RECOMMENDED ACTION:
If the Housing and Redevelopment Commission concurs, its action is to adopt Resolution No.
3&E $ , denying without prejudice a major redevelopment permit (RP 99-03) for the Park
Laguna Apartments.
ITEM EXPLANATION:
On March 21,200O and April 18,2000, the Housing and Redevelopment Commission reviewed
and considered an application for a major redevelopment permit requested for Park Laguna
Apartments. At its meeting of April 18, 2000, the Commission denied the application without
prejudice. The resolution denying that application is attached for your review and approval. The
Commission should satisfy itself that the findings as shown in the resolution accurately reflect its
findings.
FISCAL IMPACT:
None.
ENVIRONMENTAL REVIEW:
No further environmental review is required on a project that has been denied. Future
environmental review will be required if a revised project is submitted for consideration.

RESOLUTION NO. 324 -
A RESOLUTION OF THE HOUSING AND REDEVELOPMENT
COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA DENYING
MAJOR REDEVELOPMENT PERMIT (RP 99-03) WITHOUT PREJUDICE ’
FOR A TEN UNIT APARTMENT PROJECT, INCLUDING SET BACK
VARIANCES, THE ESTABLISHMENT OF RH GENERAL PLAN DENSITY
DESIGNATION (15-23 DWELLING UNITS PER ACRE) AND A DENSITY
INCREASE TO EXCEED THE ESTABLISHED GROWTH MANAGEMENT
CONTROL POINT (19 DWELLING UNITS PER ACRE) ON PROPERTY
LOCATED AT 2530 STATE STREET.IN LAND USE DISTRICT 4 OF THE
VILLAGE REDEVELOPMENT MASTER PLAN

WHEREAS, on January 24, 2000, the City of Carlsbad Design Review
Board held a duly noticed public hearing to consider a Major Redevelopment Permit (RP
99-03) for construction of a new ten (10) unit apartment project on property located at
2530 State Street and adopted Design Review Board Resolution No, 272 recommending
to the Housing and Redevelopment Commission that Major Redevelopment Permit (RP
99-03) be approved; and
WHEREAS, the Housing and Redevelopment Commission of the City of
Carlsbad, held duly noticed public hearings on March 21,200O and April 18,200O to hear
and consider the recommendations of all persons interested in or opposed to this request;
and
WHEREAS, Housing and Redevelopment Commission of the City of
Carlsbad received the report and recommendation from its staff and the Design Review
Board and received public testimony; and
WHEREAS, after careful consideration of all issues and after careful
exercise of its discretion, balancing all of the competing factors in the Village Design
Manual, the Carlsbad General Plan and zoning ordinances, recognizing the special
character of this site and its special topographical and locational characteristics, and

considering the present character of development and redevelopment in the
neighborhood; and
WHEREAS, based on the evidence presented at the public hearings, the
application and reports and all other evidence relevant to this matter the Housing and
Redevelopment Commission of the City of Cartsbad, California, finds as follows:
1. That the above recitations are true and correct.
2. That the project, as presented on March 21,200O and April 18,2000, is
out of character with the existing development in the neighborhood and the proposed
redevelopment for the neighborhood.
3. The proposed project is too massive, too tall and overwhelming for this
special site, which is the entryway to the Village Area.
4. That because of its special location a proposed proj,ect for it should be a
pleasing focal point in the neighborhood in the future and that other alternative designs,
induding a reduction in the density and intensity of this land use, should be presented for
consideration or approval.
5. There is an inadequate justiication for density exceeding the growth
control point of 19 dwelling units per acre and, in order to exceed that growth
management control point, additional public facilities or additional architectural elements
should be included to make the project more compatible with the neighborhood and
aesthetically pleasing.
6. The pedestrian. spaces and circulation have not been designed in
relationship to the land use at this location in order to provide a pedestrian-oriented
building design, landscaping and hardscape.

7. The proposed project will have an adverse impact on open space within
the surrounding area and it should be developed to reduce the impacts on the reduction
of open space within the surrounding area.
8. Neighboring properties have existing or proposed set backs greater than
that which are proposed for the subject property.
9. Although variances to increase the set back distances may be
appropriate, they are insufficient to mitigate the public views of the project, the pedestrian
orientation of the project and the harmony and character of this special location which is
sensitive because of the existing and proposed redevelopment and its access to the
special entryway views into the Village and the views from the site across existing open
space, parks and lagoons.
IO. In light of the above, a reduced front yard set back is inappropriate
and inconsistent with the views expressed herein in that a reduced standard will have an
adverse impact on surrounding properties and will not meet the goals and objectives of
the Village Redevelopment Area and it will not result in an interesting and visually
appealing project which reinforces the village character of the area.
Therefore, the Housing and Redevelopment Commission denies the
proposed project without prejudice.
This action is final on the date this resolution is adopted by the Housing and
Redevelopment Commission. The provisions of Chapter 1.16 of the Carlsbad Municipal
Code, “Time Limits for Judicial Review” shall apply:

“NOTICE TO APPLICANT’
‘The time within which judicial review of this decision must be
sought is governed by Code of Civil Procedure, Section 1094.6, which has
been made applicable in the City of Carlsbad by Carlsbad Municipal Code
Chapter 1 .I 6. Any petition or other paper seeking judicial review must be filed
in the appropriate court not later than the ninetieth day following the date on
which this decision becomes final; however, if within ten days after the
decision becomes final a request for the record of the proceedings
accompanied by the required deposit in an amount sufficient to cover the
estimated cost of preparation of such record, the time within which such
petition may be filed in court is extended to not later than the thirtieth day
following the date on which the record is either personally delivered or mailed
to the party, or his attorney of record, if he has one. A written request for the
preparation of the record of the proceedings shall be filed with the City Clerk,
City of Carlsbad, 1200 Carlsbad Village Drive, Carlsbad, California 92008.”
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the
Housing and Redevelopment Commission of the City of Carlsbad on the 2nd day
of May 2000, by the following vote, to wit:
