ACCEPTANCE OF AN OFFER AND ACCEPTANCE OF WATER SYSTEM FACILITIES FOR CMWD 84-202, AIRPORT BUSINESS CENTER UNIT 2, CT 81-46
RECOMMENDED ACTION:
Adopt Resolution No. 706 accepting construction of water system facilities to ATrport Business Center Unit 2, Carlsbad Tract 81-46, CMWD Project No. 84-202.
ITEM EXPLANATION
Carlsbad Airport Centre, a California limited partnership developers of the subject project, have satisfactorily completed all of the construction and related proceedings for the project, and the water system is now ready for acceptance, ownership and operation by the District. As a condition of development approval, the Carlsbad Airport Centre has offered water system facilities which includes pipelines, valves and appurtenances constructed in Airport Business Center Unit 2, Carlsbad Tract 81-
46, CMWD Project No. 84-202 for public use to the Carlsbad Municipal Water District, and upon its acceptance by the Board of Directors, all right, title and interest of the water system facilities constructed by the Carlsbad Airport Centre shall vest in the District.
FISCAL IMPACT
Requiring offer and acceptance of water system facilities will allow the District to operate and maintain the facility as part of the public system. The cost of the pipeline, $200,000.00, vested in the District will become a part of District Fixed Assets.

We hereby declare that the public water system which includes
, pipelines, valves, and appurtenances constructed in Airport
1 Business Center Unit 2, Carlsbad Tract 81-46, CMWD Project No. 84-
202 in accordance with the plans filed with the Carlsbad Municipal
Water District is built for public use and that upon its acceptance
by said District, all right, title and interest of the undersigned
in and to said facilities shall vest in said District.
We further certify that any and all claims for labor,
1 material, or any other construction costs have been cleared so that
~ there are no encumbrances. The total cost of pipeline construction
amounted to $ 200,000.00 .

RESOLUTION NO. 706
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT ACCEPTING THE CONSTRUCTION OF WATER SYSTEM FACILITIES TO AIRPORT BUSINESS CENTRE UNIT 2, CARLSBAD TRACT 81-46, CMWD PROJECT NO. 84-202
WHEREAS, the public water system which includes pipelines,
valves and appurtenances constructed in Airport Business Center
Unit 2, Carlsbad Tract 81-46, CMWD Project No. 84-202, in
accordance with the plans filed with CARLSBAD MUNICIPAL WATER
DISTRICT is built for public use and that upon its acceptance by
said District, all right, title and interest of the Carlsbad
Airport Centre in and to said facilities shall vest in said
District: and
WHEREAS, the Board of Directors further certify that any and
all claims for labor, material, or any other construction costs
have been cleared so that there are no encumbrances and the total
cost of pipeline construction amounted to $200,000.00; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of
the Carlsbad Municipal Water District, as follows:
1. That the above recitations are true and correct.
2. That the construction of the water system facilities to
Airport Business Centre Unit 2, Carlsbad Tract 81-26, CMWD
Project No. 84-202, with a total cost of pipeline construction
amounting to $200,000.00, is deemed complete and hereby accepted.
3. That the President is authorized to execute the Offer
and Acceptance of Water System Facilities documents which one
copy will be on file with the Carlsbad Municipal Water District
and one copy returned to Carlsbad.
4. That the Accountant is hereby authorized and directed
to allow the project to be closed as all related services and

costs have been identified and secured.
PASSED, APPROVED, AND ADOPTED at a regular meeting of the
Board of Directors held on 8th day of January , 1990,
by the following vote, to wit:
AYES: Board Members Lewis, Kulchin, Larson, Stanton and Nygaard
