at Palomar Airport Road and Price club Entrance, Paseo Del None and Camino De Las
Ondas, in the City of Carlsbad, CMWD Project No.94-302, Contract No. 3348A, complete
and directing the Secretary to record a Notice of Completion and release bonds in
accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On August 22, 1995, Western Pacific Construction was awarded a contract in the amount
of $271,381 for construction of Reclaimed Water Pipeline at Palomar Airport Road and
Price Club Entrance, Paseo Del None and Camino De Las Ondas, at the location shown
on the attached Location Map - Exhibit 1.
Western Pacific Construction completed the work on February 6, 1996. City forces have
inspected said construction and found it to be satisfactory. Staff recommends formal
acceptance by Board of Directors of the Carlsbad Municipal Water District.
FISCAL IMPACT:
A summary of the final project cost is as follows:

RESOLUTION NO. 936
A RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF
CARLSBAD, CALIFORNIA, ACCEPTING CONSTRUCTION OF
RECLAIMED WATER PIPELINE AT PALOMAR AIRPORT ROAD AND
PRICE CLUB ENTRANCE, PASEO DEL NORTE AND CAMINO DE LAS
ONDAS, CMWD PROJECT NO. 94-302. CONTRACT NO. 3348A
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has determined
Western Pacific Construction has completed the construction of Reclaimed Water Pipeline at
Palomar Airport Road and Price Club Entrance, Paseo Del Norte and Camino De Las Ondas, in
the City of Carlsbad, in accordance with the plans, specifications and terms of the contract
document; and
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District have previously
appropriated certain funding for said project; and
WHEREAS, the District Engineer has recommended that the Board of Directors accept
the construction by Western Pacific Construction, authorize the Secretary to file a * Notice of
Completion”, and authorize the General Manager to release the final retention fund upon passing
the thirty-five (35) day lien period following the filing of the Notice of Completion.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District, as follows: California, as follows:
1. That the above recitations are true and correct.
2. That construction of Reclaimed Water Pipeline at Palomar Airport Road and Price
Club Entrance, Paseo Del None and Camino De Las Ondas, specifically identified as CMWD
Project No. 94-302, Contract No. 3348A, is deemed complete and hereby accepted.
3. That the Secretary is hereby authorized and directed to execute the Notice of
Completion, have same recorded, and reduce/release bonds as appropriate.

4. That the General Manager is authorized to release the final retention fund, the
securities held to insure faithful performance, Western Pacific Corporation at the end of the 35
day lien period following the recording of the “Notice of Completion”.
5. That the Accountant is hereby authorized and directed to allow the project account
to remain open until such time as all related services and costs are identified and secured.
PASSED, APPROVED AND ADOPTED at a special meeting of the Board of Directors of
the Carlsbad Municipal Water District held on the 7th day of MAY ,
1996 by the following vote, to wit:
