Adopt Resolution No. wo to accept improvements, authorize the Secretary to record the
Notice of Completion and release bonds in accordance with State Law and District Codes.
ITEM EXPLANATION:
The developer has constructed improvements required of this project and has requested Carlsbad
Municipal Water District (CMWD) to accept the public improvements. City forces have inspected
the public improvements and found them to be satisfactory. Staff recommends formal acceptance
by the Board of Directors of the Carlsbad Municipal Water District.
The public improvements constructed consist of installation of water improvements.
FISCAL IMPACT:
The Carlsbad Municipal Water District will be required to maintain the public improvements. The
valuation of the water improvements is $85,860.

A RESOLUTION OF THE CARLSBAD MUNICIPAL WATER DISTRICT OF
CARLSBAD, CALIFORNIA, ACCEPTING THE PUBLIC IMPROVEMENTS
OF AVIARA PA 24, UNIT 2 - CT 90-15, CMWD NO. 91-514
WHEREAS, the public improvements consisting of installation of water improvements
located at southeast corner of Aviara Parkway and Poinsettia Lane in the City of Carlsbad,
California, have been successfully completed.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the construction of the above described public improvements is deemed
complete and hereby accepted.
3. The Secretary is hereby authorized and directed to record the Notice of
Completion for said project and release bonds in accordance with State Law and District
Codes.
4. That the Carlsbad Municipal Water District of Carlsbad, California, is hereby
directed to commence maintaining the above described public improvements for said project.
PASSED, APPROVED AND ADOPTED at a special meeting of the Board of Directors of
the Carlsbad Municipal Water District held on the 5th day of AUGUST , 1997 by the
following vote, to wit:
AYES: Board Members Lewis, Finnila, Nygaard, Kulchin, Hall
