RECOMMENDED ACTION:
Adopt Housing and Redevelopment Commission Resolution No. 363 awarding a contract for
consultant services to RBF Consulting to develop a Land Use Strategy and Vision Statement for the Ponto
Area (Planning Area 3) of the South Carlsbad Coastal Redevelopment Project Area (SCCRA), and
appropriating $176,209 in SCCRA tax increment funds to fund the subject contract.
ITEM EXPLANATION:
As part of the Council goals for 2002-2003, a staff team has been directed to initiate the process to
develop a Land Use Strategy and Vision Statement for the Ponto Area (Planning Area 3) of the South
Carlsbad Coastal Redevelopment Project Area. The team consists of staff from Housing and
Redevelopment, Planning, Community Development and the City Attorney's Office with resource
assistance from the Engineering/Public Works Department.
Staff and the consultant will work to identify the various constraints and opportunities represented within
the subject portion of the South Carlsbad Coastal Redevelopment Area. An analysis of the constraints and
opportunities will then be used by staff and the consultant to complete a Land Use Visioning Process for
the area. The results of the visioning process will be presented in both a written, narrative report (Land
Use Strategy) and an illustrative vision poster. There will be various community workshops and/or
meetings to obtain feedback from the public on proposed plans for the area.
Background
On July 18, 2000, the City Council and Housing and Redevelopment Commission took the necessary
action to adopt' a redevelopment plan for the South Carlsbad Coastal Redevelopment Project Area.
Adoption of this plan established the boundaries for this redevelopment project area and legally created a
second redevelopment area within the City of Carlsbad. During the public hearings held to adopt the
redevelopment project area, there were many questions/concerns raised by residents and business
owners regarding the specific details of future land uses and potential projects for the area. City staff and
the City Council indicated that follow-up activities would include the development of a Land Use Strategy
and Vision Statement for the various planning areas. The proposed Strategy will set forth a vision and
more specific objectives/activities for the Ponto Area of the South Carlsbad Coastal Redevelopment Area
for implementation of the adopted Redevelopment Plan.
Consultant Selection
In response to a Request for Proposals (RFP) issued in November, 2002, the staff team received a total
of three (3) proposals from consultant firms interested in providing the required professional services to
the City of Carlsbad. The consultant firms submitting proposals were:

RBF Consulting $476,638
P&D Environmental $553,695
A staff team reviewed all of the consultant proposals and interviewed each of the firms. Each of the firms
were judged on the following criteria: 1) responsiveness to the RFP; 2) demonstrated understanding of the
project; 3) technical expertise/experience in providing the required services; 4) technical
expertise/experience in providing services within the coastal zone; 5) technical experience in integrating

environmental, coastal, engineering, and land use constraints into complex planning solutions; and 6)
proximity of contractor’s base of operations and experience in providing professional services in the City of
Carlsbad. Cost was considered but was not a determining factor as to which consultant was identified as
the best for providing the needed professional services for the subject project. Based on the proposal
reviews, interviews, and reference checks, the staff team is recommending that RBF Consulting be
awarded the contract for the subject professional consulting services. The staff team believes that RBF
Consulting has the qualifications and experience required to best meet the needs of the
City/Redevelopment Agency as related to the proposed development of a Land Use Strategy and Vision
Statement for the Ponto Area of the South Carlsbad Coastal Redevelopment Area.
After RBF Consulting had been identified as the best qualified consultant to provide the desired
professional services , the scope of work for the subject project was refined and the total project cost was
reduced from $476,638 to $176,209. All of the consultant proposals included the completion of an
Environmental Impact Report (EIR) for the subject project. However, staff made a determination that the
desired Land Use Strategy and Vision Statement does not require the completion of an EIR.
Consequently, the EIR and related studies were eliminated from the project scope of work. Although there
were a few other refinements to the scope of work, the elimination of the EIR was the primary reason for
the significant reduction in cost for the project. As each individual development project is processed within
the subject area, appropriate environmental review will be completed on a case-by-case basis.
Following elimination of the Master EIR as a project task, staff reconsidered each of the three (3)
proposals received for the subject project. Staff re-evaluated the consultant teams and the proposed
activities. Following this re-evaluation, staff made a determination that RBF Consulting remained staff’s
first choice as the appropriate professional consultant to complete the desired work. While each of the
consultant teams were qualified to complete the desired work, staff believes that RBF Consulting had the
best demonstrated land use planning skills and had the greatest amount of experience in preparing the
desired Land Use Strategy and Vision Statement. The professional services agreement with RBF
Consulting, with the final scope of work, is attached for review by the Housing and Redevelopment
Commission.
ENVIRONMENTAL REVIEW
A Program Environmental Impact Report (EIR) was prepared and certified for the establishment of the
South Carlsbad Coastal Redevelopment Project Area. The preparation of a Land Use Strategy and Vision
Statement for the Ponto Area of the Redevelopment Area is considered a subsequent activity and is not
required to go through separate environmental review pursuant to Section 15168 of the California
Environmental Quality Act (CEQA). All feasible mitigation measures and alternatives to reduce impacts
associated with the Redevelopment Project identified in the Program EIR will be addressed in the
preparation of the Land Use Strategy. Further, as was discussed in the Program EIR, actual development
projects proposed as a result of the Redevelopment Plan or Land Use Strategy will be subject to
subsequent, separate environmental review and documentation.
FISCAL IMPACT
Sufficient funds are available from current appropriations for this project. The City and the Carlsbad
Housing and Redevelopment Commission entered into a reimbursement agreement on August 7, 2001
whereby the City has agreed to provide financial assistance by loaning funds to the Agency until sufficient
tax increment revenue has been received to repay the City. It is anticipated that sufficient tax increment
revenue will be received during the current fiscal year to fund the current year operations and the contract
for the Land Use Strategy.

A RESOLUTION OF THE HOUSING AND REDEVELOPMENT COMMISSION
OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE
COMMISSION CHAIRMAN TO EXECUTE A PROFESSIONAL SERVICES
AGREEMENT WITH RBF CONSULTING FOR THE DEVELOPMENT OF A
LAND USE STRATEGY AND VISION STATEMENT FOR THE PONTO AREA
OF THE SOUTH CARLSBAD COASTAL REDEVELOPMENT PROJECT AREA,
AND ACCEPTING A LOAN FROM THE CITY OF CARLSBAD IN THE
AMOUNT OF $176,209 TO FUND THE SUBJECT AGREEMENT.
WHEREAS, the Carlsbad Redevelopment Agency has a need and a desire to develop and process
a Land Use Strategy and Vision Statement for the Ponto Area (Planning Area 3) of the South Carlsbad
Coastal Redevelopment Area to implement the approved Redevelopment Plan for the subject project area
which was established in July, 2000; and
WHEREAS, the Carlsbad Redevelopment Agency has determined that it requires the ,
professional services of a consultant with experience in developing the desired Land Use Strategy and
Vision Statement for the Ponto Area of the South Carlsbad Coastal Redevelopment Area; and
WHEREAS, the Carlsbad Redevelopment Agency has completed a request for proposals and
selection process to identify the consultant most qualified to develop the desired Land Use Strategy and
Vision Statement for the Ponto Area of the South Carlsbad Coastal Redevelopment Area; and
WHEREAS, the City of Carlsbad has appropriated funding for the subject contract for
professional services and has previously agreed, per a Cooperative Agreement approved on August 7,
2001, to loan funds to the Housing and Redevelopment Commission for operations and projects of the
Carlsbad Redevelopment Agency.
NOW, THEREFORE BE IT HEREBY RESOLVED as follows:
1. That the above recitations are true and correct.
2. That the Housing and Redevelopment Commission hereby authorizes the Commission
Chairman to execute a professional services agreement with RJ3F Consulting to provide the
required consultant services to develop the desired Land Use Strategy and Vision Statement
for the Ponto Area of the South Carlsbad Coastal Redevelopment Area, in substantially the
form presented in Exhibit 2 and as approved by the City Attorney, acting in hislher capacity
as Counsel to the Commission.

3. That on behalf of the Carlsbad Redevelopment Agency, the Housing and Redevelopment
Commission accepts a loan in the amount of $176,209 from the City of Carlsbad to fund the
subject professional services agreement. The loan shall constitute an indebtedness of the
Housing and Redevelopment Commission and shall be repaid at the time tax increment
funding becomes available. The loan shall be repaid with future tax increment fbnds
generated solely from the South Carlsbad Coastal Redevelopment Project Area and as set
forth within the Cooperation Agreement between the City of Carlsbad and Carlsbad
Redevelopment Agency dated August 7,2001.

