CMWD ENG STATION C DISINFECTION FACILITIES CITY MGR.q RECOMMENDED ACTION: Adopt Resolution No. && for approval of agreement for engineering construction management assistance for the Maerkle Reservoir Pump Station and Disinfection Facilities, CMWD Project No. 89-109. ITEM EXPLANATION: The second phase of expansion and upgrading of the Maerkle Reservoir Facilities consists of construction of a pump station for potable water and chloramination facility. The second phase of the project was approved and authorized to advertise for bids at the May 12, 1992, meeting of the Board of Directors by Agenda Bill 162 and Resolution No. 787. The District is following City procedure with the City Engineering Department providing inspection services. The District Engineer will be the project engineer. Dudek & Associates, design engineers, have entered into an agreement with the District to assist the project engineer with engineering construction management assistance on an as needed basis. FISCAL IMPACT: The 1992-93 C.I.P. Budget appropriated $3,337,500 for the second phase, pump station and chloramination construction which is estimated to cost $2,300,000. The agreement for engineering construction management assistance is estimated not to exceed $90,000. There are $1,037,500 remaining unencumbered for this phase, therefore, there are sufficient funds available. This agreement reflects the maximum contingent price. It is not expected that the costs will reach this maximum amount unless the project proves to be unusually difficult. EXHIBITS: 1. Location Map. 2. CHANGES IN WORK i )' If, in the course of the contract, changes seem merited by the Consultant or the District, and informal consultations with the other party indicate that a change in the conditions of the contract is warranted, the Consultant or the District may request a change in contract. TERMINATION OF CONTRACT In the event of the Consultant's failure to prosecute, deliver, or'perform the work as provided for in this contract, the District may terminate this contract for nonperformance by notifying the Consultant by certified mail of the termination of the Consultant. The Consultant, thereupon, has five (5) working days to deliver said documents owned by the District and all work in progress to the Encrineer . The Board of Directors may then opt to consider the directed solution to the problem. SUSPENSION OR TERMINATION OF SERVICES This agreement may be terminated by either party upon tendering thirty (30) days written notice to the other party. That the above recitations are true and correct. 25 2. That the Engineering Services Agreement between Dudek & 26 Associates, Inc. and Carlsbad Municipal Water District for 27 engineering construction management assistance as directed in 28 Exhibit rrA1l of the Engineering Services Agreement attached thereto II .
