ADMI N RECOMMENDED ACTION: Adopt Resolution No. 658 declaring that a Stage II water alert of the Water Management Program of the Carlsbad Municipal Water District (Ordinance No. 30) be implemented and remain in force until further notice. ITEM EXPLANATION A series of adverse events for water supply in Southern California over the .past year have combined to dramatically reduce the potential water supplies for the San Diego region for 1990 and during the next few years. An unprecedented four dry years on the State Water Project and Colorado River Basin are limiting supplies available for all users of these systems. This will be the first year that Southern California will feel that direct effect of Arizona taking more if its share of the Colorado River supply, with MetropolitanIs Colorado River Aqueduct supply being reduced to about 950,000 AF this year versus the 1,200,OOO AF during past years. The City of Los Angeles has dramatically increased its demands upon Metropolitan's water in the past few years due to drought on the Owens Valley aqueduct system and losses of Mono Basin water due to court decisions. In San Diego County, local water supplies are at a ten-year low compounding the additional demands on imported water. This year Metropolitan's supplies are likely to be 100,000 to 200,000 AF short o-f total demands. The implications of a fifth- year drought demand strong action at this time to conserve water this year to maintain storage levels and to limit serious economic consequences should the drought continue and additional water supplies not materialize. If shortages beyond this year were to occur, the Water Authority and its member agencies would likely be in a particularly vulnerable position due to our significant involvement in interruptible agricultural and surface water storage programs. The Authority's involvement.in these programs amounts to about 30 percent of Metropolitan Water District's various interruptible supplies amounting to about 700,000 AF. Therefore, given the current water shortage and potential for serious shortages in the coming years, if events continue to turn out adversely, the County Water Authority is asking that member agencies achieve a 10% reduction in use over expected 1990 levels during the peak summer months. This is a measured response to the current shortages and is designed to reduce demands allowing more water to remain in storage to mitigate potential future supply shortages. The request for a 10% reduction was discussed at the San Diego County Water Authority's board meeting on Thursday, April 12th. It is expected that all the member agencies will be asking Agenda Bill No. @/? (continued) Page 2 their governing entities to adopt a similar call for a 10% drought response (Stage II Water Alert). Because of the heightened public awareness of the present four-year drought and a continuing educational and water awareness program county-wide, the County Water Authority and staff believe that a 10% reduction in present water usage can be accomplished through declaration of a Stage 2 Water Alert. This Stage 2 Water Alert is in accordance with the District's Emergency Water Management Program adopted on December 6, 1989 (a copy is attached). This ordinance follows: allows for the foilowing ‘stages to take effect as a. b. C. d. Stacre 1 - Water Watch Applies when possibility exists that the District will not be able to meet all of the demands. Accomplished through voluntary efforts. Staae 2 - Water Alert Applies when probability exists that the District will not be able to meet all of its water demands. Accomplished through mandatory water conservation measures. Staae 3 - Water Warninq Applies when District will not be able to meet all of the water demands. Accomplished through stricter mandatory water conservation measures. Staae 4 - Water Emersencv Applies when a major failure of any supply or distribution facility occurs in the State Water Project, Metropolitan Water District, San Diego County Water District or CarlsbadMunicipal Water District facilities. Accomplished through the most restrictive and severe mandatory water conservation measures. FISCAL IMPACT The Stage II Water Alert would require a public education process through the media. The District has $30,000 budgeted for a water awareness campaign and various educational programs. The recent staff addition of an Administrative Analyst will allow the District to proceed with these programs as budgeted. If a 10% reduction in water usage is realized, a corresponding reduction in District revenue could occur. The District's portion of the per unit water charge used to offset District expenses is approximately 25 cents out of its $1.01 per unit charge. If a reduction of 10% water usage is realized, a possible 2.5% shortfall _- Agenda Bill No. o/q (continued) Page 3 could occur. However, the District's annual budgetary process assumes minimal increases in water sales. RAUTENKRANZ, Sec#etary (SEAL) ORDINANCE NO. 30 AN ORDINANCE OF THE CARLSBAD MUNICIPAL WATER DISTRICT FINDING THE NECESSITY FOR AND ADOPTING AN EMERGENCY WATER MANAGEMENT PROGRAM TO REPLACE ORDINANCE NO. 28 BE IT ORDAINED by the Board of Directors of the Carlsbad Municipal Water District as follows: SECTION 1. Declaration of POliCV. California Water Code Sections 375 et seq. permit public entities which supply water at retail to adopt and enforce a water conservation program to reduce the quantity of water used by the people therein for the purpose of conserving the water supplies of such public entity. The Board hereby establishes a comprehensive water conservation program pursuant to California Water Code Sections 375 et seq., based upon the need to conserve water supplies and to avoid or minimize the effects of any future shortage. SECTION 2. Findinss. The Board finds and determines that a water shortage could exist