HomeMy WebLinkAbout1991-01-29; Municipal Water District; 074; Acceptance of Maerkle Reservoir & PipingB# M4 IT& ~‘-2% 41 1 EPT.ADMIN MWD - AGENDA BILL TITLE: ACCEPTANCE OF TEN NILLION GALLON MAERKCE RESERVOIR AND PIPING APPURTENANCES aECOMMENDED ACTION: Adopt Resolution No. 709 accepting the construction of the 10 million gallon Maerkle Reservoir and piping appurtenances, authorization to file the Notice of Completion and to release the retention funds. ITEM EXPLANATION: On May 10, 1989 the District signed a contract with Commercial Contractors, Inc. of San Diego for $5,327,818.36 for the construction of a 10 million gallon concrete reservoir and piping appurtenances. The .project involved the construction of a rectangular concrete' facility to store 10 million gallons of potable water. The tank is divided by a center wall into two 5 million gallon compartments. Instllation of various sized piping, the largest being 42 inch diameter, was a part of this project to enable water from the District's existing open reservoir to flow to this new facility and to the District's distribution system. During the course of construction of this project, a quality problem occurred with the concrete being supplied to the job site. Certain portions of the concrete were removed at the direction of the District because of noncompliance with the specifications. As a result the concrete supply subcontractor and the general contractor, Commercial Contractors, Inc., became involved in a lawsuit and a "stop payment notice" was received by the District. The general contractor issued a bond to the District for 125% of the disputed amount. The City Attorney's office reviewed this project and the bond for conformance to District and State law requirements and found the bond to be satisfactory. Therefore, the District can proceed with acceptance of this project and file the Notice of Completion. After the required time has passed and no additional claims have been received, release of the retainage can be made. The bond will remain with the District until settlement of the suit and proper notice has been sent to the District. The entire project has been inspected and accepted by staff and is now ready for formal acceptance by the Board. h - Agenda Bill on Acceptance of Maerkle Reservoir (continued) FISCAL IMPACT: The 1989-90 budget for this project's construction totaled $6,519,600.00. Location map C % 2 3 4 5 6 . . 7 e _ _. 9 1C 11 12 12 14 15 1E 17 1t 15 2c 21 2: 21 24 2: 2t 2: 2t RESOLUTION NO. 709 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD MUNICIPAL WATER DISTRICT ACCEPTING CONSTRUCTION OF THE TEN MILLION GALLON MAERKLE RESERVOIR AND PIPING APPURTENANCES ._ (CMWD PROJECT NO. 87-109) WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has determined that Commercial Contractors, Inc. has completed the subject project in accordance with the plans, specifications and terms of the contract document; and WHEREAS, the District Engineer has recommended that the Board of Directors accept the facilities constructed by Commercial Contractors, Inc., authorize the Secretary to file a Notice of Completion and authorize the General Manager to release the final retention of funds. NOW, THEREFORE, BE IT RESOLVED, by the Board of Directors of the Carlsbad Municipal Water District: 1. That the above recitations are true and correct; 2. That the construction of the ten million gallon Maerkle Reservoir and piping appurtenances is hereby deemed complete and accepted; 3. That the Secretary is hereby authorized and directed to record the Notice of Completion, and 4. That the General Manager is authorized to release the retainage to Commercial Contractors, Inc. at the end of the 35 day lien period following the filing of the Notice of Completion. The bond is to be retained until proper notice of settlement is received by the District.