AGREEMENT FOR PROFESSIONAL CONSULTANT SERVICES
(RBF Consulting)
THIS AGREEMENT is made and entered into as of the A uB day of
REDEVELOPMENT AGENCY, a body corporate .and politic, ("City"), and RBF
CONSULTING, a California Corporation, ("Contractor").
LIL , 2003, by and between the CITY OF CARLSBAD
RECITALS
A. City requires the professional services of a land planning and design
consultant contractor that is experienced in providing the necessary land use planning
and standards development and/or design services for preparation of a Land Use
Strategy and Vision Statement for Planning Area 3 ("Ponto Area") of the South
Carlsbad Coastal Redevelopment Area.
B. Contractor has the necessary experience in providing professional
services and advice related to preparation of the desired Land Use Strategy and Vision
Statement for the subject area.
C. Selection of Contractor is expected to achieve the desired results in an
expedited fashion.
D. Contractor has submitted a proposal to City and has affirmed its
willingness and ability to perform such work.
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained herein, City and Contractor agree as follows:
1. SCOPE OF WORK
City retains Contractor to perform, and Contractor agrees to render, those services (the
"Services") that are defined in attached Exhibit "A", which is incorporated by this
reference in accordance with this Agreement's terms and conditions.
2. STANDARD OF PERFORMANCE
While performing the Services, Contractor will exercise the reasonable professional
care and skill customarily exercised by reputable members of Contractor's profession
practicing in the Metropolitan Southern California Area, and will use reasonable
diligence and best judgment while exercising its professional skill and expertise.
TERM
The term of this Agreement will be effective for a period of two (2) years from the date 3. -
first above written. The City Manager may amend the Agreement to extend it for one (1)
additional one (1) year periods or parts thereof in an amount not to exceed fifty
thousand dollars ($50,000) per Agreement year. Extensions will be based upon a
satisfactory review of Contractor's performance, City needs, and appropriation of funds
by the City Council. The parties will prepare a written amendment indicating the
effective date and length of the extended Agreement.

4. TIME IS OF THE ESSENCE
Time is of the essence for each and every provision of this Agreement.
5. COMPENSATION
The total fee payable for the Services to be performed during the initial Agreement term
will be one hundred seventy six thousand two hundred nine dollars ($1 76,209). No other
compensation for the Services will be allowed except for items covered by subsequent
amendments to this Agreement. The City reserves the right to withhold a ten percent
(1 0%) retention until City has accepted the work and/or Services specified in Exhibit "A".
Incremental payments, if applicable, should be made as outlined in attached Exhibit "A".
6. STATUS OF CONTRACTOR
Contractor will perform the Services in Contractor's own way as an independent
contractor and in pursuit of Contractor's independent calling, and not as an employee of
City. Contractor will be under control of City only as to the result to be accomplished,
but will consult with City as necessary. The persons used by Contractor to provide
services under this Agreement will not be considered employees of City for any
purposes.
The payment made to Contractor pursuant to the Agreement will be the full and
complete compensation to which Contractor is entitled. City will not make any federal or
state tax withholdings on behalf of Contractor or its agents, employees or
subcontractors. City will not be required to pay any workers' compensation insurance or
unemployment contributions on behalf of Contractor or its employees or subcontractors.
Contractor agrees to indemnify City within thirty (30) days for any tax, retirement
contribution, social security, overtime payment, unemployment payment or workers'
compensation payment which City may be required to make on behalf of Contractor or
any agent, employee, or subcontractor of Contractor for work done under this
Agreement. At the City's election, City may deduct the indemnification amount from any
balance owing to Contractor.
7. SUBCONTRACTING
Contractor will not subcontract any portion of the Services without prior written approval
of City. If Contractor subcontracts any of the Services, Contractor will be fully
responsible to City for the acts and omissions of Contractor's subcontractor and of the
persons either directly or indirectly employed by the subcontractor, as Contractor is for
the acts and omissions of persons directly employed by Contractor. Nothing contained
in this Agreement will create any contractual relationship between any subcontractor of
Contractor and City. Contractor will be responsible for payment of subcontractors.
Contractor will bind every subcontractor and every subcontractor of a subcontractor by
the terms of this Agreement applicable to Contractor's work unless specifically noted to
the contrary in the subcontract and approved in writing by City.

8. OTHER CONTRACTORS
The City reserves the right to employ other Contractors in connection with the Services.
9. INDEMNIFICATION
Contractor agrees to indemnify and hold harmless the City and its officers, officials,
employees and volunteers from and against all claims, damages, losses and expenses
including attorneys fees arising out of the performance of the work described herein
caused in whole or in part by any willful misconduct or negligent act or omission of the
Contractor, any subcontractor, anyone directly or indirectly employed by any of them or
anyone for whose acts any of them may be liable.
The parties expressly agree that any payment, attorney's fee, costs or expense City
incurs or makes to or on behalf of an injured employee under the City's self-
administered workers' compensation is included as a loss, expense or cost for the
purposes of this section, and that this section will survive the expiration or early
termination of this Agreement.
10. INSURANCE
Contractor will obtain and maintain for the duration of the Agreement and any and all
amendments, insurance against claims for injuries to persons or damage to property
which may arise out of or in connection with performance of the services by Contractor
or Contractor's agents, representatives, employees or subcontractors. The insurance
will be obtained from an insurance carrier admitted and authorized to do business in the
State of California. The insurance carrier is required to have a current Best's Key Rating
of not less than "A-:VI'.
10.1 Coveraqes and Limits.
Contractor will maintain the types of coverages and minimum limits indicated below,
unless City Attorney or City Manager approves a lower amount. These minimum
amounts of coverage will not constitute any limitations or cap on Contractor's
indemn'ification obligations under this Agreement. City, its officers, agents and
employees make no representation that the limits of the insurance specified to be
carried by Contractor pursuant to this Agreement are adequate to protect Contractor. If
Contractor believes that any required insurance coverage is inadequate, Contractor will
obtain such additional insurance coverage, as Contractor deems adequate, at
Contractor's sole expense.
10.1.1 Commercial General Liabilitv Insurance. $1,000,000 combined
single-limit per occurrence for bodily injury, personal injury and property damage. If the
submitted policies contain aggregate limits, general aggregate limits will apply
separately to the work under this Agreement or the general aggregate will be twice the
required per occurrence limit.
10.1.2 Automobile Liability (if the use of an automobile is involved for
Contractor's work for City). $1,000,000 combined single-limit per accident for bodily
injury and property damage.

10.1.3 Workers' Compensation and Emplover's Liabilitv. Workers'
Compensation limits as required by the California Labor Code and Employer's Liability
limits of $1,000,000 per accident for bodily injury. Workers' Compensation and
Employer's Liability insurance will not be required if Contractor has no employees and
provides, to City's satisfaction, a declaration stating this.
10.1.4 Professional Liability. Errors and omissions liability appropriate to
Contractor's profession with limits of not less than $1,000,000 per claim. Coverage must
be maintained for a period of five years following the date of completion of the work.
10.2. Additional Provisions. Contractor will ensure that the policies of insurance
required under this Agreement contain, or are endorsed to contain, the following
provisions:
1 0.2.1 The City will be named as an additional insured on General
Liability.
10.2.2 Contractor will obtain occurrence coverage, excluding Professional
Liability, which will be written as claims-made coverage.
10.2.3 This insurance will be in force during the life of the Agreement and
any extensions of it and will not be canceled without thirty (30) days prior written notice
to City sent by certified mail pursuant to the Notice provisions of this Agreement.
10.3 Providina Certificates of Insurance and Endorsements. Prior to City's execution
of this Agreement, Contractor will furnish certificates of insurance and endorsements to
City.
10.4 Failure to Maintain Coveraae. If Contractor fails to maintain any of these
insurance coverages, then City will have the option to declare Contractor in breach, or
may purchase replacement insurance or pay the premiums that are due on existing
policies in order to maintain the required coverages. Contractor is responsible for any
payments made by City to obtain or maintain insurance and City may collect these
payments from Contractor or deduct the amount paid from any sums due Contractor
under this Agreement.
10.5 Submission of Insurance Policies. City reserves the right to require, at anytime,
complete and certified copies of any or all required insurance policies and
endorsements.
11. BUSINESS LICENSE
Contractor will obtain and maintain a City of Carlsbad Business License for the term of
the Agreement, as may be amended from time-to-time.

12. ACCOUNTING RECORDS
Contractor will maintain complete and accurate records with respect to costs incurred
under this Agreement. All records will be clearly identifiable. Contractor will allow a
representative of City during normal business hours to examine, audit, and make
transcripts or copies of records and any other documents created pursuant to this
Agreement. Contractor will allow inspection of all work, data, documents, proceedings,
and activities related to the Agreement for a period of three (3) years from the date of
final payment under this Agreement.
13. OWNERSHIP OF DOCUMENTS
All work product produced by Contractor or its agents, employees, and subcontractors
pursuant to this Agreement is the property of City. In the event this Agreement is
terminated, all work product produced by Contractor or its agents, employees and
subcontractors ,pursuant to this Agreement will be delivered at once to City. Contractor
will have the right to make one (1) copy of the work product for Contractor’s records.
14. COPYRIGHTS
Contractor agrees that all copyrights that arise from the services will be vested in City
and Contractor relinquishes all claims to the copyrights in favor of City.
15. NOTICES
The name of the persons who are authorized to give written notices or to receive written
notice on behalf of City and on behalf of Contractor under this Agreement.

