ENG SERVICES RELATED TO LAKE CALAVERA IMPROVEMENTS, PRELIMINARY DESIGN REPORT, PROJECT NO. 38211 RECOMMENDED ACTION: CITY MGR. ,j& Adopt Resolution No., \\ag IO approve and authorize Amendment No. 1 to agreement with CGvL Engineers for additional pre-design services related to Lake Calavera Improvements, Preliminary Design Report, Project No. 38211. ITEM EXPLANATION: On June 15, 2000, an agreement by and between the Carlsbad Municipal Water District and CGvL Engineers was made and entered into for necessary engineering design services for preparation of Lake Calavera Improvements, Preliminary Design Report. The improvements include: inlet/outlet works repair; spillway remediation; access road improvements; water-quality control; and site control options. Mid-course study findings indicate that it would be prudent to perform additional investigations of existing facilities to support recommendations for final design. These tasks include: video survey of inletloutlet works; sediment, soil, and water quality testing; conduct bottom soundings; and agency review. FISCAL IMPACT: The proposal submitted by CGvL Engineers was in the amount not-to-exceed $40,000. RESOLUTION NO. 1128 A RESOLUTION OF THE BOARD OF DIRECTORS OF CARLSBAD MUNICIPAL WATER DISTRICT (CMWD) TO APPROVE AND AUTHORIZE AMENDMENT NO. 1 TO AGREEMENT WITH CGvL ENGINEERS FOR ADDITIONAL PRE-DESIGN SERVICES RELATED TO LAKE CALAVERA IMPROVEMENTS, PRELIMINARY DESIGN REPORT, PROJECT NO. 38211. 6 WHEREAS, on June 15, 2000, the Board of Directors of the Carlsbad Municipal Water 7 District of Carlsbad, California, approved an agreement with CGvL Engineers for the Preliminary 8 Design Report for the Lake Calavera Improvements (the “Agreement”); and WHEREAS, based on mid-course study findings, the Board of Directors of the Carlsbad 9 Municipal Water District of Carlsbad, California, has determined it necessary and in the public IO interest to amend the Agreement to provide additional pre-design services related to the ” Preliminary Design Report for the Lake Calavera Improvements; and 12 WHEREAS, the work contained in Amendment No. 1 will be provided at a cost 13 not-to-exceed $40,000 and there are sufficient funds in the existing appropriation. 14 NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal 1s Water District of the City of Carlsbad, California, as follows: 16 1. RECITALS WHEREAS, the initial agreement, dated June 15, 2000, identified a scope of work to provide the necessary engineering design services for preparation of Lake Calavera Improvements, Preliminary Design Report; and WHEREAS, the parties to this aforementioned agreement desire to alter the scope of work as follows: provide pre-design work involving field surveys, sampling, testing and analysis, in addition to agency review; and WHEREAS, a supplemental scope of work and fee schedule have been negotiated and agreed to between the parties hereto, and shown on Exhibit “A” Scope of Services and Fee; NOW THEREFORE, in consideration of these recitals and the mutual covenants contained herein, the District and Contractor agree as follows: 1. Contractor shall provide services as outlined on the attached Exhibit ‘A”. 2. District shall pay Contractor for all work associated with Paragraph 1 above, on a time and materials basis not-to-exceed $40,000. Contractor shall provide District on a monthly basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and related activities and costs for approval by District. 7/25/00 3. Contractor shall complete all work outlined on the attached Exhibit “A” by September 30,2001, or by the expiration of the agreement amended hereby. 4. All other provisions of. the aforementioned agreement entered into on June 15, 2000, by and between District and Contractor shall remain in full force and effect. 5. All requisite insurance policies to be maintained by the Contractor shall include coverage for the amended assignment and scope of work. Mid-course study findings indicate that it would be prudent to proceed with a series of pre-design tasks over the next two months, to support final design. If award of final design were to proceed in July -of this year on a fast-track basis, it is anticipated that the Lake Calavera immediate improvements could be completed by November of next year (2002). The proposed scope of work and schedule for the pre-design tasks is attached as Exhibit 1. These tasks have been discussed with you and/or your staff over the past several weeks and would be in addition to those under our current engineering service contract. Each of the ten tasks is described in terms of approach, methodology, results and time duration. The pre-design work involving field surveys, sampling, testing and analysis, as well as agency reviews would be carried out over approximately the next eight weeks during completion of our study report. Results and work products could be incorporated in the final report as well as subsequent facility design. For this additional work, we propose to use essentially the same project team as for the study, with some additional subcontractors for the field services. Key members of this team have performed similar work for CMWD in the ,past. All team members have- confirmed availability to pursue this work in a timely manner. Service fee estimates for the ten tasks are presented in Exhibit 2. We propose our engineering services for the above-noted scope of work to be completed within two months of notice to proceed, on a time-and-materials basis for a total fee not to exceed ‘$40,000 without additional CMWD authorization. This fee includes the cost of the subcontractors needed for the noted field services. Charges for miscellaneous direct expenses are included as part of the hourly billing rates for each labor category, and include standard software and computer usage, normal communication and postage, and minimal in-house photocopying. Charges for other direct expenses are billed at the actual cost or charge out rate, plus a service charge of 10 percent for expenses, and 10 percent for subconsultants.
