RECOMMENDED ACTION:
Adopt Resolution No. 9 / & for acceptance of construction of water system facilities to Aldea, Carlsbad
Tract 90-l 4, Aviara Planning Area 16, CMWD Project No. 90506.
ITEM EXPLANATION:
DR. Horton, Inc. - San Diego, developer of the subject project, has satisfactorily completed all of the
construction and related proceedings for the project, and the water system is now ready for acceptance,
ownership and operation by the District. As a condition of development approval, DR. Horton, Inc. - San
Diego has offered water system facilities which includes pipelines, valves and appurtenances constructed in
Aldea, Carlsbad Tract 90-14, Aviara Planning Area 16, CMWD Project No. 90-506, for public use to the
Carlsbad Municipal Water District, and upon its acceptance by the Board of Directors, all right, title and interest
of the water system facilities constructed by DR. Horton, Inc. - San Diego shall vest in the District.
FISCAL IMPACT:
Requiring offer and acceptance of water system facilities will allow the District to operate and maintain the
facility as part of the public system. The cost of the pipeline, $281500.00, vested in the District will become
a part of District Fixed Assets.

We hereby declare that the public water system which includes pipelines, valves
and appurtenances constructed in ALDEA, AVIARA PLANNING AREA 16. C. T. 94-10,
in accordance with the plans filed with the Carlsbad Municipal Water District is built for
public use and that upon its acceptance by said District, all right, title and interest of the
undersigned in and to said facilities shall vest in said District.
We further certify that any and all claims for labor, material, or any other
construction costs have been cleared so that there are no encumbrances. The total cost
of pipeline construction amounted to Two Hundred Eighty One Thousand Five Hundred Dollars.
($281,500.00 ).

A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT, CARLSBAD, CALIFORNIA, FOR
ACCEPTANCE OF CONSTRUCTION OF WATER SYSTEM FACILITIES TO
ALDEA, CARLSBAD TRACT 90-14, AVIARA PLANNING AREA 16, CMWD
PROJECT NO. 90-506
WHEREAS, the public water system which includes pipelines, valves, appurtenances
constructed in Aldea, Carlsbad Tract 90-14, Aviara Planning Area 16, CMWD Project No. 90-506, in
accordance with the plans filed with Carlsbad Municipal Water District is built for public use and that upon
its acceptance by said District, all right, title and interest of D.R. Horton, Inc. - San Diego in and to said
facilities shall vest in said District; and
WHEREAS, the Board of Directors further certify that any and all claims for labor, material,
or any other construction costs have been cleared so that there are no encumbrances and the total cost
of pipeline construction amounted to $281,500.00, and the system is deemed complete and hereby
accepted. NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District, as follows:
1. That the above recitations are true and correct.
2. That the construction of the water system facilities in Aldea, Carlsbad Tract 90-l 4,
Aviara, Planning Area 16, CMWD Project No. 90-506, with a total cost of pipeline construction amounting
to $281,500.00, and the system is deemed complete and hereby accepted.
3. That the President is authorized to execute the Offer and Acceptance of Water
System Facilities document of which the original copy will be on file with the City of Carlsbad, one copy
will be on file with the Carlsbad Municipal Water District and one copy will be returned to D.R. Horton, Inc.
- San Diego.

3 4. That the Finance Director is hereby authorized and directed to allow the
2 project to be closed as all related services and costs have been identified and secured.
3 PASSED, APPROVED AND ADOPTED at a special meeting of the Board of Directors held
4 on 14th day of NOVEMBER, 1995, by the following vote, to wit:
