QUITCLAIM OF AN OFFER OF DEDICATION FOR A
DEPT. ENG. WATERLINE EASEMENT OVER A PORTION OF LOT 1; CARLSBAD TRACT 80-33, CMWD 90-C-339
RECOMMENDED ACTION:
Adopt Resolution No. 681 guitclaiming an offer of dedication for a waterline easement over a portion of Lot 1, Carlsbad Tract 80-33, CMWD 90-C-339.
ITEM EXPLANATION
This item is a request by the owner of Lot 1, Carlsbad Tract 80-
33, to guitclaim an offer of dedication for a waterline easement no longer-required.
The Engineering staff has reviewed the request and concurs with the owners contention. The easement will no longer be necessary as -it contained a temporary waterline for phasing of a commercial park. The waterline has been removed, and the easement is no longer required.

A RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT APPROVING THE EXECUTION OF A DEED CONVEYING A WATERLINE EASEMENT TO THOMAS M. LINDEN ACROSS A PORTION OF LOT 1, CARLSBAD TRACT 80-33
WHEREAS, the Board of Directors of the Carlsbad
Municipal Water District has determined it to be in the
public interest to guitclaim said easement;
NOW, THEREFORE, BE IT RESOLVED by the Board of
Directors of the Carlsbad Municipal Water District, as
follows:
1. That the above recitations are true and correct.
2. That the Grant Deed conveying an easement for waterline
purposes to Thomas M. Linden, which is on file with the Secretary
of the Board of Directors and is incorporated by this reference;
3. That the President and the Secretary are authorized to
execute the deed which will be returned to Thomas B. Linden for
recordation.
PASSED, APPROVED AND ADOPTED at the regular meeting of
the Carlsbad Municipal Water District held on the 14th day
of August , 1990 by.the following vote, to wit:
AYES: Board Members Lewis, Kulchin, Larson, Mamaux and Pettine
