NOTICE OF COMPLETION FOR
1993 FENCING PROJECTS IN THE
CITY OF CARLSBAD PROJECT NO. 3900A
RECOMMENDED ACTION:
Adopt Resolution No. 8% accepting the construction and installation of 1993 Fencing Projects
in the City of Carlsbad, CMWD Project No. 92-104, Contract No. 39OOA, as complete and
directing the Secretary to record a Notice of Completion and release of bonds in accordance with
State Law and City Ordinances.
R-EM EXPLANATION:
On January 5, 1993, Fortress Fence Co. was awarded a contract in the amount of $22,983.79
to construct and install 1993 fencing projects in the City of Carlsbad for Buena Vista Reservoir.
Fortress Fence Co. completed the work on April 19, 1993. City forces have inspected said
improvements and found them to be satisfactory. Staff recommends formal acceptance by Board
of Directors of the Carlsbad Municipal Water District.

RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF
CARLSBAD, CALIFORNIA ACCEPTING CONSTRUCTION AND
INSTALLATION OF 1993 FENCING PROJECT, CMWD PROJECT
NO. 92-104, CONTRACT NO. 3900A. AS COMPLETE
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has
determined that Fortress Fence Co. has completed the construction and installation of 1993
Fencing Projects in the City of Carlsbad for Buena Vista Reservoir, in accordance with the plans,
specifications and terms of the contract document; and
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District have
previously appropriated certain funding for said project; and
WHEREAS, the District Engineer has recommended that the Board of Directors
accept the construction and installation by Fortress Fence Co., authorize the Secretary to file a
“Notice of Completion”, and authorize the General Manager to release the final retention fund
upon passing the thirty-five day lien period following the filing of the Notice of Completion,
NOW, THEREFORE, BE lT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District, as follows:
1. That the above recitations are true and correct.
2. That construction and installation of 1993 Fencing Projects, specifically
identified as CMWD Project No. 92-104, Contract No. 39OOA, is deemed complete and hereby
accepted.
3. That the Secretary, is hereby authorized and directed to record the Notice of
Completion.

4. That the General Manager is authorized to release the final retention fund, the
securities held to insure faithful performance, to Fortress Fence Co. at the end of the 35 day lien
period following the filing of the “Notice of Completion”.
5. That the Accountant is hereby authorized and directed to allow the project
account to remain open until such time as all related services and costs are identified and
secured.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the m day of JUNE , 1993, by the following vote, to wit:
