NOTICE OF COMPLETION FOR
1992 FENCING PROJECTS IN THE
CITY OF CARLSBAD PROJECT NO. 3900
RECOMMENDED ACTION:
Adopt Resolution No. m’accepting the construction and installation of 1992 Fencing Projects
in the City of Carlsbad, CMWD Project No. 91-l 10, Contract No. 3900, as complete and directing
the Secretary to record a Notice of Completion and release of bonds in accordance with State
Law and City Ordinances.
I lTEM EXPLANATION:
On September 15, 1992, Lightening Fence was awarded a contract in the amount of $60,566-l 6
to construct and install 1992 fencing projects in the City of Carlsbad for Maerkle I Reservoir,
Maerkle II Reservoir and La Costa Low Reservoir.
Lightning Fence completed the work on April 7, 1993. City forces have inspected said
improvements and found them to be satisfactory. Staff recommends formal acceptance by Board
of Directors of the Carlsbad Municipal Water District.

RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF
CARLSBAD, CALIFORNIA ACCEPTING CONSTRUCTION AND
INSTALLATION OF 1992 FENCING PROJECT, CMWD PROJECT
NO. 91-l 10, CONTRACT NO. 3900. AS COMPLETE
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has
determined that Lightning Fence has completed the construction and installation of 1992 Fencing
Projects in the City of Carlsbad for Maerkle I Reservoir, Maerkle II Reservoir and La Costa Low
Reservoir, in accordance with the plans, specifications and terms of the contract document; and
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District have
previously appropriated certain funding for said project; and
WHEREAS, the District Engineer has recommended that the Board of Directors
accept the construction and installation by Lightning Fence, authorize the Secretary to file a
“Notice of Completion”, and authorize the General Manager to release the final retention fund
upon passing the thirty-five day lien period following the filing of the Notice of Completion.
NOW, THEREFORE, BE lT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District, as follows:
1. That the above recitations are true and correct.
2. That construction and installation of 1992 Fencing Projects, specifically
identified as CMWD Project No. 91-l 10, Contract No. 3900, is deemed complete and hereby
accepted.
3. That the Secretary, is hereby authorized and directed to record the Notice of
Completion.

4. That the General Manager is authorized to release the final retention fund, the
securities held to insure faithful performance, to Lightning Pence at the end of the 35 day lien
period following the filing of the “Notice of Completion”.
5. That the Accountant is hereby authorized and directed to allow the project
account to remain open until such time as all related services and costs are identified and
secured.

Council held on the -day of JUNE , 1993, by the following vote, to wit:
