a - RESOLUTION NO. 940
A RESOLUTION OF THE BOARD OF DIRECTORS OF THE CARLSBAD
MUNICIPAL WATER DISTRICT APPOINTING A MEMBER TO THE SAN
DIEGO COUNTY WATER AUTHORITY.
WHEREAS, the term of the existing Director of the Carlsbz
Municipal Water District as a representative to the San Diego
County Water Authority expires on June 17, 1996; and
WHEREAS, a majority of the Board of Directors can appoint
representative to serve for a new term to expire June 17, 200:
and
WHEREAS, no member of the Board of Directors may appoint
vote for his or her own appointment,
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors
the Carlsbad Municipal Water District as follows:
1. That the above recitations are true and correct.
2. That Director CLAUDE LEWIS is appointed to
represent the Carlsbad Municipal Water District on the Board
Directors of the San Diego County Water Authority for a term
to expire on June 17, 2002, or until a successor is appointed
qualified.
That the Secretary is hereby directed and authorized to
deliver a certified copy of this resolution forthwith to the
Board of Directors of the San Diego County Water Authority.

RE: Claude “Bud” Lewis’ term of office on the Authority Board
The Authority records indicate Bud Lewis’ term of office as your representative on
the Water Authority’s Board will expire on June 17, 1996.
Under the terms of the County Water Authority Act, Mr. Lewis will continue as a
member of the Water Authority Board from the City of Carlsbad until such time as he is
reappointed or his successor is appointed.

The Carlsbad Municipal Water District Board, at its meeting of June 4, 1996,
adopted Resolution No. 940 appointing Claude “Bud” Lewis as the representative to
the San Diego County Water Authority for a term to expire on June 17, 2002, or
until a successor is appointed.

SAN DIEGO COUNTY WATER AUTHORITY APPOINTMENT
The County Water Authority Act was amended this year to delete the prohibition against
a member of the Carlsbad Municipal Water District appointing himself or herself to the
County Water Authority. Amendments to Water Code Appendix Section 45-6,
amended by Senate Bill 1173 (Killea) (1995 Stats, Chapter 73) caused that section to
read as follows:

‘I.. . (The County Water Authority) Board of Directors shall consist of
at least one representative from each public agency, the area of
which is within the authority. The representative shall be
designated and appointed by the chief executive officers of those
public agencies, respectively, with the consent and approval of the
legislative bodies of the public agencies, respectively. Any
member of the governing body of a member agency which is a
water district may be appointed by that member agency to the
board of the authority to serve as the agency’s representative. ..Any
director holding dual offices shall not vote upon any contract
between a county water authority and the member public agency
he or she represents on the authority’s board ...”
