ITEM EXPLANATION: Western Financial Savings Bank, developers of the Western Financial Plaza project, have submitted completed plans and agreement for onsite water system site improvements. A performance guarantee in the sum of $25,000 has been posted to guarantee the water system improvements. This project is located on the south side of Hosp Way east of El Camino Real. It is recommended that the Board of Directors approve and accept the plans and agreement for onsite water system improvements for the Western Financial Plaza, Minor Subdivision 827, CMWD Project No. 89-C- 313, authorize the District Engineer to sign the improvement plans and the President to sign the Onsite Water System Improvements Agreement. The plans and specifications for the water 1 6/25/91 REV. 1 improvements, which are the subject of this Agreement, are set 2 forth on all sheets of those plans ("improvementsl'). The DISTRICT 3 Board of Directors has approved the plans. 4 C. Interim Maintenance of Imnrovements. (‘" i P , i "'. 10: Severabilitv of Provisions. The invalidity or illegality of any provisions of this,Agreement shall not affect the i validity or enforcement of the remainder of this Agreement. Waiver or Amendment. No provision of this Agreement, nor any breach hereof, can be waived unless in writing. Waiver of any one breach of any provision hereof shall not be construed as a waiver of any other breach of the same or any other provision hereof.
