DEPT. CMWD PROJECT NO. 90-109 CONTRACT NO. 3388 CITY MGR.
RECOMMENDED ACTION:
Adopt Resolution No. 10 1-3 to accept the construction of the Maerkle Reservoir, Cover
and Liner, Contract No. 3388, authorize the Secretary to record the Notice of Completion and
release bonds in accordance with State Law and District Codes.
ITEM EXPLANATION:
On October 1, 1996, J.W. Contracting Corporation was awarded a contract in the amount of
$4,563,000 for the construction of the Maerkle Reservoir, Cover and Liner, Contract No. 3388.
J.W. Contracting Corporation completed the work on July 23, 1998.
City forces have inspected the public improvements and found them to be satisfactory. Staff
recommends formal acceptance by the Board of Directors of the Carlsbad Municipal Water
District.
The public improvements consist of the construction of the Maerkle Reservoir, Cover and Liner,
Contract No. 3388.
FISCAL IMPACT:
The Carlsbad Municipal Water District will be required to maintain the public improvements.

A RESOLUTION OF THE CARLSBAD MUNICIPAL WATER
DISTRICT OF CARLSBAD, CALIFORNIA, ACCEPTING THE
CONSTRUCTION OF THE MAERKLE RESERVOIR,
COVER AND LINER, CMWD PROJECT NO. 90-109,
CONTRACT NO. 3388.
WHEREAS, the public improvements consisting of the construction of the Maerkle
Reservoir, Cover & Liner, Contract No. 3388, have been successfully completed.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Carlsbad
Municipal Water District of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the construction of the above described public improverhents is deemed
complete and hereby accepted.
3. The Secretary is hereby authorized and directed to record the Notice of
Completion for said project and release bonds in accordance with State Law and District
Codes.
4. That the Carlsbad Municipal Water District of Carlsbad, California, is hereby
directed to commence maintaining the above described public improvements for said project.
PASSED, APPROVED AND ADOPTED at a special meeting of the Board of Directors of
the Carlsbad Municipal Water District held on the 4th day of August , 1998 by the
following vote, to wit:
