RECOMMENDED ACTION:
Adopt Resolution No. to accept improvements, authorize the Secretary to record the 9 L 9
Notice of Completion and release bonds in accordance with State Law and District Codes.
ITEM EXPLANATION:
The developer has constructed improvements required of this project and has requested Carlsbad
Municipal Water District (CMWD) to accept the public improvements. City forces have inspected
the public improvements and found them to be satisfactory. Staff recommends formal acceptance
by the Board of Directors of the Carlsbad Municipal Water District.
The public improvements constructed consist of the installation of potable and reclaimed water
systems.
FISCAL IMPACT:
The Carlsbad Municipal Water District will be required to maintain the public improvements. The
valuation of the water improvements is as follows:

A RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF CARLSBAD, CALIFORNIA, ACCEPTING THE PUBLIC IMPROVEMENTS
OF AVIARA PA 7. CT 90-051. CMWD ##90-509
WHEREAS, the public improvements consisting of the installation of potable and
reclaimed water systems located at the northwest corner of the intersection of Aviara Parkway
and Ambrosia Lane the City of Cartsbad, California, have been successfully completed.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the construction of the above described public improvements is deemed
complete and hereby accepted.
3. The Secretary is hereby authorized and directed to record the Notice of Completion for
said project and release bonds in accordance with State Law and District Codes.
4. That the Carlsbad Municipal Water District of Carlsbad, California, is hereby directed
to commence maintaining the above described public improvements for said project.
PASSED, APPROVED AND ADOPTED at a special meeting of the Board of Directors of
the Carlsbad Municipal Water District held on the 18th day of , 1997 by the following MARCH