Each party will notify the other immediately of any changes of address that would
require any notice or delivery to be directed to another address.
16. CONFLICT OF INTEREST
City will evaluate Contractor’s duties pursuant to this Agreement to determine whether
disclosure under the Political Reform Act and City’s Conflict of Interest Code is required
of Contractor or any of Contractor’s employees, agents, or subcontractors. Should it be

determined that disclosure is required, Contractor or Contractor’s affected employees,
agents, or subcontractors will complete and file with the City Clerk those sctiedules
specified by City and contained in the Statement of Economic Interests Form 700.
Contractor, for Contractor and on behalf of Contractor’s agents, employees,
subcontractors and consultants warrants that by execution of this Agreement, that they
have no interest, present or contemplated, in the projects affected by this Agreement.
Contractor further warrants that neither Contractor, nor Contractor’s agents, employees,
subcontractors and consultants have any ancillary real property, business interests or
income that will be affected by this Agreement or, alternatively, that Contractor will file
with the City an affidavit disclosing this interest.
17. GENERAL COMPLIANCE WITH LAWS
Contractor will keep fully informed of federal, state and local laws and ordinances and
regulations which in any manner affect those employed by Contractor, or in any way
affect the performance of the Services by Contractor. Contractor will at all times observe
and comply with these laws, ordinances, and regulations and will be responsible for the
compliance of Contractor’s services with all applicable laws, ordinances and regulations.
Contractor will be aware of the requirements of the Immigration Reform and Control Act
of 1986 and will comply with those requirements, including, but not limited to, verifying
the eligibility for employment of all agents, employees, subcontractors and consultants
that the services required by this Agreement.
18. DISCRIMINATION AND HARASSMENT PROHIBITED
Contractor will comply with all applicable local, state and federal laws and regulations
prohibiting discrimination and harassment.
19. DISPUTE RESOLUTION
If a dispute should arise regarding the performance of the Services the following
procedure will be used to resolve any questions of fact or interpretation not otherwise
settled by agreement between the parties. Representatives of Contractor or City will
reduce such questions, and their respective views, to writing. A copy of such
documented dispute will be forwarded to both parties involved along with recommended
methods of resolution, which would be of benefit to both parties. The representative
receiving the letter will reply to the letter along with a recommended method of
resolution within ten (10) business days. If the resolution thus obtained is unsatisfactory
to the aggrieved party, a letter outlining the disputes will be forwarded to the City
Manager. The City Manager will consider the facts and solutions recommended by each
party and may then opt to direct a solution to the problem. In such cases, the action of
the City Manager will be binding upon the parties involved, although nothing in this
procedure will prohibit the parties from seeking remedies available to them at law.

20, TERMINATION
In the event of the Contractor's failure to prosecute, deliver, or perform the Services,
City may terminate this Agreement for nonperformance by notifying Contractor by
certified mail of the termination. If City decides to abandon or indefinitely postpone the
work or services contemplated by this Agreement, City may terminate this Agreement
upon written notice to Contractor. Upon notification of termination, Contractor has five
(5) business days to deliver any documents owned by City and all work in progress to
City address contained in this Agreement. City will make a determination of fact based
upon the work product delivered to City and of the percentage of work that Contractor
has performed which is usable and of worth to City in having the Agreement completed.
Based upon that finding City will determine the final payment of the Agreement.
Either party upon tendering thirty (30) days written notice to the other party may
terminate this Agreement. In this event and upon request of City, Contractor will
assemble the work product and put it in order for proper filing and closing and deliver it
to City. Contractor will be paid for work performed to the termination date; however, the
total will not exceed the lump sum fee payable under this Agreement. City will make the
final determination as to the portions of tasks completed and the compensation to be
made.
21. COVENANTS AGAINST CONTINGENT FEES
Contractor warrants that Contractor has not employed or retained any company or
person, other than a bona fide employee working for Contractor, to solicit or secure this
Agreement, and that Contractor has not paid or agreed to pay any company or person,
other than a bona fide employee, any fee, commission, percentage, brokerage fee, gift,
or any other consideration contingent upon, or resulting from, the award or making of
this Agreement. For breach or violation of this warranty, City will have the right to annul
this Agreement without liability, or, in its discretion, to deduct from the Agreement price
or 'consideration, or otherwise recover, the full amount of the fee, commission,
,percentage, brokerage fees, gift, or contingent fee.
22. CLAIMS AND LAWSUITS
By signing this Agreement, Contractor agrees that any Agreement claim submitted to
City must be asserted as part of the Agreement process as set forth in this Agreement
and not in anticipation of litigation or in conjunction with litigation. Contractor
acknowledges that if a false claim is submitted to City, it may be considered fraud and
Contractor may be subject to criminal prosecution. Contractor acknowledges that
California Government Code sections 12650 et sea, the False Claims Act applies to
this Agreement and, provides for civil penalties where a person knowingly submits a
false claim to a public entity. These provisions include false claims made with deliberate
ignorance of the false information or in reckless disregard of the truth or falsity of
information. If City seeks to recover penalties pursuant to the False Claims Act, it is
entitled to recover its litigation costs, including attorney's fees. Contractor acknowledges

23. JURISDICTIONS AND VENUE
Any action at law or in equity brought by either of the parties for the purpose of
enforcing a right or rights provided for by this Agreement will be tried in a court of
competent jurisdiction in the County of San Diego, State of California, and the parties
waive all provisions of law providing for a change of venue in these proceedings to any
other county.
24. SUCCESSORS AND ASSIGNS
It is mutually understood and agreed that this Agreement will be binding upon City and
Contractor and their respective successors. Neither this Agreement or any part of it nor
any monies due or to become due under it may be assigned by Contractor without the
prior consent of City, which shall not be unreasonably withheld.
25. ENTIRE AGREEMENT
This Agreement, together with any other written document referred to or contemplated
by it, along with the purchase order for this Agreement and its provisions, embody the
entire Agreement and understanding between the parties relating to the subject matter
of it. In case of conflict, the terms of the Agreement supersede the purchase order.
Neither this Agreement nor any of its provisions may be amended, modified, waived or
discharged except in a writing signed by both parties.

PHASE I INITIAL RESEARCH AND PROJECT BASE MAPPING
TASK 1.0 Project Background and Research
Task 1.1 Tour of Ponto Area
The RBF Team will tour the entire project area and surrounding
community. RBF will pay particular note to unique features; land use;
streetscape and public space opportunities; pedestrian, bicycle, and
transit linkages, traffic calming opportunities and circulation alternatives;
and view corridors. Using digital camera technology, photographs will be
taken of key items for presentation and discussion at future workshops
and council meetings.
Task 1.2 Staff Kick-Off Meeting / Interview Summaries
The RBF Team will meet for up to one day with City Staff to discuss the
project and the results the City would like to see. Participants will include the
department heads and representatives from planning department, public
works, parks and recreation, and other departments as deemed appropriate,
among others.
A key component of this meeting will be to review and record the results
of interviews held to date between city staff and stakeholders, including
but not limited to: City Staff, Property owners, Neighborhood and
Homeowner Associations, State Park Staff , Coastal Commission Staff,
etc.
Task 1.3 Review and collect existing information and data
RBF staff shall conduct investigations and become familiar with existing
land use regulations including general plan, local coastal program and
zoning as well as all pertinent regulatory plans and documents affecting
development potential of the Specific Plan area.
Assumptions:
City Staff will assist in arranging access and retrieval of applicable
plans and studies
The RBF Team will review all available plans, documents, and studies
that affect the Ponto area, including the Keyser Marston marketing study
and the technical studies prepared by the RBF Team as part of this

TASK2.0 Project Base Map and Basic Infrastructure / Site
Constraints
RBF shall prepare an electronic base map for the Ponto Plan area and its
environs, within 100 feet of the project site. The base map will be scaled
at 1 inch = 100 feet, and will include the following information from readily
available record sources. The City will provide RBF with any available
. digital maps and electronic data prior to beginning Phase II in order that
sufficient project-specific maps and graphics can be generated for use in
workshop presentations.
To prepare the base map, RBF shall perform research and investigation
of existing record data at the City of Carlsbad and County of San Diego
as well as other public agencies as deemed appropriate.
This base map shall be utilized by all disciplines preparing studies for the
Ponto Area Plan. Constraints and opportunities information generated by
baseline and inventory studies shall be incorporated onto the base map
as appropriate, in addition to topography and existing overhead and
underground utilities.

PHASE II. TECHNICAL STUDIES
TASK 3.0 Underground Utility Relocation Study
RBF Team shall prepare a study analyzing the engineering feasibility
associated with relocating a portion of the underground utilities (electrical,
water, sewer, and dry utilities) existing in the area. The purpose of this
study would be to evaluate how a utility relocation affects the potential
realignment of Carlsbad Boulevard as a means of increasing the
development potential of reclaimed land. These utilities may need to be
relocated in order to facilitate potential development.

