CMWD RECOMMENDED ACTION: Adopt Resolution No. /OY5 for approval and execution of a quitclaim deet temporary water pipeline easement over a portion of Calavera Hills Village Q, C: Tract 83-32, Map No. 12950, CMWD Project No. 84-502 ITEM EXPLANATION: This item is a request of Cypress Valley LLC, a California limited liability company, O\I Calavera Hills Village Q, Carlsbad Tract 83-32, Map No. 12950, CMWD Project No. l located north of Tamarack Avenue and east of Bluff Court. This easement was gra Carlsbad Municipal Water District per document recorded June 20, 1985 as File F 220698 of Official Records as a temporary easement to be terminated upon compls the permanent water line in Tamarack or other public rights-of-way adjacent temporary easement. The engineering staff has reviewed the request and concurs v1 owner that the water pipeline was moved into the public right-of-way and will no Ion within the public right-of-way. Therefor, the District is in agreement with the owner tt temporary pipeline easement granted to the District can be quitclaimed to the owner. FISCAL IMPACT: This item has no fiscal impact. The temporary easement was granted to the Distric no cost acquisition of the property, and the District will quitclaim the temporary eas for a no cost return of the property. The owner has paid the standard $200 f processing of a quitclaim. ENVIRONMENTAL REVIEW: The Planning Director has determined that this item is exempt in accordance with Guidelines Section 15061 (b)(3) (the “General Rule”). The activity is covered general rule that CEQA applies only to projects which have the potential for cai significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED, by the Board of Directors of the Car Municipal Water District as follows: 1. That the above recitations are true and correct. 2. That the Quitclaim Deed conveying a water pipeline easement over a porti Calavera Hills Village Q, Carlsbad Tract 85-32, Map No. 12950, CMWD Project No. 84 located north of Tamarack Avenue and east of Bluff Court granted 'to the Carl Municipal Water District, no longer contains water system facilities and will no longc necessary, which is on file with the Secretary and is incorporated by this referenc approved.
