sent to you when we first started working together.
