AD”IN CUY Ad&/% Cll’Y MGRW RECOMMENDED ACTION: Adopt Ordinance No. 32 Amending the Emergency Water Management Program by Requiring the Use of Reclaimed Water for Greenbelt Purposes. ITEM EXPLANATION In December of 1989, the District adopted an Emergency Water Management Program (Ordinance 30). This document specifies restrictions which might be imposed throughout C.M.W.D.'s service area in periods of water shortage. This is accomplished through the creation of four stages of increasingly stringent water restrictions. The more severe the water shortage, the more severe the'restrictions. The declaration of a Stage II Water Alert under the District's Emergency Water Management Program is an item that appeared earlier on tonight's agenda. Ordinance 30 exempts the use of reclaimed water from all restrictions. However, the Ordinance does not prohibit the use of potable water for the irrigation of greenbelt areas where reclaimed water is available. This proposed revision will prohibit the use of potable water and will require the use of reclaimed water on all greenbelts including cemeteries, golf courses, parks, and highway landscaped areas when reclaimed water is available. A complete copy of Ordinance 30 is included in the previous bill regarding the declaration of a Stage II Water Alert. FISCAL IMPACT The requirement for the use of reclaimed water in greenbelt areas may require the City to install dual water systems on various types of projects, including golf courses which will add to the construction cost for these projects. The extent of the additional cost is not currently known, but it is expected to be major in at least some cases. EXHIBITS 1. Ordinance 32, Amending the Emergency Water Management Program. ORDINANCE NO. 32 AN ORDINANCE OF THE CARLSBAD MUNICIPAL WATER DISTRICT AMENDING EMERGENCY WATER MANAGEMENT PROGRAM BY REQUIRING USE OF RECLAIMED WATER FOR GREENBELT PURPOSES BE IT ORDAINED by the Board of Directors of the Carlsbad Municipal Water District (District) as follows: Section 1: Section 6. paragraph (B) sub-paragraph 9 and paragraph (C) sub-paragraph 9 shall be revised to read: The operation of any ornamental fountain or similar structure is prohibited unless it is a recycling type system or UNLESS RECLAIMED WATER IS AVAILABLE AND PERMITTED. Section 2: Section 6.1 is hereby added to Ordinance No. 30, establishing an Emergency Water Program, to read: SECTION 6.1 Use of Reclaimed Water for Greenbelt Purposes. No customer of the District shall make, cause, use or permit the use of water supplied by the District for greenbelt uses, including, but not limited to, cemeteries, golf courses, parks, and highway landscaped areas, when, following notice and a hearing, the District finds that reclaimed water is available under the following conditions: a) cl d) the reclaimed water is of adequate quality and is available for use; the reclaimed water may be furnished to such areas at a reasonable cost, comparable to or less than the cost of supplying potable domestic water; the State Department of Health Services has determined that such use would not be detrimental to public health; and the use of reclaimed water will not adversely affect downstream water rights, will not degrade water quality. Following such a determination, the District may assist the customer in obtaining any permits or approvals required for the use of reclaimed water. h -. . * r Section 3. Effective Date and Publication. This Ordinance shall become effective as of the date of adoption and shall be published within ten days of adoption, pursuant to California Water Code Section 376.
