3ECOMMENDED ACTION:
Adopt Resolution No. 9 1 “I accepting the recoating of the La Costa Lo and Skyline
Steel Tank Reservoirs in the City of Carlsbad, CMWD Project No. 94-102, Contract No.
3425, as complete and directing the Secretary to record a Notice of Completion and
release of bonds in accordance with State law and City Ordinances.
ITEM EXPLANATION:
On March 3, 1995, Professional Restoration Services, Inc., was awarded a contract in the
amount of $186,210.00 for recoating of the La Costa Lo and Skyline Steel Tank Reservoirs
at the locations shown on the attached location map, exhibit 1.
Professional Restoration Services, Inc., completed the work on October 26, 1995. City
forces have inspected said recoating and found it to be satisfactory. Staff recommends
formal acceptance by Board of Directors of the Carlsbad Municipal Water District.

A RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF
CARLSBAD, CAUFORNIA ACCEPTING THE RECOATING OF THE LA
COSTA LO AND SKYUNE STEEL TANK RESERVOIRS, CMWD PROJECT
NO. 94-102. CONTRACT NO. 3425 AS COMPLETE
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has determined
Professional Restoration Services, Inc., has completed the construction of the recoating of La
Costa Lo and Skyline Steel Tank Reservoirs in the City of Carlsbad, in accordance with the plans,
specifications and terms of the contract document; and
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District have previously
appropriated certain funding for said project; and
WHEREAS, the District engineer has recommended that the Board of Directors accept the
construction by Professional Restoration Services, Inc., authorite the Secretary to file a “Notice
of Completion”, and authorize the General Manager to release the final retention fund upon
passing the thirty-five (35) day lien period following the filing of the Notice of Completion.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District, as follows:
1. That the above recitations are true and correct.
2. That the construction of the recoating of the La Costa Lo and Skyline Steel Tank
Reservoir, specifically identified as CMWD Project No. 94-102, Contract No. 3425, is deemed
complete and hereby accepted.
3. That the Secretary, is hereby authorized and directed to record the Notice of
Completion, have same recorded, and reduce/release bonds as appropriate.
4. That the General Manager is authorized to release the final retention fund, the
securities held to insure faithful performance, Professional Restoration Services, Inc., at the end
of the 35 day lien period following the recording of the “Notice of Completion’.

5. That the Accountant is hereby authorized and directed to allow the project account
to remain open until such time as all related sevices and costs are identified and secured.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Board of Directors of
the Carlsbad Municipal Water District held on the 9th day of JANUARY t
1996 by the following vote, to wit:

The property on which said work of improvement was completed is in the City of Carlsbad, County of San Diego, State of California, and is described as follows: CMWD Project No. 94-102, Contract No. 3425, La Costa Lo and Skyline Steel Tank Reservoirs.
