ADMI N l fiECOMMENDED ACTION: Adopt Ordinance No. 37 regulating the issuance of water meters. ITEM EXPLANATION The District presently allows issuance of residential, industrial and commercial water meters on the basis of an existing service, an approved building lot, and payment of the required fee. Recent requests for these water meters have been based on the aforementioned conditions and on a potential building moratorium due to the fifth year drought conditions that affect San Diego County as well as Carlsbad. The purpose of purchasing water meters at this time without issuance of a building permit at the same time indicates that the meters cannot be immediately put into service. Therefore, purchase of meters at this time may lead to banking of the meters for use during a potential water emergency where water meter issuance would be curtailed. Therefore, the attached Ordinance No. 37 will revise the issuance of water meter permits to closely parallel the issuance of sewer permits in accordance with City Code 13.10.010. FISCAL IMPACT Since this a&ion would regulate issuance of water meters and would not reduce the number of water meters installed, no fiscal impact is anticipated. EXHIBITS 1. Ordinance No. 37 . :. ’ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE NO. 37 AN ORDINANCE OF THE CARLSBAD MUNICIPAL WATER DISTRICT REGULATING THE ISSUANCE OF WATER METERS WHEREAS, present practice of the District is to allow issuance of water meters upon proper application and receipt of the required deposit: and WHEREAS, the District desires to modify the issuance of all residential, industrial and commercial water meters to parallel the issuance of City sewer permits: NOW, THEREFORE, the Carlsbad Municipal Water District Does Ordain: SECTION 1. That concurrently with issuance of a valid building permit for a new structure or with the issuance of a move-on permit for a mobile home, upon application and payment of the required fees, a water meter permit may be issued by the District's General Manager authorizing connection of the structure for which the building permit has been issued or the mobile home for which the move-on permit has been issued, to the water system. SECTION 2. It is unlawful for any person to connect to or use the District's water system without first obtaining a water meter permit. SECTION 3. Every water meter permit issued pursuant to Section 1. shall be returned if the building permit for the structure to which the connection is being made or the move-on permit for the mobile home to be connected, expires by limitation or otherwise becomes null and void. If a permit has expired, then before the connection for such structure or mobile home can be made a new water meter permit shall be obtained and the fee shall be one- half of the required fee for the original permit unless one year has passed since the expiration in which case the fee shall be the same as a new permit. SECTION 4. Permits for the connection of an existing structure to the water system may be issued by the General Manager at any time upon proper application. Every water meter permit issued pursuant to this subsection shall expire by limitation and become null and void if work on the connection authorized by such permit is not completed within one hundred eighty days from the date of issuance of such permit. SECTION 5. The Carlsbad Municipal Water District finds that this Ordinance and actions taken hereafter pursuant to this Ordinance are exempt from the California Environmental Quality Act as specific actions necessary to prevent or mitigate an 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 emergency pursuant to Public Resources Code Section 21080(b) (4) and the California Environmental Quality Act Guidelines Section 15269(c). The Manager of the District is hereby authorized and directed to file a Notice of Exemption as soon as possible following adoption of this Ordinance. SECTION 6. This Ordinance shall become effective as of the date of adoption and shall be published within ten days of adoption, pursuant to the California Water Code Section 376.
