Adopt Resolution No. 86 3 accepting the construction of Reclaimed and Potable
Water System Improvements in the City of Carlsbad, CMWD Project Nos. 86-109,91-l 09,
and 9 l-301 , Contract No, 3394, as complete and directing the Secretary to record a Notice
of Completion and release of bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On August 10, 1993, T.C. Construction was awarded a contract in the amount of
$964,177.45 to construct the reclaimed and potable water system improvements at the
location shown on the attached Location Map - Exhibit “1 ‘I.
T.C. Construction completed the work on March 11, 1994. City forces have inspected
said construction and found it to be satisfactory. Staff recommends formal acceptance by
Board of Directors of the Carlsbad Municipal Water District.

RESOLUTION NO. 867
RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT
OF CARLSBAD, CALIFORNIA ACCEPTING CONSTRUCTION OF
THE RECLAIMED AND POTABLE WATER SYSTEM
IMPROVEMENTS CMWD PROJECT NOS. 86-109, 91-109 AND
91-301 CONTRACT NO. 3394 AS COMPLETE.
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has determined
T.C. Construction has completed the construction of the Reclaimed and Potable Water System
Improvements in the City of Carlsbad, in accordance with the plans, specifications and terms of
the contract document; and
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District have previously
appropriated certain funding for said project; and
WHEREAS, the District Engineer has recommended that the Board of Directors accept the
construction by T.C. Construction, authorize the Secretary to file a “Notice of Completion”, and
authorize the General Manager to release the final retention fund upon passing the thirty-five (35)
day lien period following the filing of the Notice of Completion
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District, as follows:
1. That the above recitations are true and correct.
2. That the construction of the Reclaimed and Potable Water System Improvements,
specifically identified as CMWD Project Nos. 86-109, 91-l 09 and 91301 Contract No. 3394, is
deemed complete and hereby accepted.
3. That the Secretary, is hereby authorized and directed to record the Notice of
Completion.
4. That the General Manager is authorized to release the final retention fund, the
securities held to insure faithful performance, to T.C. Construction at the end of the 35 day lien
period following the recording of the “Notice of Completion”.

1 5. That the Accountant is hereby authorized and directed to allow the project account
2 to remain open until such time as all related services and costs are identified and secured.

The street address of said property is Palomar Airport Road between Paseo Del Norte and College, from Palomar Airport Road to “E” Tank north of Palomar Airport Road; El Camino Real between Camino Vida Robles and La Costa Boulevard; La Costa Boulevard from El Camino Real to D2 Tank; College Boulevard from Palomar Airport Road to Cobblestone Road.