based upon the occurence of one or more of the following conditions: (A) A general water supply shortage due to increased demand or limited supplies. (B) Distribution or storage facilities of San Diego County Water Authority or other agencies become inadequate. (C) A major failure of the supply, storage and distribution facilities of the Metropolitan Water District of Southern California, the San Diego County Water Author- ity , or of the Carlsbad Municipal Water District occurs. The Board also finds and determines that the conditions prevailing in the San Diego County area require that the water resources available be put to maximum beneficial use to the extent to which they are capable, and that the waste or unreasonable use, or unreasonable method of use, of water be prevented and that the conservation of such water be encouraged with a view to the maximum reasonable and beneficial use thereof in the interests of the people of the Carlsbad Municipal Water District and for the public welfare. SECTION 3. CEOA Exemntion. The Carlsbad Municipal Water District finds that this Ordinance and actions taken hereafter pursuant to this Ordinance are exempt from the California Envi- ronmental Quality Act as specific actions necessary to prevent or mitigate an emergency pursuant to Public Resources Code Section 21080(b)(4) and the California Environmental Quality Act Guide- lines Section 15269(c). The Manager of the District is hereby authorized and directed to file a Notice of Exemption as soon as possible following adoption of this Ordinance. . . . .’ SECTION 4. Application. The provisions of this Ordinance shall apply to all persons, customers, and property served by the Carlsbad Municipal Water District. SECTION 5. Authorization. The Carlsbad Municipal Water District's General Manager, or a designated representative, is hereby authorized and directed to implement the provisions of this ordinance. SECTION 6. Water Conservation Stases. No customer of the Carlsbad Municipal Water District shall knowingly make, cause, use, or permit the use of water supplied by the District for residential, commercial, industrial, agricultural, governmental, or any other purpose in a manner contrary to any provision of this Ordinance, in an amount in excess of the amounts authorized by this Ordinance, or during any period of time other than the periods of time specified in this Ordinance. At no time shall water be wasted or used unreasonably. The following stages shall take effect upon declaration as herein provided. (A) STAGE 1 - VOLUNTARY COMPLIANCE - WATER WATCH. STAGE 1 applies during periods when the possibility exists that the Carlsbad Municipal Water District will not be able to meet all of the demands of its customers. During STAGE 1, all elements of STAGE 2 shall apply on a voluntary basis only. (B) STAGE 2 - MANDATORY COMPLIANCE - WATER ALERT. STAGE 2 appiies during periods when the probability exists that the Carlsbad Municipal Water District will not be able to meet all of the water demands of its customers. During STAGE 2, the following water conservation mea- sures shall apply EXCEPT WHEN RECLAIMED WATER IS USED: 1. Lawn watering and landscape irrigation, including construction meter irrigation, is permitted only on designated irrigation days and only between the hours of 6:00 p.m. and 6:00 a.m. the following morning EXCEPT WHEN RECLAIMED WATER IS USED. Watering is permitted at any time if the hand-held hose equipped with a positive shut-off nozzle is used, a hand-held faucet-filled bucket of five (5) gallons or less is used, or a drip irrigation system is used. A "designated irriga-tion day" is determined by the last digit in the street address. Properties with addresses ending in an even number may use water on even numbered days and addresses ending in an odd number may use water on odd numbered days. 2. Agricultural users and commercial nurseries as de- fined in the Metropolitan Water District Code are exempt from Stage 2 irrigation restrictions, but will be required to curtail all nonessential water use. Washing of autos, trucks, trailers, boats, air- planes and other types of mobile equipment is prohibited except on designated irrigation days between the hours of 6:00 p.m. and 6:00 a.m. the following morning, EXCEPT WHEN RECLAIMED WATER IS USED. Such washing, when allowed, shall be done with a hand-held bucket, or a hand-held hose equipped with a positive shut-off nozzle for quick rinses. Washing is permitted at any time on the immediate premises of a commercial car wash. Further, such washings are exempted from these regulations where the health, safety and welfare of the public is contingent upon frequent vehicle cleaning such as garbage trucks and vehicles used to transport food and perishables. Filling or refilling swimming pools, spas, ponds, and artificial lakes is permitted only on designated irrigation days between the hours of 6:00 p.m. and 6:00 a.m. the following morning, UNLESS RECLAIMED WATER IS AVAILABLE AND ITS USE PERMITTED. Watering golf courses, parks, school grounds and recreational fields is permitted only between the hours of 6:00 p.m. and 6:00 a.m. the following morning, except golf course greens, UNLESS RECLAIMED WATER IS AVAILABLE AND ITS USE PERMITTED. The use of water from fire hydrants shall be limited to fire fighting and related activities, for construction activities, or other activities necessary to maintain the health, safety and welfare of the public. Water shall not be used to wash down sidewalks, driveways, parking areas, tennis courts, patios or other paved areas, except to alleviate immediate fire or sanitation hazards, UNLESS RECLAIMED WATER IS AVAILABLE AND ITS USE PERMITTED. Restaurants shall not serve water to their customers except when specifically requested. The operation of any ornamental fountain or Similar structure is prohibited