WATER PIPELINE CROSSING AND OVERSIZING PIPELINE 9/10/02 ADDITIONAL FUNDS FOR THE INTERSTATE 5 IMPROVEMENTS IN MERMAID LANE AND NEPTUNE DRIVE PROJECT NO. 36591 RECOMMENDED ACTION: Adopt Resolution No. 1168 approving appropriation of additional funds for the additional costs of the Interstate 5 water pipeline crossing and the oversizing water pipeline improvements in Mermaid Lane and Neptune Drive, Project No. 36591, ITEM EXPLANATION: The Carlsbad Municipal Water District (District) has completed construction of a 16-inch diameter water transmission main across Interstate 5 from Piovana Court west to Mermaid Lane. Mermaid Lane is within a development constructed by Greystone Homes, Inc. (Greystone), referred to as Poinsettia Shores Planning Area "C" and subsequently called "Santalina". The 16-inch diameter transmission main continues through the Santalina development within Mermaid Lane, and then Neptune Drive until connecting to an existing 16-inch diameter pipeline in Navigator Circle. To provide water to the Santalina development, Greystone was required to construct a minimum 8-inch diameter pipeline in Mermaid Lane and Neptune Drive. Greystone agreed to oversize the a 16-inch diameter. Greystone has constructed the 16-inch pipeline in Mermaid Lane and pipelines with a reimbursement agreement to pay for oversizing cost from an 8-inch diameter to Neptune Drive. The District's Board of Directors approved a reimbursement agreement with Greystone on July 18, 2000 with Resolution No. 1095. The District's reimbursement obligations are for the actual costs of pipeline oversizing in Mermaid Lane and Neptune Drive. Together, the costs for the Interstate 5 water pipeline crossing and water pipeline oversizing in Mermaid Lane and Neptune Drive have exceeded the estimates for the improvements and also exceeded the appropriated funds. An additional appropriation of $5,000 is necessary to cover the final costs of the project. ENVIRONMENTAL REVIEW The Planning Commission issued a Mitigated Negative Declaration for the Interstate 5 transmission main on January 5, 2000. The water pipeline in Mermaid Lane and Neptune Drive were incorporated into the environmental documentation and approval of a Negative Declaration for Poinsettia Shores Planning Area C by the City Council on March 21, 2000 by Resolution No 2000-89. FISCAL IMPACT: The construction of the Interstate 5 water pipeline crossing was done through Public Works Contract No. 3659-1. Appropriations to Capital Improvement Project No. 3659-1 fund both the Interstate 5 waterline crossing and the oversizing of pipeline in Mermaid Lane and Neptune Drive. A total of $982,000 has been appropriated for this project. The actual costs for the Interstate 5 water transmission main and oversizing cost for the Mermaid Lane and Neptune Drive water pipeline have exceeded the total estimated cost and the project's appropriated funding. An additional appropriation from the Water Connection Fund of $5,000 is necessary to cover the total cost of the project. The following table is a summary of the project cost. WHEREAS, the District has completed construction of the 16-inch diameter water transmission pipeline across Interstate 5 from Piovana Court west to Mermaid Lane, continuing in Mermaid Lane then into Neptune Drive; and WHEREAS, that portion of the pipeline in Mermaid Lane and Neptune Drive are within a development built by Greystone Homes, Inc., referred to as Poinsettia Shores Planning Area "C" and subsequently called "Santalina" has been constructed by Greystone Homes, Inc.; and WHEREAS, The Planning Commission issued a Mitigated Negative Declaration for the Interstate 5 transmission main on January 5,2000; and WHEREAS, The water pipeline in Mermaid Lane and Neptune Drive were incorporated into the environmental documentation and approval of a Negative Declaration for Poinsettia Shores Planning Area C (Santalina) by the City Council on March 21, 2000 by Resolution No 2000-89; and WHEREAS, Greystone Homes, Inc., and the District entered into an agreement in which the District would reimburse Greystone Homes, Inc., for construction cost to oversize Santalina's 8-inch diameter water pipelines in Mermaid Lane and Neptune Drive to a 16-inch diameter pipeline; and WHEREAS, appropriation of funds for this project was based on a preliminary cost estimate for both the Interstate 5 water pipeline crossing and the oversizing of water pipeline in Santalina; and WHEREAS, costs for both the Interstate 5 crossing and oversizing of pipeline within Santalina have exceeded the cost estimates and appropriated funds for the project; and WHEREAS, to cover the District's ,reimbursement obligations to Greystone Homes, Inc., an additional appropriation of $5,000 from the Water Connection Fund is required; and WHEREAS, the District's payment of the reimbursement obligations to Greystone Homes, I Inc., is the final payment for costs relating to this project . That the above recitations are true and correct: 2. That to cover the costs for this project, an additional appropriation of $5,000 is necessary ; 3. That the appropriation increase of $5,000 from the Water Connection Fund to the project is hereby approved: 4. That the Finance Director is authorized to appropriate $5,000 into the project account.
