HD. MTG. lo-a-o 1 iii%’ THE INTERFAITH HOUSING ASSISTANCE CORPORATION FOR MANAGEMENT AND CITY DEPT. H/RED MAINTENANCE SERVICES FOR THE TYLER COURT C,TYMGR APARTMENTS. I RECOMMENDED ACTION: That the Housing and Redevelopment Commission ADOPT Resolution No. wr- , AUTHORIZING the Executive Director to execute a Second Extension of the Management Agreement between the Carlsbad Redevelopment Agency and Interfaith Housing Assistance Corporation for the management and maintenance of the Tyler Court Apartments. ITEM EXPLANATION On September 30, 1999, the Carlsbad Redevelopment Agency (Agency) purchased the 75unit Tyler Court Senior Apartment Complex located at 3363 Tyler Street. The purchase of the property has resulted in providing permanent affordable housing for very low and extremely low income senior citizens in Carlsbad. Upon assuming ownership, the Housing and Redevelopment Commission authorized staff to enter into a Management Agreement with the Interfaith Housing Assistance Corporation (IHAC) for the day-to-day management and maintenance of Tyler Court. For the past two years, IHAC has fulfilled their contractual obligations, and staff is satisfied with their performance. Therefore, based upon a satisfactory review of IHAC’s past performance, staff is recommending that the Housing and Redevelopment Commission authorize an additional one-year extension of the agreement. I FISCAL IMPACT The costs associated with the day-to-day management and maintenance for the Tyler Court Senior Apartments is estimated to be approximately $249,000 for the fiscal year 2001-2002. Of the $249,000, $29,700 is the management fee for IHAC while the remaining $220,000 is for the operation and maintenance of the property. The funding for these expenses will be provided through rent revenues generated by the leasing of the 75 senior units on a monthly basis. Based on current projections, it is estimated that rent revenues generated by the project will be approximately $360,000 per year. Therefore, it is not anticipated that any additional City or Redevelopment Agency funding will be required for continued operations of the subject property. I EXHIBITS 1. WHEREAS, the City of Carlsbad has a significant need for affordable housing throughout the community as set forth in both its Housing Element of the General Plan and the City’s federally- required Consolidated Plan; and WHEREAS, on September 30, 1999, the Redevelopment Agency of the City of Carlsbad purchased the Tyler Court Senior Apartment Complex for the purpose of providing permanent affordable housing for very low and extremely low income senior citizens in Carlsbad; and WHEREAS, on September 30, 1999 the Redevelopment Agency of the City of Carlsbad executed a Management Agreement with Interfaith Housing Assistance Corporation for the management and maintenance of the Tyler Court Senior Apartments; and WHEREAS, on October 3, 2000 the Housing and Redevelopment Commission extended the Management Agreement with Interfaith Housing Assistance Corporation for the management and maintenance of the Tyler Court Senior Apartments. WHEREAS, the Housing and Redevelopment Commission seeks to extend the Management Agreement with Interfaith Housing Assistance Corporation for the management and maintenance of the Tyler Court Senior Apartments for an additional one year period. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Housing and Redevelopment Commission of the City of Carlsbad, California, as follows: 1. The above recitations are true and correct. 2. The Housing and Redevelopment Commission hereby authorizes the Agency Executive Director to extend the Management Agreement for one additional one (1) year period or parts thereof, based upon a review of satisfactory performance and the City’s needs and subject to the approval by the City Attorney. NO. 348 PAGE 2 3 AMENDMENT NO. 2 TO EXTEND THE AGREEMENT FOR EXCLUSIVE MANAGEMENT AGENT SERVICES OF THE DEVELOPMENT KNOWN AS THE TYLER COURT SENIOR APARTMENTS, CONSISTING OF 75 DWELLING UNITS AND LOCATED AT 3363 TYLER STREET, CARLSBAD, CA, BETWEEN THE CITY OF CARLSBAD REDEVELOPMENT AGENCY, A COMMUNITY REDEVELOPMENT AGENCY AND INTERFAITH HOUSING ASSISTANCE CORPORATION, A CALIFORNIA NONPROFIT PUBLIC BENEFIT CORPORATION This Amendment No. 2 is entered into and effective as of the 12th day of OCTOBER I 2OOL, extending the agreement dated September 28, 1999 (the “Agreement”) by and between the City of Carlsbad Redevelopment Agency, a Community Redevelopment Agency, a municipal corporation, (“Agency”), and Interfaith Housing Assistance Corporation, a California Nonprofit Public Benefit Corporation (“Agent”) (collectively, the “Parties”). RECITALS A. The Agreement, as may have been amended from time to time, is hereby extended for a period of one year ending on October 1,2002. 2. All other provisions of the Agreement, as may have been amended from time to time, shall remain in full force and effect. 3. All requisite insurance policies to be maintained by the Agent pursuant to the Agreement, as may have been amended from time to time, shall include coverage for this Amendment. NOW IT THEREFORE BE RESOLVED: The Board of Directors of Interfaith Housing Assistance Corporation hereby authorizes, Matthew B. Jumper, President, to negotiate, execute and implement a management agreement with the appropriate agency of the City of Carlsbad for the management of the Tyler Court Apartments. Be it further resolved that Matthew B. Jumper is authorized to negotiate, execute and implement all other necessary contractual agreements with the appropriate agency of the City of Carlsbad for the purpose of completing the Tyler Court Apartments management transaction.