TASK 4.0 Carlsbad Boulevard Realignment Study
Preliminary layout of alternative realignments of Carlsbad Boulevard will
be prepared at a scale of 1 inch = 100 feet. Plans will show horizontal
alignment, vertical profile, grading, median configurations, proposed right-
of-way acquisitions and impacts to utilities, adjacent developments and
other existing offsite improvements for two alternative realignments.
The units of the analysis will be from Ponto Drive to Batiquitos Lagoon
Bridge. It will include recommendations on existing and proposed utilities
based upon the Underground Utility Relocation Study. The study will be
performed in accordance with.City of Carlsbad standards and will include
an assessment of:

is intended that portions of this task shall be conducted within Phase II as
part of developing the land use strategy. Traffic analysis for the selected
land use concept will be completed in Phase 111. The following scope of
work outlines our work plan.
Existina Conditions
RBF will document all existing roadway and intersection conditions within
the Ponto Study area. RBF will conduct a field review of the site,
collecting specific information, including:

Bus Routes
0 Any special traffic control measures that may effect traffic flow
RBF will request the intersection record drawings and traffic signal timing
sheets for all existing intersections.
RBF will research the City Growth Management Plan traffic count data to
determine if traffic count data is available within the study corridor. Peak
hour and daily traffic counts are collected by the City on an annual basis
through this program in August every year.
Study locations to be evaluated in the traffic study will be identified using
two criteria:
a. City LFMP requirements - All roadway segments and intersections
where 20% or more of the proiect generated trips are forecast to be
added to the existing or future condition will be evaluated.
b. SANDAG/SANTEC/ITE requirements - All roadway segments and
intersections where 50 or more proiect generated trips are forecast to
be added to the existing or future condition will be evaluated.
Proiect Impacts Analvsis
The traffic impact analysis report and level of service analysis will be
prepared in accordance with the SANTEC/ITE Guidelines for the Traffic
Impact Studies in the San Diego Region, dated March 2, 2000. The

following steps will be taken to determine the forecast project related
impacts:
Trip generation. After the project land uses are identified, RBF will review
the traffic model to ensure that the appropriate land uses are reflected in
the traffic analysis zone and that all connections to. the traffic analysis
zone from the roadway network are appropriately represented. RBF will
work with SANDAG to update the traffic model and conduct the
necessary traffic model analyses.
Trip Distribution. A select zone analysis run will be conducted using the
traffic model to determine the distribution of project trips on the roadway
network. Because of the size of the proposed project, manual distribution
of project trips is neither appropriate or recommended. The select zone
analysis run will be used to determine the percent distribution of trips from
the project site to surrounding communities. If the select zone analysis
shows that over 150 peak hour trips are added to Interstate 5, a freeway
analysis will be required.
Trip generation rates for the project site will be determined based on the
SANDAG “Not so Brief Guide”, dated April, 2002. RBF will work with City
staff to ensure that the appropriate’designations for the identified land use
are selected prior to inclusion in the traffic study. If the project is
determined to evolve in a series of phases, RBF will prepare a phased
analysis of the project. Phasing could be linked to land use, access
and/or realignment of Carlsbad Boulevard.
Level of Service Analvsis
Roadway and intersection level of service analysis will be calculated for
the following study scenarios:

0 Near-Term Conditions, including any identified phasing of the
proposed project
Future Conditions
Consistent with the County CMP and the City’s Growth Management
plan, intersections will be evaluated using both the Highway Capacity
Manual (HCM) and Intersection Capacity Utilization (ICU), where
appropriate. Only intersections and roadway segments along regionally
significant arterials (RSA’s) will be evaluated using the HCM
methodology.

Future traffic volumes will be modeled for the year 2030 using the
updated Carlsbad Sub-area model expected to be completed late 2002,
early 2003.
Siunificant Impact Identification
Based on the level of service analysis, potential project related significant
impacts will be identified. According to SANTECATE guidelines, a project
is said to significantly impact an intersection or roadway segment if:
1. The addition of the project generated trips results in a change from
acceptable to unacceptable, or
2. If the study location is currently deficient, then an increase in delay of
2.0 seconds or greater or a change in the volume to capacity ratio of
0.02 or more is considered significant.
Summarv and Conclusions
RBF will submit a draft of this report to the City for review prior to
submitting the final report. Our project team will meet with the City to
review their comments.
All comments within the context of the scope of work will be included in
the final draft. This report will include analysis of the study locations
consistent with both the City’s Growth Management Plan and the County
Congestion Management Plan.
Task 5.0 Deliverables:

TASK 6.0 Geology/Soils Investigation
The RBF Team’s Geotechnical consultant shall perform the following

The consultant shall review the available soils and geology related data
pertinent to the potential relocation of Carlsbad Boulevard and
identification of any significant constraint to the planned development of
the study area.
The Consultant shall provide a bluff retreat analysis along the west side of
Carlsbad Boulevard, as well as on the east side in the vicinity of the

Batiquitos Lagoon Bridge. The Consultant shall prepare an analysis of
groundwater conditions and shall recommend criteria for any required

Task 6.0 Deliverables

and bluff conditions.
Task 7.0 Biological Resource Inventory
Recon will prepare a Biological Resources Inventory and a Wetlands
Delineation Report. The purpose of these studies will be to provide basic
site constraints data that could have significant impact on the ultimate
development plan for the Ponto Area.
Existing Conditions/Constraints
Records Search. Recon will conduct a search of the records of the
California Natural Diversity Data Base (California Department of Fish and Game) and the -California Native Plant Society to determine what sensitive species have been reported from the vicinity of the project.
Biological Resources Survey. Recon will conduct a biological resources
survey of the 128-acre project area, including a botanical survey of the
property to search for sensitive plant species and a zoological survey to
search for sensitive animal species that are apparent at the time of the
survey.
Map On-Site Plant Communities. Following the biological resources survey, Recon will prepare a map showing natural plant communities, areas that could be under the jurisdiction of the U.S. Army Corps of Engineers and/or the California Department of Fish and Game as wetlands or waters of the U.S., the observed locations of sensitive
species, and habitat for sensitive species. Biologically sensitive areas
that could pose constraints to development will be outlined on the map.
Record On-Site Resources. Recon will record any inventoried biological
resources located during the survey and comply with the reporting
requirements of the Natural Diversity Data Base.
Constraints Report. Recon will prepare a constraints report that
describes biological resources occurring on the property, potential
constraints posed by those resources, possible impacts of the
development on the biological resources, and probable mitigation
measures.

ldentification of Additional Studies. Recon will identify additional studies
that may be required, such as directed searches for particular sensitive
species. These and any other special studies would only be conducted
with additional authorization from the client. The costs for these studies are not included in the fee submitted as part of this proposal.
Biological Summaw Report
Following completion of the tasks above, Recon will prepare a biological
summary report that describes biological resources occurring on the property, assesses the impact of the proposed development on the biological resources, and discusses mitigation measures, if necessary.
Wetland Delineation
Recon will conduct a wetland delineation according to guidelines set forth by the 1987 U.S. Army Corps of Engineers (USACE), as currently required by the USACE and accepted by the California Department of Fish and Game. Next, Recon will analyze the results of the delineation to determine the extent of jurisdictional wetlands and waters of the U.S. on
the property. This task will be concluded with the preparation of a
wetland delineation report that illustrates and discusses the condition of
the jurisdictional areas. If appropriate, impacts and mitigation measures
will be discussed in the report.

Scope of Work
CounciVPlanning Commission during the workshops or special sessions
noted in Task 11 .O.
Task 11 Deliverables:
0 Written summary of input received during workshops or special
sessions with property owners, community , and city council/
planning commission
Task 12.0 Memorandum of Final Ponto Report and Vision Poster
Changes
Upon conclusion of the property owner workshop, community workshop,
and special session with the City Council and Planning Commission, ,
RBF will prepare and submit to the City a memorandum that identifies all ’
changes which the City may wish to make to the Report and Vision
Poster. RBF will meet with staff to discuss any desirable revisions,
following review of the subject memorandum. This discussion with staff
on the memorandum will provide the guidance for completion of all final
deliverables by RBF
Task 13.0 Final Report and Vision Poster
RBF will incorporate all desired changes as directed by the City. The
final Report and Vision Poster will be presented by City Staff to the
Planning Commission and City Council for adoption. RBF will assist staff
in this final presentation to the Planning Commission and City Council
and/or other appropriate legislative body.
Task 13.0 Deliverables: . Attendance at one (1) Planning Commission hearing . Attendance at one (1 ) City Council hearing . One final (1) full color and one (1) electronic version of Ponto
Vision Plan, including final version of narrative report and poster . Copy-ready Master of the Ponto Vision Plan and Vision Poster

RBF will provide the following products to the City of Carlsbad:
1. Five- (5) draft copies of each Technical Study.
2. PrinVCopy Ready Master of each product provided under this scope
3. Electronic Copy of each product provided under this scope (in a form
of work
compatible with City of Carlsbad computer systems)
REIMBURSABLES
Anticipated reimbursable items include the following: . Document printing and binding . Blue prints and computer plots . Photographic prints . Mileage ($.40/mile) to attend staff and outreach meetings
RBF has provided an estimated budget of reimbursable items..
UNDERSTANDINGS / ASSUMPTIONS / EXCEPTIONS
Consultant shall note any special understandings, clarifications,
assumptions or exceptions to this scope of work.
