CARLSBAD RESEARCH CENTER UNIT 4 (37-f MGl3.w RECOMMENDEDACTION: Adopt Resolution No. 690 approving reimbursement to Carlsbad Research Center for the construction of increased size of the 14- inch water line to an 18-inch water line in Faraday Avenue, Carlsbad Research Center Unit 4, CMWD 85-205, according to Reimbursement Agreement between Carlsbad Research Center and the District dated August 20, 1986. ITEM EXPLANATION Carlsbad Research Center, developers of the subject project, have satisfactorily completed all of the construction and related proceedings for the project, and the 18-inch water line is now ready for acceptance, ownership and operation by the District. As a condition of approval of the Carlsbad Research Center Unit 4, the District and the Carlsbad Research Center entered into a Reimbursement Agreement with respect to the following: the developer agreed to construct the 18" line and the District agreed to reimburse the Developer for the difference in the cost of constructing the 18-inch water line versus constructing a 14- inch water line in the same location. According to the agreement, the Developer furnished the District with the estimated cost of constructing the 14-inch water line and the actual cost of constructing the 18-inch water line in Faraday Avenue. After review of the Developer's submittal, the District made the final determination, reasonably and in good faith, based on the information provided by the Developer, the actual cost of construction reimbursable in the amount of $16,945. The Carlsbad Research Center agrees with the District's determination and has requested reimbursement approval upon acceptance and approval of the dedication of the water system facilities constructed for Carlsbad Research Center Unit 4 by the Board of Directors. FISCAL IMPACT Requiring upsizing of the water line in Faraday Avenue, will save the District costs in the future upsizing of water lines. EXEIBITS 1. Location Map. . 2. LOCATION MAF , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 690 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT FOR APPROVAL OF THE REIMBURSEMENT TO CARLSBAD RESEARCH CENTER FOR THE DIFFERENCE IN CONSTRUCTION COSTS OF INSTALLATION OF AN 18-INCH WATER LINE AND A 14-INCH WATER LINE IN THE SAME LOCATION IN FARADAY AVENUE, CARLSBAD RESEARCH CENTER UNIT 4 WHEREAS, the Reimbursement Agreement entered into on August 20, 1986, between the District and the Carlsbad Research Center which includes reimbursing the Developer for the difference in the cost of constructing the 18-inch Faraday pipeline, valves and appurtenances versus constructing a 14" water line in the same location constructed in Carlsbad Research Center Unit 4, CMWD 85- 205 in accordance with the plans filed with CARLSBAD MUNICIPAL WATER DISTRICT is built for public use and that upon its acceptance of the Carlsbad Research Center Unit 4 by said District, reimbursement shall occur within 30 days of dedication and acceptance: and WHEREAS, the Board of Directors further certify that Carlsbad Research Center and Carlsbad Municipal Water District have agreed that the District made the final determination based on information provided by the Developer of the actual cost of construction reimbursable in the amount of $16,945.00, and all claims for labor, material, or any other construction costs have been cleared so that there are no encumbrances and the total cost of pipeline construction reimbursement amounted to $16,945.00; and the Developer has requested payment; and NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad Municipal Water District, as follows: 1. That the above recitations are true and correct. 1 2. That the reimbursement of the difference in construction 2 costs of an 18-inch water line versus a 14-inch water line in the 3 same location in Faraday Avenue, Carlsbad Research Center Unit 4, 4 amounting to a total cost of reimbursement of $16.945.00, is 5 deemed agreed upon and hereby accepted. 6 3. That the President is authorized to direct the 7 Accountant to issue payment to Carlsbad Research Center in the a amount of $16,495.00 for reimbursement to the Developer. 9 4. That the Accountant is, hereby authorized and directed lo to allow the project to be closed as all related services and 11 costs have been identified and secured. 12 PASSED, APPROVED, AND ADOPTED at a regular meeting of the 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 ~ Board of Directors held on 2nd day of October , 1990, by the following vote, to wit: .
