IEPT. rhr(wn CITY ATTY ~ CITY MGR. ~ 3ECOMMENDED ACTION: Recommend Board of Directors approve resolution to establish fee for agricultural land conversion mitigation for Twin "D" reservoir site improvements. Carlsbad Municipal Water District will be constructing a new 8.5 don gallon potable water storage facility adjacent to the present Twin "D" tank site. The District has purchased 2.74 acres at this site and, as a condition of the coastal pennit allowing the construction of the 8.5 million gallon tank, a fee must be established by the City Council for mitigation of the loss of agricultural land. The District wiU be paying this fee upon award of the construction contract, at a later date. For further explanation of this item and location, refer to the attached City agenda bill. ESTABLISH FEE FOR AGRICULTURAL LAND CONVERSION MITIGATION FOR TWlN 'D' SITE IMPROVEMENTS Adopt Resolution No. Reservoir site Improvements, Assessor Parcel No. 215-08-23, (2.74 acres), CMWD Project No. 84-111, Contract No. 3376. to establish fee for agricultural land conversion mitigation for Twin ITEM EXPLANATION: The Twin 'D' Reservoir Site Improvements are located within the 'Designated Coastal Agricultural Lands' of Mello II Local Coastal Program (LCP). Any development of the 274 acre site requires the preservation of prime agricultural land elsewhere within the statewide coastal zone or the payment of an agricultural land conversion mitigation fee. The amount of fee set by the Carlsbad City Council ranges between $s,Ooo and $lO,OoO per acre and is based upon the per acre cost of presenn'ng prime agricultural land elsewhere in the state. The conversion mitigation fee is deposited in the State Coastal Conservancy Fund, through the administration of our coastal development permit, and is used to preserve or enhance other important coastal resources. Since the site will be developed by constructing a new 8.5 million gallon potable water storage facility allowing the existing adjacent potable water storage reservoirs to be converted to reclaimed water uses, both of which are necessary and complimentary to adjacent agricultural uses, staff recommends that the mitigation fee be set at the minimum of $5,OOO per acre for a total fee of $13,700. ENWRONMENTAL REVIEW: EIA 91-15, a conditional negative declaration, was processed through the City of Carlsbad Planning Department and approved in 1992. Proposed Twin '0' Reservoir Improvements were reviewed, and a conditional permit was issued by the Coastal Commission in September 1993. In both instances, a condition was placed on the project requiting the payment 04 agricultural land conversion mitigation fees. FISCAL IMPACT: Approximatety $4,38O,OOO is available in the 1993/1994 Capital Improvement Projects Budget for the Twin 'D' Reservoir Improvements, therefore, funds are available for the expenditure of $13,700 for the payment of agricultural land conversion mitigation fees. A RESOLUTION OF THE CrrY COUNCIL OF CARLSBAD, CALIFORNIA, TO ESTABLISH FEE FOR AGRICULTURAL LAND CONVERSION MITIGATION FEES, TWIN 'D' RESERVOIR SITE IMPROVEMENTS, ASSESSOR PARCEL NO. 215080-23, (2.74 ACRES), CMWD PROJECT 84-1 1 1, CONTRACT NO. 3376 WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary, desirable, and in the public interest to establish an agricultural land conversion mitigation fee for the 2.74 acre Twin 'D' Reservoir Site known as Assessor Parcel No. 21 5-080-23 and being within Site 111 of the 'Designated Coastal Agricultural Lands' of the Mello I1 Local Coastal Program (LCP), and that said fee be deposited with the State Coastal Conservancy fund; and WHEREAS, the amount of mitigation fee set by the City of Carlsbad ranges between $5,OOO and $lO,OoO per acre and is based upon the per acre cost of preserving prime agricultural land elsewhere in the state. Considering that said Assessor Parcel No. 215-080-23 will be developed with potable water storage facilities and existing adjacent potable water reservoirs are being converted for reclaimed water storage, both of which are necessary and complimentary to adjacent agricultural uses, the mitigation fee should be in the lesser amount of $5,OOO per acre for a total fee of $13,700; and WHEREAS, approximately $4,38O,OOO is available for development of the Twin '[Y Reservoir Improvements, therefore, funds are available for the expenditure of $13,700 for the payment of agricultural land conversion mitigation fees; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad, California, as follows: 1.
