H/RED Coastal Redevelopment Project RECOMMENDED ACTION: CITY MGR. ADOPT Housing and Redevelopment Commission Resolution No. 3w approving and authorizing transmittal of the Report to the City Council and adopting Owner Participation Rules for the South Carlsbad Coastal Redevelopment Project. ITEM EXPLANATION: During the past 11 to 12 months, the Housing and Redevelopment Commission (“Commission”) has been undertaking the necessary steps to prepare a Redevelopment Plan for the proposed South Carlsbad Coastal Redevelopment Project (“Plan”). Redevelopment of the proposed Project Area would enable the Commission to: l Facilitate interim improvements at the Encina Power Plant to reduce its environmental and economic impacts on the community; l Accommodate the economically viable redevelopment of the Encina Power Plant to a physically smaller, more operationally efficient facility; l Provide potential funding for the proposed realignment of Carlsbad Boulevard, yielding excess property that could facilitate public recreational facilities and improvements; and l Promote the redevelopment of underutilized properties in the Ponto area. Prior to the joint Commission/City Council public hearing and consideration of the Plan and adoption of its ordinance, the Commission will need to approve the following documents pertaining to the Plan: the Report to the Cify Council and the Owner Participation Rules. Report to City Council Requirements for adopting and implementing redevelopment projects are established in the California Community Redevelopment Law, Health and Safety Code Sections 33000 a. s. (“Law”). The law requires the Commission to transmit a Report to the City Council (“Report”) on the proposed Plan. The purpose of the Report is to provide in one document, all information, documentation, and evidence regarding the Project. It assists the City Council in its legally required findings and determinations for adopting the Plan. The Report has been prepared in accordance with Section 33352 of the Law. It consists of the following components: l The reasons for selection of the Project Area, including a description of proposed projects and programs, and how these projects and programs will improve or alleviate blight; I I Page 2 of AB# 3aI, l A description of the physical and economic conditions in the Project Area; l The five-year implementation plan; l An explanation why blight cannot be alleviated by the private sector or without tax increment financing; l The method of financing; l The method of relocation; l An analysis of the Preliminary Plan; l The report and recommendation of the Planning Commission; l The Planning Commission’s finding that the Plan conforms to the City’s General Plan; l The Environmental Impact Report; l An analysis of the base year report of the County Auditor-Controller; l The neighborhood impact report, and; l A summary of consultations with affected taxing agencies. As discussed in the Report, the proposed Plan is designed to enable the Commission to proactively engage in the redevelopment of Project Area properties. Completion of various community development, economic development, infrastructure, and housing programs under the Plan will result in alleviating physical and economic blighting conditions within the Project Area. The Report describes how tax increment financing, and other resources that may become available, will be an essential part of the Commission’s redevelopment program. The Report also contains the Planning Commission’s report, finding that the Plan conforms to the City’s General Plan, and recommending City Council adoption of the Plan. Owner Participation Rules The Law also requires that the Commission have rules to guide owner participation opportunities and extend reasonable preferences to persons engaged in business in the Project Area to reenter within the Project Area. The Rules Governing Participation by Property Owners and the Extension of Reasonable Preferences to Business Occupants (“Owner Participation Rules”) provides guidelines for the participation of property owners, business operators, and business tenants in the Project Area. In the event the Commission wishes to rehabilitate, redevelop, or develop a property in the Project Area or a property owner, business operator, or business tenant wishes to participate in the redevelopment process, the Owner Participation Rules outline the procedures to be followed. This will ensure that both the rights of the participant are preserved while the goals stated in the Plan are achieved. A \smptoccandrop.doc 2 - Page 3 of AEH 3 &b On February 15, 2000, the Commission authorized for circulation and comment the draft Owner Participation Rules. No comments were provided to the Commission; the proposed Owner Participation Rules to be considered for adoption are unchanged from those accepted and circulated by the Commission in February 2000. STAFF RECOMMENDATION: Staff recommends that the Commission approve the Report to Council and authorize its transmittal to the City Council for review and consideration prior to action to adopt the Plan. Staff also recommends that the Commission approve the Owner Participation Rules as submitted for review. Approval of the attached Commission Resolution will approve both the Report to Council and the Owner Participation Rules. FISCAL IMPACT: No fiscal impact at this time related to approval of the Report to Council and Owner Participation Rules. If the related Redevelopment Plan is ultimately approved and adopted, revenue will be generated that can be used to fund proposed redevelopment programs and projects for the area and provide additional financial resources to assist with the continued development of affordable housing programs throughout the City of Carlsbad. (“Law”); and WHEREAS, pursuant to Section 33345 of the Law, the Commission shall adopt and make available for public inspection, rules for owner participation in connection with a redevelopment plan; and WHEREAS, pursuant to Section 33345 of the Law, the Commission previously prepared and approved Draft Rules Governing Participation and Reentry Preferences for Property Owners, Operators of Businesses, and Business Tenants (“Owner Participation Rules”) by Resolution No. 32 1, dated February 15, 2000. The Commission made said Owner Participation Rules available for public inspection at the Office of the City Clerk, Carlsbad City Hall, 1200 Carlsbad Village Way, Carlsbad. NOW, THEREFORE, BE IT RESOLVED by the Housing and Redevelopment Commission of the City of Carlsbad as follows: 1. The proposed Project is scheduled to be heard at the City Council hearing on June 27th and as a property owner on Ponto Drive I have concerns about the Redevelopment Plan. In Section V (c) 1. Participation by owners , the Plan provides for participation in the redevelopment of property in the project area by owners as long as it is in conformity with the Plan. But, the Plan refers to a Master or Specific Plan which has to be prepared and adopted to permit uses and to facilitate the redevelopment of the properties. The problem with the Plan is there is no time limit as to when the Master Plan for the Project or the Ponto Area will be completed and approved by'the Commission. The early plans are to re-align the Coast Highway and tear down the existing power plant building plus building a smaller building for you to put in smaller but more efficient power generating equipment. I am concerned about all of this for several of reasons. I LIKE the current building and think it would be perfect for painting or tiling huge murals of some sort --- possibly an ocean scene with whales, dolphins, and all sorts of sea creatures. I used to be an aircraft pilot and it was always comforting to see the power plant as an obvious landmark. There will be a growing need for electricity in the titut-e so why couldn’t the current generating equipment be replaced with more efficient new equipment that would produce more power. Another concern is the presence of the aqua-farm in the lagoon that grows delicious muscles, abalone, and other edible sea creatures and depends on the warm water coming from the power generating plant. 1 am interested in knowing what your plans may be regarding the above.
