H/RED RECOMMENDED ACTION: CITY MGR.- ADOPT Housing and Redevelopment Commission Resolution No. 3 1’1 approvinq a revision to the participation requirements for the Vi//age Redevelopment Parking /n-Lieu Fee Program. ITEM EXPLANATION: On June 8, 1999, the Housing and Redevelopment Commission approved Resolution No. 309 authorizing implementation of the parking programs as set forth by staff in the Parking in the Car/&ad Vi//age Redevelopment Area Report. One of the issues raised during the public hearing on the various parking programs related to participation requirements for the Village Redevelopment Parking In-Lieu Fee Program. The Commission requested that staff complete a further review of the issue and then prepare a recommendation for action to address the issue. Issue Summarv For the purposes of determining participation in the Village Parking In-Lieu Fee Program, the Village has been divided into two parking zones - Zone 1 and Zone 2. A property/business owner is eligible to participate in the in-lieu fee program according to the parking zone in which a given property is located and its proximity to an existing or future public parking lot. The “parking zone” and the “proximity to a public parking lot” will determine the maximum participation permitted for a property/business owner. For example, in Zone 2, a property/business owner may be allowed to make an in-lieu fee payment for up to 50% of the on-site parking requirement if the property is located within 600 feet of an existing public parking facility. If the property is not located within 600 feet of a public parking facility, the property/business owner may be allowed to make an in-lieu fee payment for no more than 25% of the on-site parking requirement. The issue of proximity to a public parking lot was raised as an issue within the public hearing on June 8, 1999. A property owner (L. Meissner) who owns property within Zone 2 (on Jefferson Street) is located approximately 630 feet from an existing public parking lot. Based on the current participation requirements for the Village Parking /n-Lieu Fee Program, the owner would be eligible to make a payment for no more than 25% of the on-site parking requirement because no portion of the property is located within 600 feet of the public parking lot. In order to allow her new development project to proceed, the property owner will need to be eligible to pay a fee for up to 50% of her on-site parking requirement. Because the 600 feet maximum boundary line falls at the centerline of the street immediately adjacent to the subject property, the property owner requested that the Commission consider allowing her full participation (up to 50%) in the program. The Commission did not want to provide preferential treatment based on the circumstances of a single property owner. Therefore, it was requested that staff develop a revision to the participation requirements for the Vi//age Parking In-Lieu Fee Program which would allow participation by all properties which are immediately adjacent to a public street where the centerline of the street falls within the 600 foot radius of an existing (or pending) public parking facility. Attached as Exhibit 2 is a map which indicates the two parking zones for the Village Parking In-Lieu Fee Program. Please note that properties west of the railroad tracks are not eligible to participate in the program at this time. All properties within the Village Redevelopment Area, except those located west of the railroad tracks, would be eligible to participate at some level (25% to 100%) within the Parking In-Lieu Fee Program based on their zone location. The properties which are allowed maximum AB# 3/t Page 2 participation are those located within 600 feet of an existing public parking lot. Jack Henthorn and Associates prepared Exhibit 3 which provides an analysis of those properties which are located within 600 feet of an existing public parking lot, and those properties which are located adjacent to the centerline of a public street which falls within the 600 foot radius of an existing public parking lot. For information purposes the following is provided: l All properties (approximately 125 parcels) within Parking Zone 1, and located east of the railroad tracks, are within 600 feet of an existing public parking lot. These properties would be eligible for maximum participation in the in-lieu fee program for up to 100% of an on-site parking requirement. l A total of approximately 65 parcels of property are east of the railroad tracks, within Parking Zone 2, and within 600 feet of an existing public parking lot. These properties are eligible for maximum participation in the in-lieu fee program for up to 50% of an on-site parking requirement. l The map prepared by Jack Henthorn and Associates illustrates that there are a total of 14 additional parcels/properties (shown shaded) located in Parking Zone 2 which would be eligible for maximum participation (up to 50% of an on-site parking requirement) in the Village Parking In-Lieu Fee Program if a revision is made to the participation requirements to include properties adjacent to a public street where the centerline of the street falls within the 600 foot radius of an existing public parking lot. At the direction of the Housing and Redevelopment Commission, staff has reviewed the subject issue and determined that a revision could be made to the participation requirements for the village Parking /n-Lieu Fee Program to allow for some flexibility where the 600 foot radius boundary falls on the centerline of a public street immediately adjacent to a given property. Staff believes that this revision will have no adverse impact on the integrity of the program. Staffs proposed revision is outlined below. Staff Recommendation Staff is recommending that the Housing and Redevelopment Commission take action to adopt the attached resolution which will amend the participation requirements for the Vi//age Parking /n-Lieu Fee Program for those properties located within Parking Zone 2. Because the public parking lots are primarily located within the core downtown area, clarification on the 600 foot radius requirement for Parking Zone 1 is not necessary. All of the properties within Parking Zone 1 are clearly located within 600 feet of an existing public parking lot. With approval of the Commission, the participation limits shall be amended to read as follows (the addition to the existing requirement is underlined): “Within Zone #2 and east of the railroad tracks, developers/property owners may be allowed to make an in-lieu fee payment for up to fifty percent (50%) of the on-site parking requirement for the proposed new development, conversion and/or intensification of a desired use, if the property is located within 600 feet of an existing public parking facility or located immediatelv adiacent to a public street where the centerline of the street is within the 600 foot radius of an existino public parkino facilitv.” The remainder of the language as related to the participation requirements for the Vi//age Parking In- Lieu Fee Program shall remain the same as that originally set forth within the Vi//age Master P/an and Design Manual, and subsequently restated within the Parking in the Carlsbad Vi//age Redevelopment Area Report. AB# 3fr( Page 3 FISCAL IMPACT: The proposed amendment to the Village Parking In-Lieu Fee Program will result in a slight increase in the number of potential properties (by approximately 14 total) which could pay a fee for up to 50% of their on-site parking requirement for future development or an intensification of a desired use. At this time, however, staff does not have an estimate of the potential financial impact due to the uncertainty of future development in the impacted area. The current Village Parking In-Lieu Fee is $11,240 per required parking space to be provided off-site. Any revenue generated will be deposited into a fund to be used for maintenance or enhancement of existing public parking facilities and/or development of new public parking facilities in the future within the Village Redevelopment Area. WHEREAS, the Carlsbad Redevelopment Agency has studied various issues related to parking within the Village Redevelopment Area and set forth its findings and recommendations related to parking needs and demands within a report entitled “Parking in the Carlsbad ViZlage Redevelopment Area”; and, WHEREAS, the findings and recommendations set forth within the “Parking in the Carlsbad Village Redevelopment Area” Report were previously reviewed and approved by the Housing and Redevelopment Commission on June 8, 1999; and, WHEREAS, the Housing and Redevelopment Commission has subsequently considered a revision to the participation requirements for the Village Redevelopment Parking In-Lieu Fee Program to allow for participation by all properties which are immediately adjacent to a public street where the centerline of the street falls within the 600 foot radius of an existing (or pending) public parking facility. NOW, THEREFORIE, BE IT RESOLVED by the Housing and Redevelopment Commission of the City of Carlsbad as follows: 1. The above recitations are true and correct. 2. That the Housing and Redevelopment Commission hereby approves a revision to the participation requirements for the previously approved Village Redevelopment Parking In- Lieu Fee Program to allow participation by all properties which are immediately adjacent to a public street where the centerline of the street falls within the 600 foot radius of an existing (or pending) public parking facility and located within Parking Zone 2. l/l/ II// II// : ! 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 HRC Resolution No. 3. The Parking Zone #2 participation limits for the Village Parking In-Lieu Fee Program, as set forth within the Village Master Plan and Design Manual, shall be amended to read as follows: “Within Zone #2 and east of the railroad tracks, developers/property owners may be allowed to make an in-lieu fee payment for up to fifty percent (50%) of the on-site parking requirement for the proposed new development, conversion, and/or intensification of a desired use, if the property is located within 600 feet of an existing public parking facility or located immediately adjacent to a public street where the centerline of the street is within the 600 foot radius of an existing public parking facility.” 4. Except for the revision noted above, all previously approved participation requirements for the VilZage Parking In-Lieu Fee Program shall remain the same as that originally set forth within the Village Master Plan and Design Manual, and subsequently restated within the Parking in the Carlsbad Village Redevelopment Area Report.
