RECOMMENDED ACTION:
Adopt Resolution No. 9+A t o accept improvements, authorize the Secretary to
record the Notice of Completion and release bonds in accordance with State Law and
District Codes.

ITEM EXPLANATION:
The developer has constructed improvements required of this project and has requested
Carlsbad Municipal Water District (CMWD) to accept the public improvements. City forces
have inspected the public improvements and found them to be satisfactory. Staff
recommends formal acceptance by the Board of Directors of the Carlsbad Municipal Water
District.
The public improvements constructed consist of installation of waterline, water service, and
fire hydrants.
FISCAL IMPACT:
The Carlsbad Municipal Water District will be required to maintain the public improvements.

RESOLUTION NC. 942
A RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF
CARLSBAD, CALIFORNIA, ACCEPTING THE PUBLIC IMPROVEMENTS
OF CARLSBAD RESEARCH CENTER. LOT 43, UNIT 2A - CMWD#95-206.
WHEREAS, the public improvements consisting of installation of waterline, water service,
and fire hydrants located at the southeast corner of Rutherford Road and Faraday Avenue in the
City of Carlsbad, California, have been successfully completed.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the construction of the above described public improvements is deemed
complete and hereby accepted.
3. The Secretary is hereby authorized and directed to record the Notice of Completion
for said project and release bonds in accordance with State Law and District Codes.
4. That the Carlsbad Municipal Water District of Carlsbad, California, is hereby directed
to commence maintaining the above described public improvements for said project.
PASSED, APPROVED AND ADOPTED at a special meeting of the Board of Directors of
the Carlsbad Municipal Water District held on the 16th day of JUNE , 1996
by the following vote, to wit:
