EXPENDITURES FOR EMERGENCY REPAIRS TO
A BROKEN WATERLINE BETWEEN CARLSBAD

RECOMMENDED ACTION: Adopt Resolution No. II6 to declare an emergency situation and - .~ authorize an
expenditure for immediate repairs to a broken waterline between Carlsbad Village Drive and Oak Street, in an amount not to exceed $75,000.
ITEM EXPLANATION:
On January 22, 2001, the District was notified of a waterline leak in the alley between Carlsbad Village Drive and Oak Street and just west of Roosevelt Street. The line is an old 10 inch steel
waterline and was scheduled for replacement back in 1985. For reasons unknown the
waterline was never replaced. The District still has the original engineering drawing showing
the details of construction required for replacement of the existing 10 inch steel line with a new
10 inch waterline. Six customers are presently being serviced by a temporary highline (i.e. a temporary water service from a nearby fire hydrant through a parking lot by hoses to the
individual customers).
Because of the break in the waterline and possible safety and health concerns for the citizens
due to the nature of the temporary services, District staff requests that an emergency be
declared and authorization be granted to the executive manager to have the existing waterline
replaced without going through the formal bidding process and at a cost not to exceed $75,000.
This item was not posted on the CMWD meeting agenda for January 23,200l. However, the
Brown Act authorizes action on an item not previously placed upon an agenda at a regular
meeting when the Board of Directors determines that there is a need for immediate action which
cannot reasonably wait for the next regularly scheduled meeting. In this instance the disruption
of water service severely impairing the public health and safety would constitute such an
emergency. (CA Gov. Code, 9 54956.) The determination that a need for immediate action exists must be made by two-thirds of the total Board or, if two-thirds of the Board is not present,
by a unanimous vote of those remaining. (CA Gov. Code, § 54954.2(b)(2).)
FISCAL IMPACT: The cost of the repairs, in the maximum amount of $75,000 will be funded from the Water
District Capital Replacement Fund, Account No. 505-7000.
ENVIRONMENTAL REVIEW:
This project is exempt from environmental review pursuant to CEQA Guidelines section
15269(b) since it entails an emergency repair to public facilities necessary to maintain service.

A RESOLUTION OF THE BOARD OF DIRECTORS
OF THE CARLSBAD MUNICIPAL WATER DISTRICT,
CARLSBAD CALIFORNIA, DECLARING AN EMERGENCY
SITUATION AND AUTHORIZING IMMEDIATE
REPAIRS TO A BROKEN WATER LINE BETWEEN
CARLSBAD VILLAGE DRIVE AND OAK STREET.
WHEREAS, the existing waterline providing service between Carlsbad
~ Village Drive and Oak Street, just west of Roosevelt Street, is broken due to advanced
~ age, resulting in a disruption of service to adjacent residences; and
WHEREAS, service has been temporarily restored to the affected
residences by the connection of a highline along the surface of the properties; and
WHEREAS, because of the break in the waterline and the nature of the
temporary services there are possible safety and health concerns for the citizens; and
WHEREAS, any additional disruption of water service to the affected
properties may severely impair the public health, safety, or both; and
WHEREAS, such emergency situation requires immediate repair to the
line by a qualified contractor without the necessity for completing a formal bidding
process; and
WHEREAS, the project is exempt from environmental review pursuant to
CEQA Guidelines 25269(b), since it entails an emergency repair to public facilities
necessary to maintain service.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the
Carlsbad Municipal Water District, Carlsbad, California, as follows:
1. That the above recitations are true and correct.

2. That the foregoing constitutes an emergency situation requiring
immediate action which cannot reasonably wait for the next regularly scheduled
meeting of the Board of Directors of the Carlsbad Municipal Water District and requiring
that the District dispense with the formal bidding process.
3. That the Executive Manager is authorized to have the existing
waterline replaced at a cost not to exceed $75,000, utilizing funds from the Capital
Replacement Fund, Account No. 50570000.
4. This resolution shall take effect immediately upon its adoption.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Board
of Directors of the Carlsbad Municipal Water District held on the 23rd day of
January , 2001 by the following vote, to wit:
AYES: Council Members Lewis, Kulchin, Finnila, and Nygaard.
NOES: None