UNLESS RECLAIMED WATER IS AVAILABLE AND ITS USE PERMITTED. (C) STAGE 3 - MANDATORY COMPLIANCE - WATER WARNING. STAGE 3 applies during periods when the Carlsbad Municipal Water District will not be able to meet all of the water demands of its customers. During STAGE 3, the fdlOWing _- -3- . New construction meters or permits for unmetered service will not be issued. Construction water shall not be used for earth work or road construction purposes, UNLESS RECLAIMED WATER IS AVAILABLE AND PERMITTED. STAGE 4 - MANDATORY COMPLIANCE - WATER EMERGENCY. STAGE 4 applies when a major failure of any supply or distri- bution facility, whether temporary or permanent, occurs in the water distribution system of the State Water Project, Metropolitan Water District, San Diego County Water Authority, or Carlsbad Municipal Water District facilities. During STAGE 4, the following water conservation measures shall apply EXCEPT WREN RECLAIMED WATER IS USED: 1. All outdoor irrigation of vegetation is prohibited, UNLESS RECLAIMED WATER IS AVAILABLE AND PERMITTED. 2. Use of water for agricultural or commercial nursery purposes, except for livestock watering, is prohibited, UNLESS RECLAIMED WATER IS AVAILABLE AND PERMITTED. 3. Washing of autos, trucks, trailers, boats, air- planes and other types of mobile equipment is prohibited, EXCEPT WHEN RECLAIMED WATER IS USED. Washing is permitted at any time upon the immediate premises of a commercial car wash. The use of water by all types of commercial car washes shall be reduced in volume by 50%. Further, such washings are exempted from these regulations where the health, safety and welfare of the public is contingent upon frequent vehicle cleaning such as garbage trucks and vehicles used to transport food and perishables. 4. Filling, refilling or adding of water to swimming pools, spas, ponds and artificial lakes is prohibited, UNLESS RECLAIMED WATER IS AVAILABLE AND PERMITTED. 5. Watering of parks, school grounds and recreation fields is prohibited (with the exception of plant materials classified to be rare, exceptionally valuable, or essential to the well being of rare animals), UNLESS RECLAIMED WATER IS AVAILABLE AND PERMITTED. The use of water from fire hydrants shall be limited to fire fighting or related activities necessary to maintain the health, safety and welfare of the public. Water shall not be used to wash down sidewalks, driveways, parking areas, tennis courts, patios or other paved areas, except to alleviate immediate fire or sanitation hazards, UNLESS RECLAIMED WATER IS AVAILABLE AND PERMITTED. The Carlsbad Municipal Water District shall monitor the projected supply and demand for water by its customers on a daily basis. The Manager shall determine the extent of the conservation required through the implementation and/or termination of particular conservation stages in order for the Carlsbad Municipal Water District to prudently plan for and supply water to its customers. Thereafter, the Manager may order that the appropriate stage of water conservation be implemented or terminated in accordance with the applicable provision of this Ordinance. The declaration of any stage beyond STAGE 1 shall be made by public announcement and notice shall be published a minimum of three (3) consecutive times in a newspaper of general circulation. The stage designated shall become effective -6- . r’. ’ ’ z .- * immediately upon announcement. The declaration of any stage beyond STAGE 1 shall be reported to the Board Of Directors at its next regular meeting. ratify the declaration, The Board of Directors shall thereupon rescind the declaration, or direct the declaration of a different stage. SECTION 8. Penaltv. As provided in Water Code Section 377, any violation of this Ordinance is a misdemeanor. Upon conviction thereof such person shall be punished by imprisonment in the county jail for not more than 30 days, or by fine not exceeding one thousand dollars ($l,OOO), or by both. In addition to any other remedies which the Carlsbad Municipal Water District may have for the enforcement of this Ordinance, service.of water shall be discontinued or appropriately limited to any customer who willfully uses water in violation of any provision hereof. SECTION 9. Effective Date and Publication. This Ordinance shall become effective as of the date of adoption and shall be published within ten days of adoption, pursuant to the California Water Code Section 376. In order to reduce demands throughout the region, the Board recommends that all member agencies declare a Stage 2, Water Alert. The Board further recommends that water conservation rate structures be adopted. These rates could take a variety of forms, such as, a long-term inclining block rate, an emergency inclining block rate or an emergency surcharge. Upon consultation with member agency managers, it is recommended that the Stage 2 Water Alert become effective on May 1, 1990 or as soon thereafter as possible. Sincerely, ester A. Real savings can best be addressed in long-term programs. I would suggest that the Board ask the Water Commission to consider, in addition to all current programs, the following and return with their recommendations: Water Rates. Increasing block pricing. Billing Format. Revise billing system to reflect gallons used, not "units". Audit of Users. Who are CMWD's customers? Knowing the customer base will allow the District to take aim at potential saving techniques. Audit of Governmental Users. City of Carlsbad, School District, Cal Trans. Leak Detection. Some municipalities have found large savings by searching for "lost" water. Revisions of Landscape Manual. Create mandatory savings (i.e. restrict ornamental turf areas in parkways). Low-Flush Toilets. Mandatory new construction installation and aggressive retro-fit program. Hookup Restrictions. Amend Ordinance No. 30 of the CMWD, Stage 3.
